Justice S.S.SATHEESACHANDRAN\n\n Dated :22\/01\/2010\n\n O R D E R\n               S.S.SATHEESACHANDRAN, J.\n           ------------------------------------------------\n                  W.P.(C).No.2156 of 2010\n            -----------------------------------------------\n        Dated this the 22nd day of January, 2010\n\n                           JUDGMENT\n<\/pre>\n<p>        The petitioners are the defendants 1 and 2 in<\/p>\n<p>O.S.No.740\/08 on the file of the 2nd Additional Sub<\/p>\n<p>Court, Ernakulam. The above suit is one for recovery<\/p>\n<p>of possession and the respondents are the plaintiffs.<\/p>\n<p>        2. Respondents 1 to 3 are the plaintiffs in the<\/p>\n<p>suit and the other respondents are the co-defendants<\/p>\n<p>resisting the suit. The petitioners\/defendants have<\/p>\n<p>filed a written statement in which among other<\/p>\n<p>contentions, they have disputed the identity of the<\/p>\n<p>suit property as well. On the application of the<\/p>\n<p>plaintiffs\/respondents          1     to      3,     an    advocate<\/p>\n<p>commissioner has been appointed to measure out the<\/p>\n<p>suit property with the assistance of a private<\/p>\n<p>surveyor. Imputing bias and partiality on the part of<\/p>\n<p>the   surveyor      deputed        to    assist      the   advocate<\/p>\n<p>W.P.(C).No.2156 of 2010<\/p>\n<p>                         :: 2 ::\n<\/p>\n<p>commissioner      and   seeking    his   removal    and<\/p>\n<p>appointment of a Taluk Surveyor in his place, the<\/p>\n<p>petitioners, it is submitted, had moved Ext.P3<\/p>\n<p>application before the court below. That application,<\/p>\n<p>after hearing both sides, it is submitted by the<\/p>\n<p>counsel, was dismissed on 11.12.2009. Though the<\/p>\n<p>petitioners have applied for issue a carbon copy of<\/p>\n<p>the order, the grievance canvassed is that till date, it<\/p>\n<p>has not been furnished.         The petitioners have,<\/p>\n<p>therefore, filed the present writ petition, invoking the<\/p>\n<p>supervisory jurisdiction vested in this court for issue<\/p>\n<p>a writ, direction or order to the court below to issue a<\/p>\n<p>copy of the order passed on Ext.P3 application and,<\/p>\n<p>also to provide a breathing time to challenge that<\/p>\n<p>order by keeping in abeyance the measurement of the<\/p>\n<p>suit property for a short period.\n<\/p>\n<p>        3. Considering the submissions made and<\/p>\n<p>taking note of the facts and circumstances, I find, no<\/p>\n<p>W.P.(C).No.2156 of 2010<\/p>\n<p>                         :: 3 ::\n<\/p>\n<p>notice to the respondent is necessary and it is<\/p>\n<p>dispensed with. There will be a direction to the court<\/p>\n<p>below to issue a copy of the order passed on Ext.P3<\/p>\n<p>application, if already applied for, within a period of<\/p>\n<p>five days from the date of receipt\/production of a<\/p>\n<p>copy of this judgment.
