Justice M.C.HARI RANI\n\n Dated :11\/06\/2009\n\n O R D E R\n                R.BASANT &amp; M.C.HARI RANI, JJ.\n          --------------------------------------------------\n                  W.P.(C)No.17048 OF 2007\n        -----------------------------------------------------\n            DATED THIS THE 11th DAY OF JUNE, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>Basant, J.\n<\/p>\n<p>      This petition has been filed by the petitioner against an<\/p>\n<p>interlocutory order passed by the Family Court in an Original<\/p>\n<p>Petition filed by her claiming maintenance and realisation of<\/p>\n<p>money and consequential reliefs. The petitioner had applied for<\/p>\n<p>attachment of the property.         That petition was dismissed.<\/p>\n<p>Thereafter, the present application was filed seeking reliefs to<\/p>\n<p>ensure that she is not forcibly thrown out of possession of the<\/p>\n<p>property.\n<\/p>\n<p>      2.    The respondent had entered appearance and resisted<\/p>\n<p>the prayer.     The learned Judge has vide impugned order<\/p>\n<p>dismissed the petition.\n<\/p>\n<p>      3.    The petitioner claims to be aggrieved by the impugned<\/p>\n<p>order.   What is her grievance?       The learned counsel for the<\/p>\n<p>petitioner submits that the order has been passed without giving<\/p>\n<p>the petitioner an opportunity to adduce evidence and the<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.17048\/07            -2-<\/span><\/p>\n<p>petitioner shall be able to satisfy the learned Judge that her<\/p>\n<p>prayer for reliefs is justified. But, opportunity to adduce evidence<\/p>\n<p>has not been granted to her. An opportunity may be given to her<\/p>\n<p>to place relevant materials before the court below. This is the<\/p>\n<p>short prayer raised by the petitioner.\n<\/p>\n<p>      4.   We see from the records that no documents have been<\/p>\n<p>marked on the side of the petitioner. Notice was issued to the<\/p>\n<p>respondent.    Respondent has not entered appearance.         Notice<\/p>\n<p>was given to his counsel, who is appearing before the court<\/p>\n<p>below. Still, there was no appearance.\n<\/p>\n<p>      5.   Having considered all the relevant circumstances, we<\/p>\n<p>are persuaded to agree that the request of the petitioner can be<\/p>\n<p>accepted and the petitioner can be granted an opportunity to<\/p>\n<p>substantiate her contentions in the petition.<\/p>\n<p>      6.   In the result, this petition is allowed. The impugned<\/p>\n<p>order Exhibit P4 is set aside. The learned Judge of the Family<\/p>\n<p>Court is directed to dispose of I.A.No.2897\/06 after giving the<\/p>\n<p>parties an opportunity to raise all their contentions and produce<\/p>\n<p>appropriate evidence in support of their assertions. The court<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.17048\/07         -3-<\/span><\/p>\n<p>below shall dispose of the I.A. within a period of 45 days from the<\/p>\n<p>date on which a copy of this judgment is placed before the Family<\/p>\n<p>Court.\n<\/p>\n<p>     7.
