Justice A.K.BASHEER\n\n Dated :26\/09\/2008\n\n O R D E R\n                  H.L.DATTU, C.J. &amp; A.K.BASHEER, J.\n                         -------------------------------------------\n                              S.T.Rev.No.397 of 2006\n                        ------------------------------------------\n                  Dated, this the 26th day of September, 2008\n\n                                    ORDER\n<\/pre>\n<p>H.L.Dattu, C.J.\n<\/p>\n<p>               This Sales Tax Revision is directed against the orders passed<\/p>\n<p>by the Kerala Sales Tax Appellate Tribunal, Additional Bench, Kozhikode<\/p>\n<p>in T.A.No.270 of 2004 dated 28th April, 2005.<\/p>\n<p>               (2) Petitioner is engaged in the sales of the water supply and<\/p>\n<p>sanitary fittings including motor pumps, compressors, etc.<\/p>\n<p>               (3) The returns filed by the assessee for the assessment year<\/p>\n<p>1999-2000 was not accepted by the assessing authority and accordingly<\/p>\n<p>relying on the check post declaration, has completed the best judgment<\/p>\n<p>assessment as provided under Section 17(3) of the Kerala General Sales<\/p>\n<p>Tax Act, 1963 (&#8216;the Act&#8217; for short) and has made certain additions towards<\/p>\n<p>the probable omissions and suppressions.<\/p>\n<p>               (4) Aggrieved by the said order, the assessee had filed first<\/p>\n<p>appeal before the first appellate authority. The first appellate authority<\/p>\n<p>while rejecting the appeal has concurred with the findings and conclusions<\/p>\n<p>reached by the assessing authority.\n<\/p>\n<p>S.T.Rev.No.397 of 2006<br \/>\n<span class=\"hidden_text\">                                          2<\/span><\/p>\n<p>              (5)   Inter alia, questioning the correctness or otherwise of<\/p>\n<p>the orders passed by the first appellate authority, the assessee had filed<\/p>\n<p>second appeal before the Sales Tax Appellate Tribunal in T.A.No.270 of<\/p>\n<p>2004.    The Tribunal by its orders dated 28.4.2005        has rejected the<\/p>\n<p>assessee&#8217;s appeal.\n<\/p>\n<p>              (6) Being aggrieved by the aforesaid orders, the assessee is<\/p>\n<p>before us in this Sales Tax Revision.\n<\/p>\n<p>              (7) The assessee has framed the following questions of law<\/p>\n<p>for our consideration and decision. They are as under:<\/p>\n<blockquote><p>               &#8220;i) Whether the order of the Sales Tax Appellate<\/p>\n<p>        Tribunal is correct on law, facts and circumstances of the<\/p>\n<p>        case?\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>               ii) The petitioner stated case before the Appellate<\/p>\n<p>        Tribunal was that the petitioner was in possession of the<\/p>\n<p>        book of accounts and he was prevented from producing<\/p>\n<p>        the same before the assessing authority by reason of ill<\/p>\n<p>        health and he had requested for an opportunity for<\/p>\n<p>        production of the same. Has not the Tribunal erred in law<\/p>\n<p>        in sustaining the assessment order without giving an<\/p>\n<p>        opportunity to the petitioner to produce the books of<\/p>\n<p>        accounts?\n<\/p><\/blockquote>\n<p>S.T.Rev.No.397 of 2006<br \/>\n<span class=\"hidden_text\">                                          3<\/span><\/p>\n<p>               iii) Form No.27B declarant ought to have been put<\/p>\n<p>        to the test of cross examination and Section 30B(4)<\/p>\n<p>        proceedings should have been initiated against the alleged<\/p>\n<p>        consignor. The tribunal did not apply its mind to this<\/p>\n<p>        specific contention of the petitioner raised before it. Is the<\/p>\n<p>        finding of the tribunal ignoring relevant contentions of the<\/p>\n<p>        petitioner   and   based   on    irrelevant  considerations,<\/p>\n<p>        sustainable on law, facts and circumstances of the case?<\/p>\n<p>               iv) The Tribunal ought to have found that the<\/p>\n<p>        additions made by the assessing authority are highly<\/p>\n<p>        excessive, arbitrary and have no rational nexus with the<\/p>\n<p>        defects noted. Has not the tribunal grossly erred in law<\/p>\n<p>        and on facts in sustaining the additions made by the<\/p>\n<p>        assessing authority?\n<\/p>\n<p>              (8)   The order of assessment passed by the assessing<\/p>\n<p>authority for the assessment year in question is on estimation basis.<\/p>\n<p>              (9) Time and again the apex Court has observed that in<\/p>\n<p>exercise of the powers of this Court under Section 41 of the Act, it can<\/p>\n<p>only look into whether the Tribunal has failed to decide a question of law<\/p>\n<p>or has erroneously decided a question of law.<\/p>\n<p>              (10) The Supreme Court in the case of       Commissioner of<\/p>\n<p>Sales Tax Madhya Pradesh Vs. H.M.Esufali H.M.Abdulali {1973 (32)<\/p>\n<p>STC 77) has stated as under:\n<\/p>\n<p>S.T.Rev.No.397 of 2006<br \/>\n<span class=\"hidden_text\">                                          4<\/span><\/p>\n<p>        &#8220;The reassessments were valid. From the circumstance<br \/>\n        that the assessee had dealings outside the accounts of the<br \/>\n        value of Rs.31,171.28 for 19 days, it was open to the<br \/>\n        officer to infer that the assessee had large scale dealings<br \/>\n        outside the accounts.     In such a situation, it was not<br \/>\n        possible for the officer to find out precisely the turnover<br \/>\n        suppressed and he could only make an estimate of the<br \/>\n        suppressed turnover on the basis of the material before<br \/>\n        him.   So long as the estimate made by him was not<br \/>\n        arbitrary and had a reasonable nexus with the facts<br \/>\n        discovered, it could not be questioned. It was wrong to<br \/>\n        hold that the officer must have material before him to<br \/>\n        prove the exact turnover suppressed.&#8221;\n<\/p>\n<p>             (11)    This is a case of best judgment assessment. In that<\/p>\n<p>best judgment assessment, the assessing authority had the advantage of<\/p>\n<p>verifying the records.    On   verification of the records,   the assessing<\/p>\n<p>authority had found that several check post declarations received from the<\/p>\n<p>check post were not seen accounted in the purchase list produced by the<\/p>\n<p>assessee,   and that in spite of repeated notices, the assessee has not<\/p>\n<p>produced the books of accounts before him for verification.      Therefore,<\/p>\n<p>based on the information available, the assessing authority has completed<\/p>\n<p>the best judgment assessment. It is not a case where the best judgment<\/p>\n<p>assessment has been made without any basis whatsoever.<\/p>\n<p>             (12) In that view of the matter, we are of the opinion that no<\/p>\n<p>question of law as such would arise in this revision petition for our<\/p>\n<p>consideration and decision.\n<\/p>\n<p>S.T.Rev.No.397 of 2006<br \/>\n<span class=\"hidden_text\">                                        5<\/span><\/p>\n<p>             (13)   Therefore, while rejecting the revision petition, we<\/p>\n<p>confirm the orders passed by the Tribunal.<\/p>\n<p>             Ordered accordingly.\n<\/p>\n<\/p>\n<p>                                                   (H.L.DATTU)<br \/>\n                                                  CHIEF JUSTICE<\/p>\n<p>                                                  (A.K.BASHEER)<br \/>\n                                                     JUDGE<br \/>\nvns<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court D.
