      Petitioner challenges Exts.P7 and P8 and seeks        a<\/p>\n
prohibition   restraining    the     first   respondent from<\/p>\n
proceeding with Ext.P7 complaint.\n<\/p>\n
      2.    The briefly stated facts are that in 1979,<\/p>\n
petitioner was appointed into the Indian Forest Service<\/p>\n
and was alloted to the Kerala Cadre and joined service as<\/p>\n
Assistant Conservator of Forests.          He earned various<\/p>\n
promotions and in the year 2002, he was promoted as<\/p>\n
Chief   Conservator of Forests.        By Ext.P6 order dated<\/p>\n
31.3.2010 extending him the benefit of Ext.P1 guidelines<\/p>\n
providing for promotion to those who have completed 25<\/p>\n
years of service , petitioner was promoted as Additional<\/p>\n
Principal Chief Conservator of Forests and was posted<\/p>\n
against a leave vacancy. Accordingly, he joined the higher<\/p>\n
post and retired from that post on 31.3.2010 itself.<\/p>\n
      3.    The case of the petitioner is that such promotion<\/p>\n
in pursuance to Ext.P1 guidelines was based on Ext.P2<\/p>\n
representation made by him, Ext.P3 recommendation of<\/p>\n

the screening committee and on Ext.P4 Cabinet Decision.<\/p>\n
His grievance is that subsequent to his retirement, the<\/p>\n
second respondent, a total stranger filed Ext.P7 complaint<\/p>\n
before the first respondent in which Ext.P8 interlocutory<\/p>\n
order was passed restraining the authorities from paying<\/p>\n
the retirement benefits to the petitioner , on the basis of the<\/p>\n
promotion that was given to him by Ext.P6 order.       It is in<\/p>\n
the aforesaid circumstance, he has challenged Exts.P7 and<\/p>\n
P8.\n<\/p>\n
      4.    Second respondent has filed a counter affidavit<\/p>\n
reiterating the allegations that he made in Ext.P7<\/p>\n
complaint.     Although he concedes the eligibility of the<\/p>\n
petitioner for the benefit of Ext.P1 guidelines, according to<\/p>\n
him,    in giving     promotion to the petitioner by Ext.P6,<\/p>\n
respondents in Ext.P7 complaint have abused their position<\/p>\n
and hence, it is        argued that the 1st respondent was<\/p>\n
justified in passing Ext.P8 order.\n<\/p>\n
      5.    As already seen, what is under challenge in this<\/p>\n
writ petition is Ext.P7 complaint and Ext.P8 interim order.<\/p>\n
On a reading of Ext.P7 complaint, if it discloses an<\/p>\n

\n                                3<\/span><\/p>\n
“allegation” as defined in Section 2 (b) of the Kerala Lok<\/p>\n
Ayuktha Act, 1999,       Lok Ayuktha cannot be faulted for<\/p>\n
having taken cognizance of the complaint on the ground<\/p>\n
that it has exceeded its jurisdiction. If it is an act within its<\/p>\n
jurisdiction, this Court also, at least for the present, should<\/p>\n
not interfere with the proceedings and the petitioner should<\/p>\n
be left to appear and contest the matter.<\/p>\n
      6.    Therefore, what is necessary is to read the<\/p>\n
complaint and see if prima facie, a case of “allegation” has<\/p>\n
been made out.        A reading of the complaint discloses that<\/p>\n
following are the allegations.\n<\/p>\n
      i.    On 26th       March 2010, the 2nd          and 3rd<\/p>\n
respondents opened a new file proposing to create a post<\/p>\n
named ‘Additional Principal Chief Conservator of Forests<\/p>\n
to illegally aid the 4th respondent to get promoted.<\/p>\n
      ii)   For    aiding the petitioner and to procure him<\/p>\n
undue promotion to the newly created post of Additional<\/p>\n
Principal Chief Conservator of Forests’ four IFS officers<\/p>\n
senior to him had to be promoted resulting in the creation<\/p>\n
of five posts<\/p>\n

