The petitioner faces allegations under Section 409<\/p>\n<p>I.P.C. These crimes have been registered on the basis of private<\/p>\n<p>complaints filed by the complainants who are subscribers to<\/p>\n<p>Sri.Vairajathan Kuries of which the petitioner was a collecting agent.<\/p>\n<p>The crux of the allegations against the petitioner in all the three<\/p>\n<p>complaints is that the amounts received from the subscribers though<\/p>\n<p>acknowledged in the pass book issued to them are not remitted to the<\/p>\n<p>accounts of the Vairajathan Kuries. It is alleged that an amount of<\/p>\n<p>Rs.1,000\/-, Rs.14,000\/- and Rs.34,000\/- remitted by the respective<\/p>\n<p>subscribers have been misappropriated by the petitioner herein.<\/p>\n<p>Investigation is pending. The petitioner apprehends imminent arrest.<\/p>\n<p>      2.    The learned counsel for the petitioner submits that the<\/p>\n<p>petitioner is absolutely innocent. The Vairajathan Kuries has been<\/p>\n<p>mis-managed by its proprietors. It is not a case of the petitioner not<\/p>\n<p>remitting the amount; but it is a case of the Vairajathan Kuries not<\/p>\n<p>maintaining proper accounts of the amounts remitted by its<\/p>\n<p>subscribers.\n<\/p>\n<p><span class=\"hidden_text\">B.A.No.6503\/07                       2<\/span><\/p>\n<p>      3.    It is the petitioner&#8217;s case that he had received the amounts<\/p>\n<p>and remitted the amounts to the Vairajathan Kuries. If the payments<\/p>\n<p>are remitted to the account of Vairajathan Kuries maintained with the<\/p>\n<p>Co-operative Bank, it is for the petitioner to satisfy the court that such<\/p>\n<p>payments have been made. At the moment and with the available<\/p>\n<p>inputs, I find absolutely no reason to assume that the allegations<\/p>\n<p>raised against the petitioner are false and are raised vexatiously. I<\/p>\n<p>am satisfied, in these circumstances, that it is not necessary to invoke<\/p>\n<p>the extraordinary equitable discretion under Section 438 Cr.P.C. The<\/p>\n<p>petitioner must appear before the investigating officer or the learned<\/p>\n<p>Magistrate having jurisdiction and seek regular bail in the ordinary<\/p>\n<p>course.\n<\/p>\n<p>      4.    In the result, this petition is dismissed.
