Justice ANTONY DOMINIC\n\n Dated :27\/01\/2011\n\n O R D E R\n                       ANTONY DOMINIC, J.\n\n             ```````````````````````````````````````````````````````\n                 W.P.(C) No. 12070 of 2009 C\n             ```````````````````````````````````````````````````````\n           Dated this the 27th day of January, 2011\n\n                            J U D G M E N T\n<\/pre>\n<p>            Petitioner is the owner of 2.5 acres of land in<\/p>\n<p>Poonjar Vadakkekara village. During 1984-85, petitioner was<\/p>\n<p>the licensee of certain toddy shops. Default led to recovery<\/p>\n<p>proceedings and finally, the aforesaid property of the<\/p>\n<p>petitioner was sold in revenue recovery proceedings and<\/p>\n<p>Government purchased the land. Subsequently, availing of<\/p>\n<p>the benefit of an Amnesty scheme, petitioner settled the<\/p>\n<p>liability. In this writ petition, what the petitioner contends is<\/p>\n<p>that since he has settled the liability and as revenue recovery<\/p>\n<p>proceedings have been withdrawn as per Ext.P4, the property<\/p>\n<p>should be re-conveyed to him, giving the benefit of Ext.P5<\/p>\n<p>Government Order.\n<\/p>\n<p>       2.   However, as rightly pointed out by the learned<\/p>\n<p>Government Pleader, petitioner has no case that the Amnesty<\/p>\n<p>scheme under which the liability has been settled, enables the<\/p>\n<p>W.P.(C) No.12070\/2009<br \/>\n<span class=\"hidden_text\">                                  : 2 :<\/span><\/p>\n<p>petitioner to claim re-conveyance of the property.      In that<\/p>\n<p>view of the matter, the issue raised by the counsel for the<\/p>\n<p>petitioner is fully covered against him by the Division Bench<\/p>\n<p>judgment of this Court in State of Kerala Vs. George Jacob<\/p>\n<p>[2010 (3) KHC 381], wherein it has been held that<\/p>\n<p>reconveyance can be claimed only if Amnesty scheme<\/p>\n<p>provides for re-conveyance. In this case, admittedly there is<\/p>\n<p>no such provision in the Amnesty Scheme, the benefit of<\/p>\n<p>which was availed by the petitioner.
