He was paid gratuity in<\/p>\n<p>accordance with the Kerala Service Rules which were<\/p>\n<p>adopted by the Kerala State Electricity Board for their<\/p>\n<p>employees.     On the contention that the petitioner is<\/p>\n<p>entitled to payment of gratuity under the Payment of<\/p>\n<p>Gratuity Act, petitioner filed a Gratuity Case before the<\/p>\n<p>2nd respondent Controlling Authority under the payment<\/p>\n<p>of Gratuity Act, who, by Ext.P1 order, allowed the claim<\/p>\n<p>and directed the Electricity Board            to pay additional<\/p>\n<p>gratuity to the petitioner. Petitioner&#8217;s grievance in this<\/p>\n<p>writ petition is that the amount covered by Ext.P1 has not<\/p>\n<p>been paid to the petitioner.\n<\/p>\n<p>      2.   Learned standing counsel appearing for the<\/p>\n<p>Kerala State Electricity Board submits that the amount<\/p>\n<p>covered by Ext.P1 order has been deposited before the<\/p>\n<p>Regional Joint Labour Commissioner, Kozhikode on<\/p>\n<p>21.3.2006.\n<\/p>\n<p>W.P ( C) No. 31832 of 2009<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>      3.     Learned counsel appearing for the petitioner<\/p>\n<p>submits that even if it has been so deposited, it has not<\/p>\n<p>been disbursed to the petitioner.      According to him, on<\/p>\n<p>enquiry, the respondents submitted that the amount<\/p>\n<p>deposited cannot be disbursed since an appeal filed by the<\/p>\n<p>Electricity Board against the judgment which has been<\/p>\n<p>relied on in Ext.P1 for allowing the claim of the petitioner<\/p>\n<p>is pending before the Supreme Court, in which, there is a<\/p>\n<p>stay also.\n<\/p>\n<p>      4.     I have heard the learned counsel for the<\/p>\n<p>petitioner, the learned standing counsel for the Electricity<\/p>\n<p>Board and the learned Government Pleader.<\/p>\n<p>      5.     It is true that the appeal against the judgment<\/p>\n<p>of the Division Bench of this Court holding that the<\/p>\n<p>Payment of Gratuity Act is applicable to the employees of<\/p>\n<p>the Kerala State Electricity Board is pending before the<\/p>\n<p>Supreme Court and the Supreme Court has granted a stay<\/p>\n<p>of operation of the judgment. But a Division Bench of this<\/p>\n<p>Court has in Abdul Rahiman Vs. The District Collector,<\/p>\n<p>W.P ( C) No. 31832 of 2009<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>Malappuram [2009 (4) KHC 283] held that even when a<\/p>\n<p>decision of the Division Bench is stayed by the Supreme<\/p>\n<p>Court, the learned Single Judges of this Court are bound by<\/p>\n<p>the ratio of the decision of the Division Bench and in<\/p>\n<p>identical matters coming up before them, the           learned<\/p>\n<p>Single Judges are bound to follow the ratio of the said<\/p>\n<p>decision notwithstanding the stay granted by the Supreme<\/p>\n<p>Court. However, a Division Bench of this Court has passed<\/p>\n<p>certain orders to safeguard the interest of the Board in the<\/p>\n<p>event of they ultimately succeeding in the appeal pending<\/p>\n<p>before the Supreme Court.\n<\/p>\n<p>      6.      Following those decisions, I dispose of this writ<\/p>\n<p>petition with the following directions.<\/p>\n<p>      Even after four months from today, the Board is not<\/p>\n<p>able to get the appeal pending before the Supreme Court<\/p>\n<p>disposed of, the Regional Joint Labour Commissioner,<\/p>\n<p>Kozhikode shall disburse the amount in deposit with him to<\/p>\n<p>the petitioner, on the petitioner executing a bond with two<\/p>\n<p>serving employees of the Board as sureties for due<\/p>\n<p>repayment of the amount in the event of the Electricity<\/p>\n<p>W.P ( C) No. 31832 of 2009<br \/>\n<span class=\"hidden_text\">                                 4<\/span><\/p>\n<p>Board succeeding in the appeal pending before the<\/p>\n<p>Supreme Court. If the petitioner is unable to find serving<\/p>\n<p>employees of the Board as sureties, the amount need be<\/p>\n<p>disbursed only after the appeal is finally disposed of by the<\/p>\n<p>Supreme Court.
