Justice R.BASANT\n\n Dated :29\/10\/2007\n\n O R D E R\n                            R.BASANT, J.\n                         ----------------------\n                       B.A.No.6543 of 2007\n                   ----------------------------------------\n            Dated this the 29th day of October 2007\n\n                              O R D E R\n<\/pre>\n<p>     Application for regular bail.                   The petitioner faces<\/p>\n<p>allegations under the Kerala Abkari Act.                  The petitioner was<\/p>\n<p>allegedly found to be in possession of 5.5 litres of spirit on<\/p>\n<p>19\/8\/2007.   He was arrested on 22\/9\/2007 and continues in<\/p>\n<p>custody from that date.         He has no history of any criminal<\/p>\n<p>antecedents, submits the learned Public Prosecutor.<\/p>\n<p>     2.   The learned counsel for the petitioner prays, the<\/p>\n<p>learned Public Prosecutor does not oppose the said prayer on<\/p>\n<p>condition that the investigating officer is granted reasonable<\/p>\n<p>further time to complete the investigation and I am satisfied that<\/p>\n<p>regular bail can be granted to the petitioner subject to<\/p>\n<p>appropriate conditions.\n<\/p>\n<p>     3.   In the result, this petition is allowed. The petitioner<\/p>\n<p>can now be enlarged on bail on the following terms and<\/p>\n<p>conditions:\n<\/p>\n<p>     i)   The petitioner shall not be released on bail on the<\/p>\n<p>strength of this order prior to          05\/11\/2007.
