SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 02\/05\/2011 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>Present<br \/>\n\tapplication, under<br \/>\n\tsection  24 of the Code of Civil Procedure, has<br \/>\n\tbeen preferred by the petitioner\n<\/p>\n<p>\t&#8211; wife, for an appropriate  order to transfer the proceedings<br \/>\n\tof Hindu<br \/>\n\tMarriage Petition No. 75 of 2009 from the Court<br \/>\n\tof learned Principal Senior Civil Judge, Bhuj-Kutch to the Family<br \/>\n\tCourt at Ahmedabad or any other Court at Ahmedabad.\n<\/p>\n<p>It<br \/>\n\tis the case on behalf of the petitioner<br \/>\n\t that the petitioner<br \/>\n\thas been driven out from her matrimonial home and is compelled to<br \/>\n\tstay at her parental house at Ahmedabad. It is further case of the<br \/>\n\tpetitioner  that she has a<br \/>\n\tminor child aged about 2 years and therefore, it will be very<br \/>\n\tdifficult  for the petitioner<br \/>\n\tto attend the Court at Bhuj-Kutch. It is further the case on behalf<br \/>\n\tof the petitioner  that she<br \/>\n\thas no source of income and it is not possible for the applicant to<br \/>\n\tattend the Court at Bhuj on every adjournment due to financial<br \/>\n\tconstraints. Therefore, it is requested to allow the present<br \/>\n\tpetition.\n<\/p>\n<p>Having<br \/>\n\theard Mr.Mishra, learned advocate<br \/>\n\tappearing on behalf of the petitioner &#8211;  wife and Ms.Nisha<br \/>\n\tParikh, learned advocate appearing<br \/>\n\ton behalf of the respondent &#8211; husband and considering<br \/>\n\tthe  facts narrated hereinabove and considering the fact that the<br \/>\n\tpetitioner is alleged to have been driven out and is compelled to<br \/>\n\treside at her parental home at Ahmedabad and she has a minor child<br \/>\n\taged about 2 years and considering the difficulties to be faced by<br \/>\n\tthe petitioner   to attend<br \/>\n\tthe Court at Bhuj-Kutch which is approximately 400 KMs away from<br \/>\n\tAhmedabad where the petitioner is<br \/>\n\tresiding at her parental house, present petition<br \/>\n\tdeserves to be allowed.\n<\/p>\n<p>In<br \/>\n\tview of the above and for the reasons stated above, present\u00a0petition<br \/>\n\tis allowed. Proceedings of Hindu<br \/>\n\tMarriage Petition No. 75 of 2009 pending in the<br \/>\n\tcourt of learned  Principal Senior Civil Judge, Bhuj-Kutch are<br \/>\n\thereby ordered to be transferred to the Family Court at Ahmedabad.<br \/>\n\tThe learned  Principal Senior Civil Judge, Bhuj-Kutch before whom<br \/>\n\tthe proceedings of  Hindu<br \/>\n\tMarriage<br \/>\n\tPetition No. 75 of 2009 are pending, is hereby<br \/>\n\tdirected to transmit\/transfer the proceedings of  Hindu<br \/>\n\tMarriage Petition No. 75 of 2009 to the Family<br \/>\n\tCourt at Ahmedabad immediately.
