SHAH\n\t\t\n\t\n\n \n\nDate\n: 23\/10\/2008 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tHeard<br \/>\nMr.C.B.Upadhyaya for the appellant ?  original plaintiff and<br \/>\nMr.Tushar Mehta, learned Senior Advocate with Mr.Rutvij Oja, learned<br \/>\nAdvocate for the respondents ?  original defendants.\n<\/p>\n<p>2.\t\tPresent<br \/>\nAppeal from Order is by the appellant ?  original plaintiff to quash<br \/>\nand set aside the order passed by the learned 8th Senior<br \/>\nCivil Judge, Bhavnagar dated 10.10.2008 passed below Exh.5 in Special<br \/>\nCivil Suit No.92 of 2007 in dismissing the same.  The appellant ?<br \/>\nherein ?  original plaintiff has instituted Special Civil Suit No.92<br \/>\nof 2007 in the Court of learned Senior Civil Judge, Bhavnagar for<br \/>\nspecific performance of agreement to sale dated 22.07.1994 with<br \/>\nrespect to disputed land. In the said Suit the appellant had<br \/>\nsubmitted application for interim injunction below Exh.5 restraining<br \/>\nthe defendants from transferring, alienating and\/or creating any<br \/>\nthird party rights with respect to disputed land. The learned trial<br \/>\nCourt after considering the submissions made on behalf of the both<br \/>\nthe parties dismissed the application Exh.5. Being aggrieved and<br \/>\ndissatisfied with the same, the appellant ?  original plaintiff has<br \/>\npreferred present Appeal from Order.\n<\/p>\n<p>3.\t\tAfter<br \/>\nmaking submissions on merits, Mr.Upadhaya, learned Advocate for the<br \/>\nappellant does not invite any reasoned order and therefore, while<br \/>\ndismissing present Appeal from Order, this Court is not assigning any<br \/>\nfurther detailed reasoned order. However, suffice it to mention that<br \/>\nconsidering the fact that agreement to sale is of 1994 of which<br \/>\nSpecific performance is sought and Suit has been filed in the year<br \/>\n2007, it cannot be said that the learned trial Court has committed<br \/>\nany error in refusing to grant injunction. However, Mr.Upadhaya,<br \/>\nlearned Advocate for the appellant has submitted that the defendants<br \/>\nmay transfer the property and\/or third party rights might be created<br \/>\nand therefore, it is requested to make suitable observations.<br \/>\nMr.Tushar Mehta, learned Senior Advocate appearing on behalf of the<br \/>\ndefendants has submitted that even otherwise the question with<br \/>\nrespect to lis-pendece will always be there. Under the<br \/>\ncircumstances while dismissing the present Appeal from Order, it is<br \/>\ndirected that any transaction herein after by the defendants will be<br \/>\nsubject to the ultimate outcome of the Suit and that subsequent<br \/>\npurchaser be informed by the defendants with respect to the pendency<br \/>\nof the proceedings.\n<\/p>\n<p>4.\t\tWith<br \/>\nthese, present Appeal from Order is dismissed.
