1.\tHeard
\nthe learned counsel for the applicant and the learned counsel for the
\nopponent.\n<\/p>\n
2<\/span><\/p>\n
  Present application has been taken out by applicant Pinkiben
\nRaktimbhai Chauhan seeking below-mentioned reliefs:\n<\/p>\n
 6(B)
\n That Your Lordships may be pleased to transfer the proceedings of
\nHindu Marriage Petition No.967 of 2008 from the Court of learned
\nFamily Court, Ahmedabad to the Court of learned Chief Judicial
\nMagistrate, Bhavnagar in the interest of justice.\n<\/p>\n
 6(C)
\nThat this Honourable Court may be pleased to stay the further
\nproceedings at Hindu Marriage Petition No.967 of 2008 pending in the
\nCourt of learned Family Court, Ahmedabad, pending the admission,
\nhearing and final disposal of this application.\n<\/p>\n
3.\tDuring
\nthe pendency of the proceedings the contesting parties had expressed
\ntheir willingness to explore the possibility of settlement, and
\ntherefore, with the consent of the parties and in view of the
\nwillingness of the parties, the proceedings were referred for
\nMediation.  The Mediation Centre has, by communication dated
\n12.3.2010, submitted that as per the report of the learned Mediator,
\nthe mediation proceedings have succeeded and the parties have arrived
\nat mutually agreeable and amicable settlement.  The learned Mediator
\nhas, in his report dated 11.3.2010 which is signed by the petitioner,
\nthe respondent and their respective advocates as well as father of
\nthe petitioner and the father of the respondent, stated as follows:\n<\/p>\n
 During
\nthe mediation negotiations take place between the parties, I have
\nalso tried to convince the parties to settle all the disputes between
\nthem and after due deliberation in the joint meeting as well as the
\nseparate sessions with the parties and after discussing and
\nnegotiating with the parents of the parties, the parties have agreed
\nto settle the dispute as a whole.  The parties have arrived at
\namicable settlement and they have jointly submitted the terms of
\nsettlement before me as agreed during the mediation. Terms of the
\nsettlement are read over and explained to the respective parties and
\nthey have stated that they have signed the settlement independently,
\nwithout any pressure, fear and coercion and upon their freewill.
\nThey have agreed that terms of the settlement are agreeable to them
\nand it is full and final settlement between them and the same
\nsettlement is Annexed hereto and Mark  Annexure   I .\n<\/p>\n
   In
\nshort the terms of the settlement suggest that the parties have
\nagreed to take divorce as there is no possibilities of their re-union
\nand both the parties will give consent in the pending proceedings for
\ngiving divorce by consent as it is not possible for them to live
\ntogether.  The husband has agreed to pay a sum of Rs.17,51,000=00 to
\nthe wife Pinkiben for the maintenance of herself and son Krishna.
\nThey have also stated in the terms of the settlement the manner in
\nwhich the maintenance amount is to be paid.  They have agreed to
\nwithdraw all the proceedings filed against each other from the
\nconcerned Courts and the present settlement which is annexed as
\nMark-I is full and final settlement between them.  Care is also taken
\nfor the minor son in the settlement.\n<\/p>\n
4.\tThe
\nlearned Mediator has also forwarded alongwith his aforesaid report,
\nthe consent terms arrived at between the parties which appears to
\nhave been executed on 11.3.2010 and is signed by the respective
\nparties.\n<\/p>\n
5.\tThe
\nlearned counsel of both the parties  have admitted the consent terms.
\n The applicant and the opponent are also present in the Court and in
\nreply to the specific querry by the Court to the applicant and the
\nopponent they have admitted the consent terms as well as the report
\nof the learned Mediator and they have agreed to abide by the terms
\nand conditions mentioned in the settlement dated 11.3.2010. The
\nlearned counsel for the parties have jointly relied upon the judgment
\nof the Hon’ble Apex Court in the case between Aparna Goyal vs.
\nRakesh Goyal<\/a> reported in 2009 AIR SCW 1447 wherein the Apex Court
\nhas taken note of a settlement arrived at between the parties during
\nmediation proceedings and having taken note of the terms of the full
\nand final settlement, disposed of the SLP directing the parties to
\nabide by the terms of the settlement and also directed the learned
\ntrial Court to pass appropriate order of decree granting divorce by
\nmutual consent by dissolving the marriage, in view of the settlement
\nbetween the parties. The Hon’ble Apex Court, in para 3 of the
\njudgment, has observed thus:\n<\/p>\n

\n  In HMA No.37\/2006 the divorce by mutual consent be passed in terms
\nof Section 13B(1) and 13B(2) of the Hindu Marriage Act, 1956 by
\ndissolving the marriage between the husband Rakesh and Aparna Goyal,
\nthe wife in terms of this order.\n<\/p>\n

\nThe settlement provides that the custody of the child namely minor
\nson Krishna shall remain with the mother i.e.  the
\napplicant-petitioner herein. The relevant Clause 3 reads thus:\n<\/p>\n
 The
\ncustody of minor son Krishna shall remain with mother applicant
\nherein and respondent husband will not make any issue about the
\ncustody of the son. Both the parties have agreed that after son
\nKrishna attains the age of majority he will be free to decide
\nindependently that with whom he will reside and, if the applicant
\nmother remarriage in future, then it will be open for the respondent
\nhusband to ask for the custody of son.\n<\/p>\n
7.\tSo
\nfar as the minor son is concerned the parties shall abide by the said
\nterm of the agreement.\n<\/p>\n
8.\tIn
\nview of the full and final settlement arrived at between the parties,
\nread with the report of the learned Mediator and having regard to the
\nadmission of the consent terms declared by the applicant and the
\nopponent who are present in the Court, present application is
\ndisposed of as settled by way of mediation and in terms of the full
\nand final settlement.  Any order with regard to the relief of
\ntransfer of proceeding is, therefore, not required at this stage.
\nHence the applicant seeks permission to withdraw this application
\nwith a liberty to place the full and final settlement on record of
\nthe respective Courts where the proceedings are pending.\n<\/p>\n
9.\tAs
\nand when copy of full and final settlement, along with the report  of
\nthe Mediator is placed on record, the trial Court shall dispose of
\nthe proceedings in accordance with law after taking into account the
\nfull and final settlement as well as the report of the learned
\nMediator.\n<\/p>\n

\n Since, in view of the settlement between the parties, the parties
\njointly request for  divorce  by mutual consent, the trial court
\nshall pass necessary and appropriate orders, in accordance with law
\nin the HMP Suit No.967 of 2008 pending in the Family Court at
\nAhmedabad.\n<\/p>\n
11.
\n In view of the full and final settlement dated 11.3.2010 arrived at
\nbetween the parties and referred  by the learned Mediator in his
\nreport, the opponent shall pay a sum of Rs.17,51,000\/- to the
\napplicant (his wife Pinkiben) for maintenance of herself and son
\nKrishna.\n<\/p>\n
12.\tThe
\nparties shall withdraw the proceedings filed against each other from
\nthe concerned courts by placing the settlement and the report of the
\nlearned Mediator on record.\n<\/p>\n
13.\tThe
\nopponent has assured the Court that the cheque will be duly cleared
\nand honoured.\n<\/p>\n
14.\tWith
\nthe aforesaid clarification and direction, the application is
\ndisposed of as withdrawn\/not pressed.  The parties are at liberty to
\nplace present order as well as the consent terms and report of the
\nlearned Mediator on record of the proceedings before the concerned
\ncourt and request for appropriate final orders in the proceedings.\n<\/p>\n
