\n    Heard the learned counsel for the petitioner<\/p>\n
and the learned senior Government Pleader appearing<\/p>\n
on behalf of the respondents.\n<\/p>\n<\/p>\n
    2.  On 14-6-2008, the committee of the co-<\/p>\n
operative  bank  represented   by   the  petitioner<\/p>\n
resolved fixing 17-8-2008 as the date for election<\/p>\n
of the successor committee.   That was forwarded to<\/p>\n
the  first  respondent,   the   State  Co-operative<\/p>\n
Election  Commission  along   with   Ext.P1  letter<\/p>\n
stating that the term of the committee in office<\/p>\n
would expire on 16-10-2008 and it has been decided<\/p>\n
to hold the election on 17-8-2008 within two months<\/p>\n
before because, nearly 70% of the members of the<\/p>\n
bank belong to Muslim community and that during<\/p>\n
September and October, they have to be deeply<\/p>\n

involved   in  the religious   fasting and prayers<\/p>\n
during the Ramzan period and therefore to obtain<\/p>\n
the co-operation of all the members, the election<\/p>\n
is fixed in August, 2008 and since the place of<\/p>\n
election, namely, the school, being not available<\/p>\n
on any other Sundays, the date is fixed as 17-8-<\/p>\n
2008.\n<\/p>\n<\/p>\n
    3.   This  writ  petition   is   filed on the<\/p>\n
apprehension   that the   first respondent is  not<\/p>\n
likely to act on Ext.P1 request and resolution.<\/p>\n
Directions are therefore sought for to compel the<\/p>\n
first respondent to act in terms of Ext.P2.<\/p>\n
    4.   Learned senior Government Pleader pointed<\/p>\n
out that the statutory provision that a resolution<\/p>\n
be drawn up by the committee at least 60 days<\/p>\n
before the date of expiry of the term of the<\/p>\n
committee in office means “within a short time<\/p>\n
above 60 days of such expiry of the term of<\/p>\n

office”, as enunciated by this Court in Sugathan v.<\/p>\n
Joint Registrar (1993 (1) KLT 927).     Though not<\/p>\n
particularly specific in that point, the decision<\/p>\n
of this Court in Thodupuzha Taluk Co-op.Marketing<\/p>\n
Society v. Joint Registrar of Co-op.Societies<\/a> (2002<\/p>\n
(1) KLT 638) was also cited in support of that<\/p>\n
proposition, which decision, I may at once notice,<\/p>\n
was one rendered also in the backdrop of the fact<\/p>\n
that there was an earlier judgment of this Court<\/p>\n
inter partis directing that the committee could<\/p>\n
continue in office till a particular date.<\/p>\n
    5.   Section 28B  of the   Kerala  Co-operative<\/p>\n
Societies Act, 1969, the “Act”, for short, provides<\/p>\n
for the constitution of the State Co-operative<\/p>\n
Election    Commission for    the  superintendence,<\/p>\n
directions and control of the conduct of election<\/p>\n
to the committee of the society.   The election in<\/p>\n
question is governed by Rule 35A of the Kerala Co-<\/p>\n
 WPC20751\/2008<\/p>\n
                          -:4:-<\/span><\/p>\n
operative     Societies  Rules,   1969,  hereinafter<\/p>\n
referred to as the “Rules”.       That Rule provides<\/p>\n
the manner in which the election to the members of<\/p>\n
the committee shall be conducted by the State Co-<\/p>\n
operative    Election  Commission.     Sub-rule  (1)<\/p>\n
thereof provides, among other things, that the<\/p>\n
committee shall meet at least 60 days prior to the<\/p>\n
date  of   expiration  of    the term and  pass  the<\/p>\n
resolution fixing the date, time and place for the<\/p>\n
conduct of the election to the new committee.   Rule<\/p>\n
35(1) enjoins and empowers the committee to fix the<\/p>\n
date for the conduct of the election.      Adverting<\/p>\n
to Section 28(1) of the Act, it can be noticed that<\/p>\n
the committee is constituted by the general body of<\/p>\n
the society for the purpose of being entrusted with<\/p>\n
the management on the affairs of the society.<\/p>\n
It  is     therefore   explicitly  clear  that   the<\/p>\n
democratic right of the general body of a co-<\/p>\n
operative    society  to    elect its  committee  is<\/p>\n
exercised by having the date of election fixed by<\/p>\n

