\nPeti;tionle’r,Ai.ifav (\u00a7foverii:rnent_Vofficial, was posted as<\/p>\n
Manager leaf’ = l{u*kVi{e’._f._:S’ree~.’\u00abSubramanya Devasthana,<\/p>\n
Sui:pramanya,_:’and.’– vv’asV””subsequently transferred to Hassan<\/p>\n
  (;Tieve~r.nme’n\u00e9t”Order dated 14-07-1993. It was alleged<\/p>\n
  he was relieved of his duties, but he<\/p>\n
lldeispitse.  relieved from the post committed tress pass
\n into  premises on 17-O9-1993 and gained entry into the
\n  of the Manager by removing lock put to the door and<\/p>\n
9′ \u00e9damaged other articles. After gaining entry, using force into<\/p>\n

\nU<\/p>\n
the chamber by the Manager, he kept control over the
\nbelongings of the Manager in the chamber and prevented
\nthe regular Manager from discharging his duties. Qn report<\/p>\n
from the Executive Officer of the tempie af”ca”s.e”‘..,was<\/p>\n
registered and on investigation charge <\/p>\n
against him arraigning him for””‘th.e,  p’uvnjishi’aolVei\u00ab<\/p>\n
under Section 448, 427 and 506(1) <\/p>\n
3. During trial  eiiamijned
\nwitnesses and produced 9 do’curfe’n”ts. Tihiouigh-tithe accused
\nresisted the charge  trial judge found<\/p>\n
the evidence   a:cts’_:est’ablivshed of the accused<\/p>\n
beyond :’easo’i:a:’b.|:ei (;lOu:Ij”t..antd it falls within the mischief of
\nSections’*.<i\u00a748,V Consequently, he was convicted<\/p>\n
b\\,r\u00ab}gt'he~ imptignied judgement in c.c. No.342\/1993 and<\/p>\n
\u00bbA ;sente,nced,:t'e. punishment. It was assailed by him in Cr}. A.<\/p>\n
  the First Appellate Court on reappraisal of<\/p>\n
ev'i'der'i,ce""also found that the guilt of the accused was<\/p>\n
 "p*i<ozved'. But, he modified the sentence. Against the said<\/p>\n
'AA'-ijiudgement this revision is filed.<\/p>\n

4. The learned counsel Sri C.H. Jadhav, appearing
\nfor the petitioner assailing the concurrent finding of the trial
\ncourt and First Appellate Court would contend that_.._c__>n close<\/p>\n
scrutiny of the evidence it is noticed that the verv’–n”a.t’urAe of<\/p>\n
the allegations made against the accusedj::did.::’n’o’t”i <\/p>\n
within the ambit of the provisionsiwh.i.ch  <\/p>\n
invoked. In this regard he
\naccused is the Governmentlocffiicial  A’a.s”‘ivianager”to
\nwork in Kukke Sree vSubramianxv\u00a7i~.D’evasthanva., Gubramanya,
\nwhich post he held co'”rit’i\ufb01hcu<5usiiy,1 1' V G<\/p>\n
5.  iearliiiedl:co:unsAe:li”_:wVoVu|’d ivfurther submit that<\/p>\n
the order’ of by the Government was the
\nsubject matterVV’0f2uw.rii’t.petition in W.P. No. 23170\/1992 and<\/p>\n
Court  interim order on 08-07-1993 staying<\/p>\n
\u00bb the of the order passed by the Government with<\/p>\n
 ‘transferring the petitioner to the new post.<\/p>\n
Coiiseiquently, petitioner continued to serve in the said post<\/p>\n
 and had not handed over the charge. Later, the this Court<\/p>\n
\ufb02dlisposed of the writ petition by an order dated 15-07-1993,<\/p>\n
H pursuant to which the Government wanted to implement the<\/p>\n

