dated 01.08.207 under Sections 302, 307, 216, 148, 149 of I.P.C., and<\/p>\n
25,54,59 of the Arms Act, registered at Police Station Sadar Bahadurgarh,<\/p>\n
Distt. Jhajjar.\n<\/p>\n
              Admittedly, the petitioner was not armed with any weapon nor<\/p>\n
he is attributed to have caused any injury to the deceased. The petitioner is<\/p>\n
in custody since 06.12.2007. Learned counsel for the petitioner contends<\/p>\n
that the case of the petitioner is by and large similar to that of co-accused<\/p>\n
Atul, who was granted bail by this Court vide order dated 06.01.2009,<\/p>\n
passed in Criminal Misc.No.M-23485 of 2008. In this case, two witnesses,<\/p>\n
out of 31 witnesses of the prosecution, are stated to have been examined so
\n Criminal Misc.No.M-4172 of 2009 (O&M)                      -2-<\/span><\/p>\n
far. Trial, in this case, is likely to take a long time.<\/p>\n
             In the given facts and circumstances and without commenting<\/p>\n
on the merits of this case, the petitioner is ordered to be released on bail on<\/p>\n
his furnishing bail\/surety bonds to the satisfaction of the Trial Court.<\/p>\n

               Petitioner Suraj Pal has brought this petition under Articles
\n226\/227 of the Constitution of India read with Section 482 of the Code of
\nCriminal Procedure to direct the respondents-State to release the petitioner
\nfrom jail on policy instructions dated 12.04.2002 in case F.I.R.No.4 dated
\n06.01.1976 under Sections 395, 396, 397, 460 of Indian Penal Code,
\nregistered at Police Station Nuh, District Gurgaon (now Mewat).\n<\/p>\n
             Learned State counsel submits that on a similar point in another
\ncase, stay has been granted by the Apex Court vide its order dated
\n06.01.2009, passed in S.L.Ps. No.9393, 9394 and 9395 of 2008.\n<\/p>\n
             Thus, it would be appropriate to adjourn this case sine-die till
\nthe decision of the Apex Court, on the stay matter in the aforesaid S.L.Ps.
\nParties would be at liberty to get this matter revived after the fate of the stay
\nin the aforesaid S.L.Ps, pending before the Hon’ble Supreme Court is
\ndecided.\n<\/p>\n
             Thus, adjourned sine-die.\n<\/p>\n
               Petitioner has brought this petition under Article 226 of the
\nConstitution of India, for issuance of a writ in the nature of Habeas Corpus
