Justice P.S.GOPINATHAN\n\n Dated :21\/07\/2010\n\n O R D E R\n                    C.N.RAMACHANDRAN NAIR &amp;\n                             P.S.GOPINATHAN, JJ.\n               ....................................................................\n           Writ Appeal Nos.265,183,1199 &amp; 1217 of 2010\n               ....................................................................\n                  Dated this the 21st day of July, 2010.\n\n                                      JUDGMENT\n<\/pre>\n<p>Ramachandran Nair, J.\n<\/p>\n<p>      The connected appeals are filed by the State challenging the<\/p>\n<p>judgment of the learned Single Judge holding that under Rule 6(VIII)<\/p>\n<p>of Chapter-V K.E.R. the school managements which have executed<\/p>\n<p>agreements with Government in terms of the Rule, have no<\/p>\n<p>responsibility to appoint protected teachers from outside the<\/p>\n<p>educational district.         Even though Government Pleader referred to<\/p>\n<p>Section 13 of the Education Act, we do not find any specific provision<\/p>\n<p>therein requiring the management to appoint protected teachers from<\/p>\n<p>outside the educational district in which the educational institution of<\/p>\n<p>the management is located. In these cases specific agreements are<\/p>\n<p>executed in terms of the above Rule under which managements were<\/p>\n<p>bound to appoint teachers protected in the educational districts wherein<\/p>\n<p>their schools are located. The learned Single Judge rightly held that the<\/p>\n<p>respondents are not bound to appoint protected teachers from outside<\/p>\n<p><span class=\"hidden_text\">W.A. 265\/2010&amp; conn.               2<\/span><\/p>\n<p>the educational district. When the Government through the Rule itself<\/p>\n<p>restricted the scope of responsibility of the management to appoint<\/p>\n<p>protected teachers by limiting their liability to such of the teachers<\/p>\n<p>protected   within    the  educational    district, obviously    without<\/p>\n<p>Government amending the Rule applicable to protected teachers<\/p>\n<p>available within a Revenue District or all over the State, they cannot<\/p>\n<p>contend otherwise. The learned Single Judge rightly upheld the claim<\/p>\n<p>of the managements to appoint teachers of their choice in terms of the<\/p>\n<p>provisions of the Rule, if no protected teacher is available in their<\/p>\n<p>educational district. Since the appellants have no case that respondents<\/p>\n<p>have violated the terms of the agreement or the Rule, there is no scope<\/p>\n<p>for interference with the judgment. Writ Appeals are consequently<\/p>\n<p>dismissed.