order of transfer. He submits that even though from the
\nnature of the order passed by the this Court it couldlzie seen<\/p>\n
that the transfer of the petitioner was cha|iVe.n’g\u00bbed’<\/p>\n
Court, which was stayed for a period, theV__qi’ue.stiionVVl’is _to\u00ab._<\/p>\n
whether the petitioner had in  han..ded -:ovle”r’–tVhe”:cVha’i+ge7.__ it<\/p>\n
as on the date the alleged inciden4t’.occ.urredfig  ” ” V<\/p>\n
6. In this regard   would submit
\nthat the records mai”r’itai.nedh’  passed by the
\nDeputy Commiss_ionel*”‘b’ea’r  interim order
\nobtained “i7n:\u00a7*v.ord:e’r’V’dated 2o~o7-1993 by
\nthe  iwtigsgiiidirecting the Tahsildar, in
\nviewiiof th’eAV.inte’riVm’olrdlegrtlranted by this Court to hand over
\ncharge accordingly that order was<\/p>\n
ccrtinpiied.  in: confirmation to the handing over the<\/p>\n
\u00bb Vlc-h_a:ge’\u00aban4ot~her correspondence was issued on 27-O2~1993<\/p>\n
  He drew my attention to the<\/p>\n
re\u00e9\u00e9presventaition made by the petitioner on O7\u00abO9–1993, in<\/p>\n
 C’ whgich\ufb02lthe petitioner has referred not only to the orders of<\/p>\n
 Court but to the order of cancellation whereby the<\/p>\n
H petitioner because entitled to continue in the Office.<\/p>\n

7. Mr. Eadhav, would further submit that these
\ndocuments were not placed before the trial court yet in<\/p>\n
order to know the factual position as on the date”i’\u00e9:Lf;~\u00ab_i”7j09-<\/p>\n
1993, when the offence is alleged to have beienv<\/p>\n
he has produced the same.\n<\/p>\n

8.  Iimite;d””ex’tent;x’Ihalve also permitted him<\/p>\n
to   which are undoubtedly the
\ncorresporl-dence’olrltjln.aAte:d–‘ from the Office of the Deputy<\/p>\n
Comm’issi4o*ner,V .D’:.–Kl’,*. Mangalore. The learned trial judge and<\/p>\n
 First “Appe|’lat’e”‘Judge have come to the conclusion that<\/p>\n
thecraictof\u00e9vthejpetitioner in removing the lock and damage to<\/p>\n
the  the door of the chamber was the act of tress<\/p>\n
 pass..V__Aand his Continuance in the chamber attracts<\/p>\n
 lvi.ngjj’.l”edients of offence punishable under Section 448 IPC and<\/p>\n
damage caused by him attract the offence under Section<\/p>\n
427 IPC.\n<\/p>\n
9. The learned Government PEeadV.e._r_”~vw:i”ir}:..V”R.aja<\/p>\n
Subramanya Bhat, in support of the impugried <\/p>\n
contend that the conduct of the”petit.i\u00e9on.er:V’was’=o*ne”:of?’ <\/p>\n
defiance. He refused to comp|yA:’w;vit’hV_A.thethe”ordet””ofV”thVe
\nGovernment and soon after’=hi’sytransf.er   had
\ntaken charge. By virtue oyfi”t’tiej’interim ord’ei’i*”obtained by
\nhim from this Court hetriedt-oi’evntperttftiieiffpcwhamber. But vide
\nEx.P6 a  Tahsildar to take
\ncharge ore’  there can be no doubt as
\non the .fwt.aiis’v—-..is5ued, the Tahsildar had taken
\ncharge’fofcjthevvfpostfof\u00bb’t’h:e-\ufb01fanager and the petitioner had no<\/p>\n
manner of rilg-htto he either in the Office as Manager or<\/p>\n
it keep _controi~-.of the institution in any manner. He submits<\/p>\n
   removed the lock and gained entry in the<\/p>\n
over which ciaim was last. Such act is the proof<\/p>\n
 “itse_if that he committed tress pass and was liable to be<\/p>\n
fuipunished for that offence.\n<\/p>\n

