(1) 267 1991 SCALE  (1)497\n\n\nACT:\n    Service    Law:   Karnataka\t  Judicial    Service--Civil\nJudge--Dismissal on ground of irregularities in discharge of\nofficial      duties--Validity\t   of--\t    Quantum\t  of\npunishment--Whether\t  proportionate--Confidence\t  of\nparties--Foundation  of\t Judicial system--Hence, not  to  be\naffected.\n\n\n\nHEADNOTE:\n    The appellant, a Civil Judge, was dismissed by the\tHigh\nCourt on the ground that he had committed certain irregular-\nities in the adjudication of references under Section 18  of\nthe Land Acquisition Act, 1894 by (i) writing letters to the\nLand  Acquisition  Officer, for enforcing  the\tAward,\teven\nthough\tunder Section 82 of the Civil Procedure Code,  1908,\ndecrees\t against the State were not available for  execution\nbefore 90 days, (ii) fixing valuation higher than the legit-\nimate  one for the lands, and (iii) using  order-sheets\t got\nprinted by the Advocate for the parties. He was also alleged\nto have purchased a pump-set costing Rs.1,000 without  prior\npermission  from the appropriate authorities. His  challenge\nto  the\t dismissal  was rejected by the High  Court  on\t the\njudicial side. Hence, the appeal.\n    Dismissing\tthe  appeal, but modifying  the\t quantum  of\npunishment, this Court,\n    HELD:  1.1 It is of paramount importance  that  judicial\nofficers  must act above board and keep the channel of\tjus-\ntice clean. Confidence of the litigating parties in Judicial\nsystem\tis  the very foundation of the\tsystem\tand  nothing\nshould be done which would affect that. [5C]\n    1.2 Fixation of valuation is a judicial act. Even if the\nassessment of valuation is modified or affirmed in appeal as\na part of the judicial process, the conduct of the  judicial\nofficer drawable from an overall picture of the matter would\nyet be available to be looked into. In appropriate cases  it\nmay be open to draw inferences even from judicial acts. [3F]\n    1.3 On a consideration of the materials on record, there\niS some scope for accepting the appellant's stand that there\nwas some mistake in\n2\nfixing\tthe valuation but no ill motive. He  is,  therefore,\nentitled  to  benefit of doubt. However, it cannot  be\tsaid\nthat he had acted innocently in writing letters for  enforc-\ning  of the awards. Similarly, he had acted indiscreetly  in\nallowing the order-sheets got printed by a particular  Advo-\ncate  to be used. Since the appellant possessed 43 acres  of\nagricultural  lands,  no serious view need be taken  of\t the\npurchase of pump-set without prior permission. [3G-H, 4C, E,\nF-G]\n    1.4 Ordinarily, justification of the quantum of  punish-\nment  imposed in a disciplinary action is not for the  court\nto decide and there have been occasions when this Court\t has\ntaken interference by the High Courts on quantum of  punish-\nment  as an act in excess of jurisdiction. But\tkeeping\t the\nresidue of the charges in view, the dismissal of the  appel-\nlant  from  service  was out of\t proportion  and  compulsory\nretirement would meet the ends of justice.
