Justice K.T.SANKARAN\n\n Dated :01\/11\/2010\n\n O R D E R\n                  K.T.SANKARAN, J.\n     -----------------------------------------\n     W.P.(C).No. 37132, 37133 &amp; 37187 OF 2009\n     -----------------------------------------\n                       st\n      Dated this the 1    day of November, 2010\n\n\n\n\n                       JUDGMENT\n<\/pre>\n<p>    The reliefs prayed for in WP(C) No.37132 of<\/p>\n<p>2010 are the following:\n<\/p>\n<\/p>\n<blockquote><p>    &#8220;a)  Issue a Writ of Certiorari or appropriate<br \/>\n        Writs, directions or orders calling for the<br \/>\n        records leading up to Ext.P5 and quash Ext.P5<br \/>\n        to   the  extent   to  which   inducted   the<br \/>\n        petitioner to the post of Associate Professor<br \/>\n        in  Rs.3700-5700  scale   with  effect   from<br \/>\n        30.12.89 instead of 8.9.88 and Professor with<br \/>\n        effect from 16.1.2001 instead of 8.9.96 or<br \/>\n        with effect from 13.12.97;\n<\/p><\/blockquote>\n<blockquote><p>    b)  Declare  that  the   petitioner  is   legally<br \/>\n        entitled to get the induction to the post of<br \/>\n        Associate Professor in Rs.3700-5700 scale in<br \/>\n        1986 UGC Scheme with effect from 8.9.88 and<br \/>\n        career advancement promotion to the post of<br \/>\n        Professor in Rs.16400-22400 scale in 1996 UGC<br \/>\n        Scheme with effect from 8.9.96 or with effect<br \/>\n        from 13.12.97;\n<\/p><\/blockquote>\n<blockquote><p>    c) Issue a Writ of Mandamus or appropriate writs<br \/>\n        directions   or    orders    directing    the<br \/>\n        respondents 3 and 4 to re-fix the salary of<br \/>\n        the  petitioner  to  the  post  of  Associate<br \/>\n        Professor  in  Rs.3700-5700  pay  scale  with<br \/>\n        effect  from  8.9.88  and  to  the  post   of<br \/>\n        Professor in Rs.16400-22400 pay scale with<br \/>\n        effect  from  8.9.96  or  with  effect   from<br \/>\n        13.12.97  and   disburse  the   consequential<br \/>\n        arrears, and increments forthwith.&#8221;\n<\/p><\/blockquote>\n<p>W.P.(C).No. 37132,<br \/>\n37133 &amp; 37187 OF 2009      2<\/p>\n<p>    2. Similar prayers are made in the other Writ<\/p>\n<p>Petitions also.\n<\/p>\n<\/p>\n<p>    3.   The   learned  counsel  for  the  petitioner<\/p>\n<p>submitted that it is not necessary to consider<\/p>\n<p>relief No.(a) at present.     He submitted that in so<\/p>\n<p>far as relief No.(b) is concerned, it is covered in<\/p>\n<p>favour of the petitioners by the decision in WP(C)<\/p>\n<p>No.6558 of 2008.       It is also submitted by the<\/p>\n<p>learned counsel for the petitioner that in Civil<\/p>\n<p>Appeal No. 2540 of 2009 and connected cases, the<\/p>\n<p>Supreme Court approved the view taken by the High<\/p>\n<p>Court.   In view of the judgment referred to above,<\/p>\n<p>the petitioners would be entitled to the       pay of<\/p>\n<p>Rs.3700-5700\/- with effect from the date of non<\/p>\n<p>cadre   promotion    as Associate  Professors.    The<\/p>\n<p>learned    Standing    Counsel  appearing   for   the<\/p>\n<p>University as well as the learned counsel for the<\/p>\n<p>petitioner submitted that the second part of relief<\/p>\n<p>No.(b)   i.e,    Career  advancement   promotion  was<\/p>\n<p>W.P.(C).No. 37132,<br \/>\n37133 &amp; 37187 OF 2009    3<\/p>\n<p>already granted to the petitioners with effect from<\/p>\n<p>27.7.1998,    25.1.1998 and 3.2.2002  respectively.<\/p>\n<p>The learned counsel for the petitioners submitted<\/p>\n<p>that this submission made by the Standing Counsel<\/p>\n<p>is correct. Accordingly, the Writ Petitions are<\/p>\n<p>disposed of directing the respondents 2 to 4 to<\/p>\n<p>grant salary to the petitioners in the pay scale of<\/p>\n<p>Rs.3700-5700 from the date of their non cadre<\/p>\n<p>promotion as Associate Professors.
