R. No.1832 of<\/p>\n<p>                    2008. Heard Mr. Purushottam Jha for the petitioner, and<\/p>\n<p>                    Mr. R. K. Shukla for opposite party no.1. This civil<\/p>\n<p>                    revision application under Section 115 of the Code of<\/p>\n<p>                    Civil Procedure has been preferred by defendant no.3 of<\/p>\n<p>                    Title Suit No. 495 of 2004, and is directed against the<\/p>\n<p>                    order dated 23.7.2008, passed by the learned Sub-<\/p>\n<p>                    Ordinate Judge I Court, Patna, whereby he has held that<\/p>\n<p>                    the preliminary objection raised by this defendant as to<\/p>\n<p>                    the maintainability of the suit shall be taken up at the<\/p>\n<p>                    time of hearing of the suit.\n<\/p>\n<p>                               2. Opposite party no.1 herein instituted the<\/p>\n<p>                    suit for certain reliefs. Defendant no.3 (the petitioner<\/p>\n<p>                    herein) filed an application under Order 7, Rule 11(d),<\/p>\n<p>                    read with Section 9 of the Code of Civil Procedure,<\/p>\n<p>                    submitting therein that, in view of the bar engrafted in<\/p>\n<p>                    Section 57, read with Section 48, of the Bihar Co-<\/p>\n<p>                    operative Societies Act, 1935, the suit in its present<br \/>\n<span class=\"hidden_text\">                3<\/span><\/p>\n<p>frame is not maintainable. On a perusal of the materials<\/p>\n<p>on record, the learned trial court has come to the<\/p>\n<p>conclusion that this shall be taken up at the time of<\/p>\n<p>hearing of the suit. Learned counsel for the petitioner<\/p>\n<p>has relied on the following reported judgments:<\/p>\n<p>   (i) The Premier Automobiles Ltd. Vs.<br \/>\n   Kamlakar Shantaram Wadke and others,<br \/>\n   (1976) 1 SCC 496.\n<\/p>\n<p>   (ii) Rajasthan State Road Transport<br \/>\n   Corporation and others Vs. Deen Dayal<br \/>\n   Sharma, (2010) 6 SCC 697.\n<\/p>\n<p>   (iii) Radha Krishna Jaiswal Vs. Sheela<br \/>\n   Kanchan &amp; others, 2003(1) P.L.J.R. 18.<\/p>\n<p>           3. We have perused the materials on record<\/p>\n<p>and considered the submissions of the learned counsel<\/p>\n<p>for the parties. Law is well settled that the Court before<\/p>\n<p>whom the matter is pending, and whose jurisdiction has<\/p>\n<p>been challenged, has the authority to decide its own<\/p>\n<p>jurisdiction. It appears to us from a perusal of the<\/p>\n<p>impugned order that the learned trial court is of the<\/p>\n<p>view that the question of jurisdiction in the instant suit<\/p>\n<p>is a mixed question of facts and law and will, therefore,<\/p>\n<p>be taken up at the time of hearing of the suit. We do not<\/p>\n<p>find any error in the impugned order. The learned trial<\/p>\n<p>court shall frame a specific issue in that behalf and will,<br \/>\n<span class=\"hidden_text\">                         4<\/span><\/p>\n<p>         inter alia, be guided by the authoritative pronouncement<\/p>\n<p>         of the Supreme Court in Premier Automobiles Ltd<\/p>\n<p>         (supra).\n<\/p>\n<p>                               C. R. No. 1833 of 2008.\n<\/p>\n<p>                    4. Heard Mr. Purushottam Jha for the<\/p>\n<p>         petitioner, and Mr. R. K. Sinha for opposite party no.1.<\/p>\n<p>         One of the defendants of Title Suit No. 494 of 2004 has<\/p>\n<p>         preferred the present civil revision application, and is<\/p>\n<p>         directed against the order dated 23.7.2008, passed by<\/p>\n<p>         the learned Sub-ordinate Judge Ist Court, Patna,<\/p>\n<p>         whereby he has held that the preliminary objection<\/p>\n<p>         raised by this defendant as to the maintainability of the<\/p>\n<p>         suit shall be taken up at the time of hearing of the suit.<\/p>\n<p>         The present civil revision application is entirely covered<\/p>\n<p>         by the aforesaid order dismissing C.R. No. 1832 of<\/p>\n<p>         2008.\n<\/p>\n<p>                    5. In the result, C.R. No.1832 of 2008, and<\/p>\n<p>         C.R.
