A.G. for the Respondents<br \/>\nNo.3.\n<\/p>\n<p>        Shri Amalpushp Shroti, Counsel for respondent No.4.<br \/>\n        This petition is directed by two students who sought<br \/>\nfollowing reliefs :-\n<\/p>\n<blockquote><p>        1. Declare that in terms of provisions of 10-A(5) of the<br \/>\n           Act,1956 by necessary implication permission of<br \/>\n           annual renewal to the respondent Institution is deemed<br \/>\n           to have been granted and permission is deemed to have<br \/>\n           been continued for the academic session 2009-10.\n<\/p><\/blockquote>\n<blockquote><p>        2. Be quashed order dt. 22.7.2010 Annexure P-1 and<br \/>\n           direct the respondent University for permitting the<br \/>\n           petitioners for appearing in the first professional<br \/>\n           examination scheduled to be conducted by the<br \/>\n           respondent University from 12.8.2010 and declare the<br \/>\n           result.\n<\/p><\/blockquote>\n<blockquote><p>        3. Be quashed order passed by the respondent union Govt.<br \/>\n           dt. 20.11.2009 and 23th March,2010 Annexure P-2 and\n<\/p><\/blockquote>\n<blockquote><p>           3.<\/p>\n<\/blockquote>\n<blockquote><p>        4. Pass such further or other order or orders as this hon.<br \/>\n           Court may deem fit and appropriate in the facts and<br \/>\n           circumstances of the case.<\/p><\/blockquote>\n<p>        Learned counsel for the respondents submitted that in<br \/>\nview of the order passed by the Apex Court in S.L.P. No. Civil<br \/>\nNo.123199\/10 dated 19.8.2010,               nothing survives in this<br \/>\npetition, the controversy has been decided in W.P.9438\/09 as<br \/>\nper the order passed by the Apex Court.\n<\/p>\n<p>        So far as the petitioners are concerned, their admission<br \/>\nhas been saved by the Apex Court by the aforesaid order. For\n<\/p>\n<p>                                                                        2&#8230;..\n<\/p>\n<p>                    W.P.10934 of 2010<\/p>\n<p>Vikas Pal &amp; Raghav Gupta                                    U.O.I. &amp; ors.\n<\/p>\n<p>23.9.2010<\/p>\n<p>ready reference order dated 19.8.2010 of the Apex Court is<br \/>\nreferred, which reads as under :-\n<\/p>\n<blockquote><p>              Permission     to   file   SLP   is   granted    in<br \/>\n       SLP(C)Nos&#8230;&#8230;CC 12369\/2010 &amp; 12370\/2010.\n<\/p><\/blockquote>\n<pre>                 Mr.       Amarendra        Sharan,       learned\n       senior     counsel appearing on behalf of the Board of\n       Governors, Medical Council of India,              submits\n<\/pre>\n<blockquote><p>       that though the students&#8217; initial admission is<br \/>\n       irregular      and illegal      but in deference to the<br \/>\n       Court&#8217;s intervention, they have decided to permit 150<br \/>\n       students to appear in the examinations          which are<br \/>\n       scheduled to commence from 23rd August, 2010. Mr.<br \/>\n       Sharan further submits that in lieu of permitting these<br \/>\n       150 students, the Petitioner Institution would be<br \/>\n       required to surrender 150 seats from the Management<br \/>\n       quota in the next five academic years.\n<\/p><\/blockquote>\n<pre>                   Mr.      K.K.        Venugopal,        learned\n       senior           counsel       appearing on behalf of the\n<\/pre>\n<blockquote><p>       Institution submits that 63 seats from the management<br \/>\n       quota have already been taken by the          respondents.<br \/>\n       He        further      submits     that    the admissions<br \/>\n       of 150 students             were     neither illegal nor<br \/>\n       irregular.\n<\/p><\/blockquote>\n<blockquote><p>                 At this juncture, we are not adjudicating on the<br \/>\n       rival contentions of the parties because the main writ<br \/>\n       petition is still pending in the High Court. We direct the<br \/>\n       Medical Council of India to file a proper affidavit before<br \/>\n       the High Court of M.P. at Jabalpur, within three weeks<br \/>\n       from today with an advance copy thereof to the other<br \/>\n       side, who would be at liberty to file rejoinder thereto, if<br \/>\n       any, within two weeks thereafter. This controversy<br \/>\n       would also be decided along with the writ petition. In<br \/>\n       the facts and circumstances of this case, we request the<br \/>\n       High Court to dispose                 of the main writ<br \/>\n       petition as expeditiously as possible, in any event,<br \/>\n       within two months from the date of communication of<br \/>\n       this order. The High Court would be entitled to decide<br \/>\n       the writ petition without being influenced by any<br \/>\n       observation made in this order. These special leave<br \/>\n       petitions are accordingly disposed of.<\/p><\/blockquote>\n<p>      As the interest of the petitioners who are the students of<br \/>\nrespondent College namely People&#8217;s College of Medical Sciences\n<\/p>\n<p>                                                               3&#8230;..\n<\/p>\n<p>                   W.P.10934 of 2010<\/p>\n<p>Vikas Pal &amp; Raghav Gupta                          U.O.I. &amp; ors.\n<\/p>\n<p>23.9.2010<\/p>\n<p>&amp; Research Center, Bhopal      have been taken care of by the<br \/>\nApex Court, nothing services in this petition.