10. These facts undoubtedly are borne from the
\nrecords, but it is not in dispute that after suffering an order
\nof transfer of the post of Manager, the petitionenhad not<\/p>\n
handed over the charge, as could be <\/p>\n
endorsement issued by the Deputy  <\/p>\n
order of interim stay by this “”da’te’d–..:<\/p>\n
passed after hearing both sirdes an’d._in’- pursuance_V’of
\norder the petitioner — accuseidiattemptedf.  office as
\nManager. The inciai\u00e9flft  hiavyefx accrued on
\n17:09:1993, Aywhich    10 days after<\/p>\n
representation’ftgyvyagKygiy\u00e9fn petitioner to the<\/p>\n
Government; _ “ff, <\/p>\n
11′.,__4 iiTVhe’refoVre\u00bb’,.:’i’t~ cannot be said that as on 17~O9~<\/p>\n
 the petitionver yvas still in Office as Manager or that he<\/p>\n
.:ha_d’_physiVca,E__ control over the premises as also other<\/p>\n
 much has been urged by the learned<\/p>\n
Go”ver’n:me’nt Pieader in pointing to the criminal attitude of<\/p>\n
  “the petitioner, yet on close scrutiny of the material evidence<\/p>\n
‘AA’–:ofr2’Afrecord I find though the evidence in the first look may<\/p>\n
‘appear as indicting the accused but on closer examination<\/p>\n

such evidence does not establish the charge beyond<\/p>\n
reasonable doubt.\n<\/p>\n
12. The whole prosecution case rests-V:._”on”.,’4the<\/p>\n
statement given by Mr. C.H.Kochannaitnelw\u00e9<\/p>\n
incumbent as Manager and employeeyof   name; <\/p>\n
Mr. Ganesha Achari. The accused  it<\/p>\n
C.H.Kochanna Rai (PW5) su_c:cessfuAl.l’y.__broVu’g.ht’:..:contr’adiction
\nin his testimony before thegi.Cogu’:rt”a.nd t’h’e’vstat\u00bbement given
\nduring investigation  163. Cr.P.C. The
\nrelevant and D4. In Ex.D3,
\nthe   stated that on
\n  the Office premises ‘to take
\ncharge  JtManager from the accused’.\n<\/p>\n
 his i*eq.uest&:’the accused refused to hand over the<\/p>\n
b ‘A\u00aband”wa|ked away without handing him the charge of<\/p>\n
 =t’h’erpostT’_’o.fMatnager. The witness further attempted to say<\/p>\n
thhuatwhiletttthe accused was going he took away the keys of<\/p>\n
 “t;i*:–en chamber of the Manager. Nothing is stated about<\/p>\n
ta’-Zailleged act of tampering with the lock or destroying the<\/p>\n
 properties.\n<\/p>\n
are with the accused there is no question of tress passing
\ninto the chamber and gaining entry into the chamber.\n<\/p>\n
15. Lastfy, it could be observed that.-gall the<\/p>\n
witnesses examined by the prosecution are those’-.ivh”o.,are<\/p>\n
under the controi of Tahsildar and on whose’ <\/p>\n
was initiated. Their statements”‘are\u00ab.oni,y x:n’atur’e, of; <\/p>\n
reaffirming each other’s statement’ abfout actuaI..
\nIn the circumstances, the Vev.,i:d’ence iead’ b,y_’*_th’e:”o’r’0secuti’0’n
\nis not ciinching to esta.biish..st’he.’i_cha’rge agai’nsst-the accused<\/p>\n
for the offence indicated _sa’b0vc-7; <\/p>\n
  offence under Section
\n506(1V1)\u00bbIi>C th’e,_ai{_eg2ati.0h\u00abis accused had threatened Ganesh
\nAchari, but no sacceptafbsle evidence is avaifable to establish<\/p>\n
 = the reasons discussed above, I am satisfied<\/p>\n
that  of the petitioner accused for the offences<\/p>\n
 punishabie under Section 448, 427 and 506(1) Mac, is not<\/p>\n
