Justice M.SASIDHARAN NAMBIAR\n\n Dated :14\/12\/2010\n\n O R D E R\n<\/pre>\n<p>             M.Sasidharan Nambiar, J.\n<\/p>\n<p>          &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n          Crl.M.C.Nos.4573 &amp; 4740 of 2010\n<\/p>\n<p>          &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<\/p>\n<p>                   COMMON ORDER<\/p>\n<p>    Petitioner is the defacto complainant in C.C.No<\/p>\n<p>2741\/2010 on the file of Judicial First Class<\/p>\n<p>Magistrate&#8217;s Court, Irinjalakuda, taken cognizance<\/p>\n<p>for the offences under Sections 465, 468, 471 and<\/p>\n<p>417 read with Section 34 of Indian Penal Code.<\/p>\n<p>Crl.M.C.No.4573\/2010 is filed to quash the case<\/p>\n<p>against respondents 1 to 4, accused 1 to 4 and<\/p>\n<p>Crl.M.C.No.4740\/2010 is filed to quash the case<\/p>\n<p>against the first respondent, the fifth accused,<\/p>\n<p>contending  that  entire   disputes  were   settled<\/p>\n<p>amicably and consequent to the settlement, it is<\/p>\n<p>not in the interest of justice to continue the<\/p>\n<p>prosecution.\n<\/p>\n<p>    2. Prosecution case is that five accused, in<\/p>\n<p>furtherance of their common intention, showing that<\/p>\n<p>out of the consideration of Rs.3,30,000\/- fixed,<\/p>\n<p>Rs.2,90,000\/- was paid as advance and agreed to<\/p>\n<p><span class=\"hidden_text\">CRMC 4573&amp;4740\/10           2<\/span><\/p>\n<p>sell the property and forged an agreement for sale<\/p>\n<p>and  instituted     suits  as  O.S.No.498\/2006  before<\/p>\n<p>Munsiff&#8217;s Court, Irinjalakuda and O.S.No.174\/2006<\/p>\n<p>before Sub Court, Irinjalakuda against petitioner<\/p>\n<p>and  thereby     committed  the  offences.  Petitioner<\/p>\n<p>would    contend    that   on  the   intervention   of<\/p>\n<p>mediators, all the disputes with the accused were<\/p>\n<p>settled amicably and hence, it is not in the<\/p>\n<p>interest of justice to continue the prosecution.<\/p>\n<p>    2. Learned counsel appearing for the petitioner<\/p>\n<p>and learned Public Prosecutor were heard.<\/p>\n<p>    3. Offences alleged against the accused are<\/p>\n<p>purely personal in nature against the petitioner,<\/p>\n<p>the   defacto     complainant.  It  is   the   defacto<\/p>\n<p>complainant herself, who has filed this petition<\/p>\n<p>contending that entire disputes with the accused<\/p>\n<p>were settled amicably. As held by the Apex Court in<\/p>\n<p><a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of Punjab<\/a> (2008 (3) KLT<\/p>\n<p>19) and Manoj Sharma v. State (2008 (4) KLT 417),<\/p>\n<p>when the offences alleged are purely personal in<\/p>\n<p>CRMC 4573&amp;4740\/10        3<\/p>\n<p>nature and petitioner has settled all the disputes<\/p>\n<p>with the accused, it is not in the interest of<\/p>\n<p>justice to continue the prosecution as there is no<\/p>\n<p>likelihood of a successful prosecution.<\/p>\n<p>     Petitions are allowed.
