A legal notice dated 18.12.2010<br \/>\nis already issued at the instance of the petitioner to the<br \/>\nCommissioner of Surat Municipal Corporation to stop construction in<br \/>\nthe area adjoining to the Patva Masjid on the basis that the<br \/>\nstructures in question of Patva Masjid is more than 400 years old and<br \/>\nnecessary procedure is initiated for declaring it to be protected<br \/>\nmonument and heritage monument. The petitioner is also stated to have<br \/>\nsent an application, through an advocate, dated 22.12.2010 to the<br \/>\nDirector General, Archaeological Survey of India, New Delhi, Dy.<br \/>\nDirector, Archaeological Survey of India, Secretary, Department of<br \/>\nCulture and Hon&#8217;ble the Prime Minister of India, with the prayer to<br \/>\nmake necessary inquiry and to declare the buildings of Humayusarai,<br \/>\nused as office of Surat Municipal Corporation, as ancient monument<br \/>\nand archaeological site under the provisions of Section 4 of the<br \/>\nAncient Monuments and Archaeological Sites and Remains Act, 1958.\n<\/p>\n<p>2.\tAdmittedly,<br \/>\nthere is in force, a previous order dated 02.02.1999 of this Court in<br \/>\nSpecial Civil Application         No. 2690 of 1996 recording<br \/>\nconsensus about leaving open passage of the width of five feet for<br \/>\ningress or egress for the use of visitors visiting the Patva Masjid.\n<\/p>\n<p>      A letter dated 20.03.1998 of the Managing Trustee of Patva<br \/>\nMasjid conveying some agreement or understanding is taken on record<br \/>\nin that proceeding.\n<\/p>\n<p>3.\tThe<br \/>\nmain grievance of the petitioner is that nothing appears to have<br \/>\nhappened pursuant to aforesaid application dated 22.12.2010. Even as<br \/>\nthe petitioner was not in a position to even prima facie<br \/>\nestablish that, that application was sent to and served upon the<br \/>\naddressees, straightaway reliance was placed upon the provisions of<br \/>\nSection 4 of the Act which require formation of an opinion that any<br \/>\nancient monument or archaeological site is of national importance and<br \/>\nnotification in the official gazette giving two months notice of the<br \/>\nintention to declare such ancient monument or archaeological site to<br \/>\nbe of national importance. Thereafter, such monument or site and<br \/>\nremains may be declared to be of national importance. Thus, the<br \/>\npetitioner is, in effect, seeking a writ of mandamus directing the<br \/>\nCentral Government to form an opinion at the behest of the<br \/>\npetitioner. There is no legal right vested in the petitioner or<br \/>\ncorresponding duty cast upon the Government to form any opinion or to<br \/>\ninitiate any proceeding under Section 4. Therefore, prima facie<br \/>\nthe petition for writ of mandamus of this nature would not be<br \/>\nmaintainable. Apart from that, the petitioner does not seem to have<br \/>\ncared to even serve proper legal notice upon the appropriate<br \/>\nauthorities or to enquire about the process carried out on his<br \/>\nearlier application dated 22.12.2010, which is supposed to have been<br \/>\nsent through an advocate. Therefore, the petition is found to be<br \/>\npremature and lacking in<br \/>\nbona fide pursuit of a genuine cause.
