P. Sharma, learned counsel for the petitioner.\n       Petitioner by way of present writ petition under Article 226 of\nthe Constitution of India seeks direction for respondents to pay<\/pre>\n<p>entire retiral dues.\n<\/p>\n<p>       The facts as gathered from the submission and the pleadings<br \/>\nare that the petitioner while in service as District Commandant<br \/>\nHome Guard was served a charge sheet on 25-07-2006. The legality<br \/>\nwhereof was challenged in Writ Petition No. 2330\/07(s); wherein<br \/>\ninitially stay was granted; however, subsequently, the petitioner was<br \/>\ndismissed on 02-12-2009.\n<\/p>\n<p>       That during pendency of the writ petition, the petitioner was<br \/>\nretired from service on attaining the age of superannuation with<br \/>\neffect from 31-03-2009. After the retirement provisional pension of<br \/>\nthe petitioner was fixed as per Rule 64 of the Madhya Pradesh Civil<br \/>\nService (Pension) Rules, 1976 by order dated 17-04-2009 because of<br \/>\npendency of the departmental enquiry.\n<\/p>\n<p>       By way of present petition the petitioner claims 90% of the<br \/>\ngratuity, earned leave encashment and the amount towards GIS<br \/>\n(Group Insurance Scheme).\n<\/p>\n<p>       Indisputably a departmental enquiry initiated against the<br \/>\npetitioner while he was in service could not be completed because of<br \/>\nthe stay thereof in Writ Petition No. 2330\/07(s), and is pending after<br \/>\nhis retirement.        Rule 64 of the Pension Rules, 1976 makes a<br \/>\nprovision regarding provisional payment of pension during pendency<br \/>\n                                                                        WP 11848.10(s)<\/p>\n<p>of the departmental enquiry after retirement. In the<br \/>\ncase at hand as evident from the charge sheet dated 25-07-2006<br \/>\n[Annexure-P\/6 with Writ Petition No. 2330\/07(s)], the record<br \/>\nwhereof was called from the record room at the time of hearing the<br \/>\nmatter,] that the petitioner has been subjected to following charges :-\n<\/p>\n<blockquote><p>            &#8220;(1) &#8220;tokuksa ls fM;wVh gsrq fj&#8217;or ds #i esa \/kujkf&#8217;k<br \/>\n            olwyus dh dk;Zokgh dj Hkz&#8221;V vkpj.k iznf&#8217;kZr djukA&#8221;<br \/>\n            (2) &#8220;vius in dk nq#i;ksx dj gksexkMZ tokuksa Onkjk<br \/>\n            eafnj Q.M rFkk gekjk ?kj &#8211; gekjk nQrj Q.M ds vUrxZr<br \/>\n            tek dh xbZ jkf&#8217;k dks gMiukA&#8221;\n<\/p><\/blockquote>\n<blockquote><p>            (3) &#8220;eafnj Q.M@gekjk ?kj &#8211; gekjk nQ~rj Q.M dk<br \/>\n            lapkyu] vkpj.k fu;eksa ds fo#\/n dk d`R; gksukA&#8221;<br \/>\n            (4) &#8220;lSfudksa ds lkFk ekj-ihV laca\/kh vuSfrd d`R; dj<br \/>\n            LosPNkpkfjrk iznf&#8217;kZr djukA&#8221;\n<\/p><\/blockquote>\n<blockquote><p>            (5) &#8220;e0 iz0 flfoy lsok vkpj.k fu;e 1665 ds<br \/>\n            fu;e-3 lkekU;-1 (,d) (nks) ,oa (rhu) dk mYya?ku<br \/>\n            djus dk dnkpj.k djukA&#8221;<\/p><\/blockquote>\n<p>       In view of the charges levelled against the petitioner, the<br \/>\naction of respondent for release of 90% pension excluding gratuity<br \/>\nand the leave encashment cannot be faulted; because, in case in a<br \/>\ndepartmental enquiry the petitioner is found guilty of defalcation<br \/>\nand the recovery of government money is ordered, the same can be<br \/>\nrecovered from the amount of gratuity and leave encashment. In this<br \/>\ncontext regard can be had to the judgment in <a href=\"\/doc\/14872\/\">State of Orissa and<br \/>\nothers v. Kalicharan Mohapatra and<\/a> another : (1995) 6 SCC 105 and<br \/>\n<a href=\"\/doc\/107483\/\">Union of India v. G. Ganayutham<\/a> : AIR 1997 SC 3387.\n<\/p>\n<p>                                                           WP 11848.10(s)<\/p>\n<p>       In view of law above and facts of present case no direction<br \/>\ncan be given to respondents to release 100% pension, or any fraction<br \/>\nof gratuity and leave encashment.\n<\/p>\n<p>       In respect of GIS the petitioner is at liberty to move the<br \/>\nauthorities for its release and on such application being filed by<br \/>\npetitioner, the authority concerned shall dwell upon it objectively.\n<\/p>\n<p>       With the above liberty to the petitioner, the petition stands<br \/>\ndismissed.
