"\n\nThese appeals are comiri\u00e9on forl'ord'ers, thisllday, the\nCourt, delivered the following.    7\n\nchallengingpplthe  ofcompensation awarded by the\nLabour-_ l'Qfficer~lf"Commissioner for Workmen's\n\nCompensation,  District, Davangere (for short\n\n"V '  _  'Co_mn1i_issione'r*')';' "\n\n ltlf1_e'y;;"are arising out of a common judgment and\n\naward the Commissioner, they are clubbed together and\n\n llftaiietl  for final disposal with the consent of learned\n\n Coiinsel appearing for the parties.\n\n%\n\n\n\n \n\n3. F or the sake of convenience parties are referred to as\nthey are referred to in the claim petitions  the\nCommissioner.\n\n4. Brief facts of the case:\n\nThat on 22.07.2007: _4_When_T'the \nworking as driver and     bearing\nregistration No.   to the 1st\nrespondent herein the accident, as a\nresult, they they filed separate\nclaim     Commissioner seeking\n  offthe lorry was placed ex parts\nand he   petitions. The Insurance\n\nCom\ufb01ppaily fileti statement of objections resisting the\n\n\u00bb clan' m petitions__.\n\n in support of their claim examined\n\n~V theinsehfeslllas PW 1, PW 2 and PW 3 respectively and Dr.\n\n  R. Ullal as PW 4. They have produced as many\n\n'   l5 documents, which are marked as EX. P 1 to P 15.\n\n\n\n \n\nThe Insurance Company except cross examining the\nclaimants and their witnesses and producing the\ninsurance policy as Ex R 2 [1] did not  any\n\nindependent evidence.\n\n6. T he Commissioner after :c'onsidering;.  orai Va-ifidif A'\n\ndocumentary evidence of the   \njudgment has held that thet:ciaim.ants_ 'haired"established'\nthat they sustainedirijuriesllllinvt-I'the-accident"occurred in\nthe course of and out they are entitled\nto seek    Commissioner\n\ntaking into cov:';s.i_deratio'11__the age of the claimants, nature\n\nof theirjob, ith'e"wa'gpes by them, the disability stated\n\nbyythe doctofand' assessing the loss of earning capacity at\n\n   35% and applying the relevant factor as per\n\n    the impugned award has awarded a\n\n cornpe'nsation of Rs.i,45,i95\/--, Rs.1,20,960\/- and\n\nit nRs:.1',3V\u00e9,568\/-- with interest at 12% p.a. after 80 days\n\n the date of award. Aggrieved by the quantum of\n\ncompensation awarded by the Commissioner the\n\n\n\n \n\n6\n\ninsurance Company is in appeal seeking reduction of\n\ncompensation.\n7. As there is no dispute regarding injuries Sustained\n\nby the claimants in the accident occurred in  of\n\nand out of employment and the liability of  \n\nCompany the only substantial quiestion'l--.of lthatslarisesi 1'. \n\nfor consideration in these appeal is: \n\nWhether the Commiss~iconer" \u00ab. is justified in\nassessing the wages otfmthejclairrrantsat"Rs.4,000\/-\npm. in the case"of dyri-Vper,'a.ndlpRs;i3,000\/-- in the case\nhamalies and assessiniglthe_-loss'~of'_.earning capacity\nat 30%, 30\u00b0\/o a1'1d*35% ._respec.tively and awarding\ncomperisation with inter'est-at..l_2% p.a. after 30 days\nfrom.the.4_da,tte of .award?_"  .\n\n8. _ Sri  nR.._RaVivsha"nkar, learned Counsel appearing\n\n V'  . fo1\u00a7._t.he:..y'Insurance'Company submits except the self serving\n\n    claimants that they were drawing wages\n\nof and Rs.4,000\/~ respectively excluding batta\n\n ofpRs.5.{l)\/-- per day they have not established the same\n\nif Vei'th:er by examining the owner of the lorry or by producing\n\n " ~-any documentary evidence to that effect. Therefore the\n\n\ufb01g\n\n\n\n \n\n7\n\nCommissioner is not justified in assessing their wages at\nRs.4,000\/~ p.m. and Rs.3,000\/-- pm. respectively. He\n\nfurther submits that the accident was  at\n\nDavangere and they were provided first aiddratv '_\n\nand continued further tre'a'tnient".4A T \n\nDr. Umanath R. U11a1, PW :2  \ntreated the claimants  the \nstating that the claimants  40% and\n45% respectively and  not justified in\n\nassessing the  of".earriing'=eapacit}? of the claimants at\n\n30%,    He fairly submits that\ninterestprnay be  per the judgment of the Apex.\n\nCourt in the" Case A'oi"{5r\u00b0iental Insurance Co. respectively but he has not stated the disability caused to<\/p>\n

loss of earning capacity at 30% by the Comrnissiorier <\/p>\n
the higher side. It is just and p1*’op’er.t’o”_.jas_sess’._the-tloss off <\/p>\n
earning Capacity at 18%. If
\nwork out to Rs.”\/2,576\/~ (R’~\u00b0$l1″;8OO”\/4″?$\u00e9 zgmgii 18%) as<\/p>\n
against Rs. 1 ,20,960\/  awarded’   Commissioner.<\/p>\n
14. The claimant  has sustained
\nfracture oft.-S\u00a711aftj:i’Qo-f’ middle th-irid tofifight femur bone fixed
\nwith interloeiiingitripaiiijtconsidering the same assessment
\nof loss ofearnirig that 35% by the Commissioner is<\/p>\n
onxthe higher’   is just and proper to assess the loss<\/p>\n
\u00bb’ of .eva1’niiA1g.oap_acity at 20%. If so, the compensation would<\/p>\n

   With regard to interest the learned Counsei fairly<\/p>\n
submit it may be modified as per the judgment of the Apex<\/p>\n