the committee, which is in office by a democratic<\/p>\n
process.\n<\/p>\n<\/p>\n
    6.   The   wisdom  to    fix  the date  for  the<\/p>\n
election is of the committee.      It is a democratic<\/p>\n
process.    Unless it is shown to be in violation of<\/p>\n
any  prescription   of   law,   the same  has to   be<\/p>\n
recognized.    This principle is well laced into the<\/p>\n
manner in which sub-rules 1, 2 and 4 of Rule 35A<\/p>\n
are couched.\n<\/p>\n<\/p>\n
    7.   Applying the law as laid by this Court in<\/p>\n
Sugathan’s    case (supra), it needs to be understood<\/p>\n
that the concept of the period of “at least 60<\/p>\n
days” in Rule 35A(1) of the Rules cannot be put in<\/p>\n
any straight formula.    It has to be understood and<\/p>\n
applied in the context in which its application is<\/p>\n
called for, on the facts and in the circumstances<\/p>\n
of a given case.    In Sugathan’s case (supra), this<\/p>\n

Court did not approve the endeavour to prepone the<\/p>\n
election    by 180  days,     which attempt was not<\/p>\n
supported by any reasons.\n<\/p>\n<\/p>\n
    8.   In the case in hand, the committee had,<\/p>\n
even in Ext.P1 dated 14-6-2008, clearly spelt the<\/p>\n
reasons for its decision to schedule the election<\/p>\n
on 17-8-2008.   Until the date of this writ petition<\/p>\n
and even as of now, the first respondent has not<\/p>\n
communicated to the writ petitioner society any<\/p>\n
decision impeaching the committee’s decision fixing<\/p>\n
the date as 17-8-2008 or challenging the reasons<\/p>\n
stated for such fixation of the date.<\/p>\n
    9.   There is no specific power conferred on<\/p>\n
the State Co-operative Election Commission or any<\/p>\n
other authority under the Act, on whose permission<\/p>\n
or orders, would depend the date of conduct of the<\/p>\n
election.    No such power is given under Rule 35A.<\/p>\n
The State Co-operative Election Commission is duty<\/p>\n
 WPC20751\/2008<\/p>\n
                        -:7:-<\/span><\/p>\n
bound to appoint an Electoral Officer to give<\/p>\n
effect to the decision of the committee fixing the<\/p>\n
date,  time   and place   for the  conduct  of  the<\/p>\n
election to the new committee.       This view is<\/p>\n
fortified by the decision of this Court in Sudevan<\/p>\n
v. Joint Registrar (1992 (2) KLT 18).     The said<\/p>\n
decision applies notwithstanding the fact that by<\/p>\n
subsequent amendments, the powers, including, to<\/p>\n
appoint the Returning Officer, have moved on from<\/p>\n
the Registrar to the State Co-operative Election<\/p>\n
Commission.    There is no sustainable reason to<\/p>\n
refuse to conduct the election in terms of the<\/p>\n
request of the petitioner as contained in Ext.P1<\/p>\n
supported by Resolution No.142 taken on 14-6-2008.<\/p>\n
    For the foregoing reasons, the first respondent<\/p>\n
is directed to duty bound to have the election<\/p>\n
conducted to the committee of the Edathala Service<\/p>\n
Co-operative Bank Ltd.No.430 on 17-8-2008 by taking<\/p>\n
 WPC20751\/2008<\/p>\n
                       -:8:-<\/span><\/p>\n
the necessary steps in terms of Rule 35A of the<\/p>\n
Rules.  It is so directed and the writ petition is<\/p>\n
allowed accordingly.\n<\/p>\n<\/p>\n
