{"id":31263,"date":"2010-07-15T00:00:00","date_gmt":"2010-07-14T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/gopal-jhode-vs-principal-secretary-the-state-of-on-15-july-2010"},"modified":"2018-04-22T18:16:17","modified_gmt":"2018-04-22T12:46:17","slug":"gopal-jhode-vs-principal-secretary-the-state-of-on-15-july-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/gopal-jhode-vs-principal-secretary-the-state-of-on-15-july-2010","title":{"rendered":"Gopal Jhode vs Principal Secretary The State Of &#8230; on 15 July, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Madhya Pradesh High Court<\/div>\n<div class=\"doc_title\">Gopal Jhode vs Principal Secretary The State Of &#8230; on 15 July, 2010<\/div>\n<pre>                                    1\n\n\n\n\n                    Writ Appeal No.1176\/2009\n15.07.2010\n      Shri Sanjay K.Agrawal, learned counsel for the appellant.\n      Shri Sanjay Dwivedi, learned Government Advocate for the\nrespondents.\n      With the consent of the parties, the matter is heard finally.\n      This is intra court appeal arises from the order dated 10.11.2009\npassed by the learned Single Judge in W.P.No.11045\/2008.\n      Facts<\/pre>\n<p> briefly stated leading to filing of the instant writ appeal are<br \/>\nthat the Collector, Balaghat, vide order dated 7.4.2005 granted<br \/>\npermission to the Gram Panchayat Chicholi to make appointment on the<br \/>\npost of Panchayat Karmi. The Gram Panchayat issued an advertisement<br \/>\ndated 15.5.2005 by which applications were invited for appointment on<br \/>\nthe post of Panchayat Karmi. Pursuant to the aforesaid advertisement as<br \/>\nmany as 9 candidates including the present appellant submitted the<br \/>\napplication. However, the Gram Panchayat instead of making<br \/>\nappointment on the basis of merit, passed a resolution dated 24.6.2005<br \/>\nby which one Sujit Kumar was appointed as Panchayat Karmi on the<br \/>\nbasis of majority of votes. The Sub Divisional Officer vide order dated<br \/>\n28.10.2005 suspended the resolution passed by the Gram Panchayat<br \/>\nand directed the Gram Panchayat to reconvene the meeting and to take<br \/>\naction for selection of Panchayat Karmi as per directions of the State<br \/>\nGovernment. However, instead of making selection from amongst the<br \/>\ncandidates who had submitted their applications, Gram Panchayat once<br \/>\nagain appointed Panchayat Karmi on the basis of majority of votes vide<br \/>\nresolution dated 12.4.2006.\n<\/p>\n<p>      The aforesaid resolution was challenged by the respondent no.5<br \/>\nbefore the Sub Divisional Officer. The Sub Divisional Officer vide order<br \/>\ndated 16.6.2007 suspended the resolution and forwarded the matter to<br \/>\nthe Collector for confirmation of the order passed by him. The Collector<br \/>\nvide order dated 28.9.2007 confirmed the order and directed the Gram<br \/>\nPanchayat to select and make appointment on the post of Panchayat<br \/>\nKarmi on the basis of merit as per directions issued by the State<br \/>\n<span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>Government, within a period of 15 days. However, the Gram Panchayat<br \/>\nagain instead of complying with the mandate of the Collector invited<br \/>\nfresh applications and vide resolution dated 5.12.2007 resolved to<br \/>\nappoint the respondent no.6 as Panchayat Karmi and an order of<br \/>\nappointment dated 10.12.2007 was issued in her favour.\n<\/p>\n<p>       The resolution dated 5.12.2007 was again challenged before the<br \/>\nSub Divisional Officer. The Sub Divisional Officer once again vide order<br \/>\ndated 10.6.2008 suspended the resolution dated 5.12.2007 passed by<br \/>\nthe Gram Panchayat. The Collector once again vide order dated<br \/>\n25.7.2008 confirmed the order dated 10.6.2008 passed by the Sub<br \/>\nDivisional Officer. The respondent no.6 filed a writ petition namely<br \/>\nW.P.No.11045\/2008 before this Court.\n<\/p>\n<p>       The learned Single Judge vide order dated 10.11.2009 dismissed<br \/>\nthe writ petition preferred by the respondent no.6. However, the case of<br \/>\nthe respondent no.6, in the peculiar facts of the case, was directed to be<br \/>\nconsidered along with other applicants for appointment on the post of<br \/>\nPanchayat Karmi. The aforesaid order is the subject matter of challenge<br \/>\nin the instant appeal.\n<\/p>\n<p>       Learned counsel for the appellant submitted that the learned<br \/>\nSingle Judge, having found that no right is created in favour of the<br \/>\nrespondent no.6 as the proceedings were taken by the Gram Panchayat<br \/>\nin violation of order dated 28.9.2007 passed by the Collector, erred in<br \/>\ndirecting the respondent no.4 to consider the case of the respondent<br \/>\nno.6 for appointment on the post of Panchayat Karmi. It was further<br \/>\nsubmitted that when applications were invited for the first time on<br \/>\n15.5.2005 the respondent no.6 was minor and, therefore, was not<br \/>\neligible for appointment.\n<\/p>\n<p>       We find force in the submissions made by the learned counsel for<br \/>\nthe appellant. A perusal of the order dated 28.9.2007 passed by the<br \/>\nCollector reveals that he had issued a direction to make selection from<br \/>\namongst the applicants who had submitted their applications pursuant<br \/>\nto advertisement dated 15.5.2005. Admittedly, the respondent no.6 on<br \/>\nthe date of first advertisement dated 15.5.2005 was minor and,<br \/>\n<span class=\"hidden_text\">                                         3<\/span><\/p>\n<p>     therefore, her case could not have been considered for appointment on<br \/>\n     the post of Panchayat Karmi.\n<\/p>\n<p>           For the aforementioned reasons, we modify the order passed by<br \/>\n     the learned Single Judge to the extent it directs the respondent no.4 to<br \/>\n     consider the case of the respondent no.6 along with other candidates for<br \/>\n     appointment as Panchayat Karmi. The aforesaid direction of the learned<br \/>\n     Single Judge is hereby set aside.
