Sections 32, 34 & 40 of the Act and submittedgthat,’~i.irijiti.ew_T’ .<\/p>\n
of the concurrent finding recorded  the C.0’U’i’t\u00e9::i’3e’|VO:\\.Ai”vyltlfi ‘*<\/p>\n
regard to seizure of the liquor V=frorn-the’ea.;joss’esslC>n<\/p>\n
Accusecl–1, who was driving’ -the lot’-ry’, the=’V:’pres.u,ifh_otioin <\/p>\n
raised that, he was carrying   permit, is
\njustified and hence   the sentence
\nimposed are legal ‘interference is
\ncalled for.   in support of
\nthe findings.   below, insofar as<\/p>\n

that an accused was in posses_sion_~’ofintoziicartst it<\/p>\n

accused has the requisite”‘V}gnovv.I’ed__ge of i.e.,l”<\/p>\n
that it was unlawfully 1na’11t11’actureCi;,._.v_Etc:\u00a7, can be
\nraised by virtue ‘uMysore Excise Act.
\nBut to contendllthlatll presuxnfgtion provided
\nunder Section 4,\\”)””of Alt:\/\u00a7yvfsore\u00ab.:.t’I\u00a5idccise Act would
\nextend   lupfesuming that an
\ninto1Eica_izi’t_’Vis  .ama131ufactured. . .etc. , as laid
\n  of _Mysore Excise Act would be,
\nin_o’u’_1~ opilnio:1:,’i’te’arl:i’1;g”too much into S.40 of the
\nMysore’   and would lead to disastrous
\n;’eo_1.1secV1uen’ce1s iierhich would be contrary to the<\/p>\n

\nhas   has failed to prove its
\ncase  In my view, the impugned<\/p>\n