\n                                4<\/span><\/p>\n
      iii)   A proposal put up by the second respondent in<\/p>\n
Ext.P7 for creation of five posts was sent for the Chief<\/p>\n
Minister’s approval through the Forest Minister and that<\/p>\n
the same was returned with a dissenting opinion.<\/p>\n
      iv)    On 27th March 2010, 2nd and 3rd respondents<\/p>\n
in Ext.P7 submitted a fresh proposal to the Chief Minister.<\/p>\n
      v)      On 31st March 2010, at 6 p.m, a fax message<\/p>\n
was received from the Ministry of Forest of the Central<\/p>\n
Government         approving   creation of post which was<\/p>\n
communicated to the Government at 6.30 p.m.<\/p>\n
      vi)    The Chief Minister approved the proposal for<\/p>\n
creation of the post at around 7 p.m on 31st March 2010.<\/p>\n
      vii) On 31st March 2010, despite that the Chief<\/p>\n
Minister approved the proposal only at 7 p.m., order was<\/p>\n
fabricated by respondents 2 and 3 in Ext.P7 making it<\/p>\n
appear that the same was issued in the forenoon itself.<\/p>\n
      viii). It is also alleged that records were created to<\/p>\n
make it appear that the petitioner took charge            as<\/p>\n
Additional Principal Chief Conservator Forests with effect<\/p>\n
from the forenoon on 31.3.2010 and retired from the post<\/p>\n

\n                               5<\/span><\/p>\n
on the same day at 5 p.m.<\/p>\n
      ix)   It is alleged that as a result of the above, there<\/p>\n
will be an increase of Rs.15,000\/- in the pension payable to<\/p>\n
the petitioner.\n<\/p>\n
      x)    It is further alleged that respondents 2,3 and 4<\/p>\n
in Ext.P7 has abused their position as public servants and<\/p>\n
that they are guilty of maladministration, nepotism,<\/p>\n
favoritism and corruption.\n<\/p>\n
      7.    Although    the   petitioner  who    is  the   4th<\/p>\n
respondent      in Ext.P7 disputes the     veracity of  these<\/p>\n
allegations, as already stated, at this stage of the<\/p>\n
proceedings, this Court need only be concerned whether<\/p>\n
the averments in Ext.P7 complaint makes out an allegation”<\/p>\n
as defined in the Act for the Lok Ayuktha to entertain the<\/p>\n
complaint and if so, it is for the petitioner to appear and<\/p>\n
contest the proceedings.\n<\/p>\n
      8.    In my view, prima facie, reading of the aforesaid<\/p>\n
allegations in Ext.P7 complaint discloses an allegation and<\/p>\n
therefore Lok Ayuktha cannot be faulted for having<\/p>\n
entertained the complaint.          Therefore, there is no<\/p>\n

\n                                6<\/span><\/p>\n
jurisdictional error committed by the Lok Ayukta, entitling<\/p>\n
the petitioner to       challenge the proceedings in a writ<\/p>\n
petition, at this preliminary stage. Of course, it is for the<\/p>\n
respondents in the complaint to appear before the Lok<\/p>\n
Ayuktha, produce materials and satisfy it that these<\/p>\n
allegations are unsustainable and that therefore the<\/p>\n
complaint itself is liable to be rejected and it is for the Lok<\/p>\n
Ayukta to consider the pleadings and evidence and to take<\/p>\n
a decision in the matter.       Therefore, the prayer in the<\/p>\n
petition for quashing Ext.P7 has to be rejected.<\/p>\n
      9.    The second contention of the learned counsel for<\/p>\n
the petitioner is that     Lok Ayuktha did not the power to<\/p>\n
pass Ext.P8 interim order. This contention also liable to<\/p>\n
rejected in view of Rule 3 (1) (c) of Kerala Lok Ayukta<\/p>\n
(Powers of Civil Court) Rules, 1999 which confers power<\/p>\n
on the Lok Ayukta to pass interim orders.<\/p>\n
      10. In view of the above reasons, I am not persuaded<\/p>\n
to grant any relief to the petitioner. Be that as it may, fact<\/p>\n
remains that as a result of the pendency of the proceedings<\/p>\n
and the interim order passed, petitioner is deprived of his<\/p>\n

\n                              7<\/span><\/p>\n
entitlement to receive the pensionary benefits on the basis<\/p>\n
of the promotion that was granted to him and according to<\/p>\n
him even the last month’s salary has not been disbursed.<\/p>\n
Therefore, once the petitioner      appears before the Lok<\/p>\n
Ayukta and file his pleadings, it is necessary that the Lok<\/p>\n
Ayukta should complete the proceedings expeditiously and<\/p>\n
I have no reason to think      that the matter will not be<\/p>\n
expedited.\n<\/p>\n
      Subject to the above, writ petition is dismissed.<\/p>\n
