                  In this second appeal, the judgment and decree<\/p>\n
             dated 02.03.2009 passed by the Addl. District Judge<\/p>\n
             (Fast Track) No.4, Jodhpur in Civil Appeal decree<\/p>\n
             No.96\/08 is under challenge, whereby, the learned<\/p>\n
             lower appellate Court while dismissing the appeal<\/p>\n
             affirmed the judgment and decree dated 26.02.2005<\/p>\n
             passed by Addl. Civil Judge (Jr. Dn.) No.5, Jodhpur in<\/p>\n
             Civil Original Case No.16\/98, by which, the appellant-<\/p>\n
             tenant has been ordered to be evicted from the<\/p>\n
             premises in question.\n<\/p>\n
                                    2<\/span><\/p>\n
     According to brief facts of the case, respondent-<\/p>\n
landlord preferred suit for eviction and recovery of<\/p>\n
arrears of rent in the year 1998 with assertion that he<\/p>\n
was allotted plot by the U.I.T., Jodhpur and he is sole<\/p>\n
owner of the said plot upon which he has constructed a<\/p>\n
house, situated at Baiji-ka-Talab, near Ramdeoji Temple<\/p>\n
and said house was given on rent to the appellant-<\/p>\n
defendant under rent-deed dated 31.01.1976.                    Suit<\/p>\n
was filed on the basis of default as well as on the<\/p>\n
ground      of    bona    fide    necessity    and    comparative<\/p>\n
hardship.        Learned trial Court framed as many as nine<\/p>\n
issues and after framing the issues, statements of five<\/p>\n
prosecution witnesses were recorded and no evidence<\/p>\n
was produced by the appellant-defendant inspite of<\/p>\n
granting enough time. Upon adjudication of the issues,<\/p>\n
the trial Court decreed the suit in favour of the<\/p>\n
respondent-plaintiff, by which, decree for eviction and<\/p>\n
recovery of rent was passed on 26.02.2005.                     Said<\/p>\n
judgment of the trial Court was challenged by the<\/p>\n
appellant-defendant before the District Judge, Jodhpur<\/p>\n
by way of filing appeal which was transferred to the<\/p>\n
Court of Addl. District Judge (Fast Track) No.4, Jodhpur.<\/p>\n
Learned lower appellate Court while dismissing the<\/p>\n
appeal   affirmed        the     judgment     and    decree   dated
\n                                    3<\/span><\/p>\n
26.02.2005 vide judgment dated 02.03.2009.<\/p>\n
      The   present      appeal        has     been     filed   by    the<\/p>\n
defendant-tenant      on    the        ground    that     though      the<\/p>\n
appellant specifically pleaded that the rent-deed Ex.-3 is<\/p>\n
not properly stamped and the same is not a registered<\/p>\n
document,    therefore,          the    said    rent-deed       is    not<\/p>\n
admissible in evidence, the learned trial Court has,<\/p>\n
however, not looked into the provisions of Stamp Act,<\/p>\n
therefore, judgments rendered by both the Courts<\/p>\n
below deserve to be quashed. As per learned counsel<\/p>\n
for the appellant, the rent-deed being not properly<\/p>\n
stamped and unregistered document is inadmissible in<\/p>\n
evidence but the learned trial Court wrongly dismissed<\/p>\n
the   application   of     the    defendant       for    raising     said<\/p>\n
objection and wrongly arrived at the finding that the<\/p>\n
rent-deed is not inadmissible in law.\n<\/p>\n
      Learned counsel for the appellant further argued<\/p>\n
that the trial Court as well as lower appellate Court has<\/p>\n
failed to take into consideration the aspect principles of<\/p>\n
natural justice.         As per learned counsel for the<\/p>\n
appellant, the appellant has not been granted sufficient<\/p>\n
opportunity of leading evidence in his defence.                      It is<\/p>\n
contended that before the trial Court opportunity was<\/p>\n
sought by the defendant on the ground that his counsel
\n                              4<\/span><\/p>\n
was out of town on 23.11.2004 due to marriage of his<\/p>\n
daughter’s daughter.       Learned trial Court however<\/p>\n
granted only two days’ time and matter was ordered to<\/p>\n
be fixed on 25.11.2004.          Thereafter, opportunity to<\/p>\n
lead evidence in defence was closed.         Therefore, in a<\/p>\n
hasty manner the trial Court decided the case which is<\/p>\n
against the principles of natural justice.<\/p>\n
      I have perused the judgment of the trial Court as<\/p>\n
well as judgment passed by the learned lower appellate<\/p>\n
Court.\n<\/p>\n
      It is very strange that before the trial Court the<\/p>\n
plea of the appellant was that the rent-deed is forged<\/p>\n
one but no evidence was produced before the trial Court<\/p>\n
to substantiate the plea of fabrication of the document.<\/p>\n
So also, no efforts were made to prove the contention<\/p>\n
before the trial Court.     Therefore, it appears that a<\/p>\n
baseless plea was taken before the trial Court by the<\/p>\n
appellant-tenant which is rightly discredited by the trial<\/p>\n
Court because no evidence whatsoever was produced<\/p>\n
by the appellant-defendant.\n<\/p>\n
      Similarly, on the ground of bona fide necessity,<\/p>\n
the appellant failed to produce any evidence on record<\/p>\n
in his defence inspite of granting ample opportunity,<\/p>\n
then, obviously he cannot be permitted to raise any
\n                                5<\/span><\/p>\n
objection with regard to finding of fact at this stage.<\/p>\n
Therefore, the finding of fact arrived at by the Courts<\/p>\n
below does not require interference.             So also, no<\/p>\n
substantial question of law emerges in this second<\/p>\n
appeal for consideration.\n<\/p>\n
     The other ground with regard to admissibility of<\/p>\n
unregistered rent-deed was rejected by the trial Court<\/p>\n
vide order dated 26.08.2004 by speaking order which is<\/p>\n
not challenged by the appellant. Therefore, the ground<\/p>\n
raised by the appellant now in this appeal is not<\/p>\n
tenable.\n<\/p>\n
     In this view of the matter, there is no ground for<\/p>\n
interference.        Consequently, this second appeal is<\/p>\n
hereby dismissed.\n<\/p>\n
     However, learned counsel for the appellant prayed<\/p>\n
that some time may be granted to the appellant to<\/p>\n
vacate the premises in question.           In my opinion, the<\/p>\n
prayer made by learned counsel for the appellant is<\/p>\n
genuine, therefore, six months’ time is hereby allowed<\/p>\n
to vacate the premises and to hand over vacant<\/p>\n
possession      of   the   premises   in    question   to   the<\/p>\n
respondent-plaintiff, upon the condition further that the<\/p>\n
appellant shall furnish undertaking before the trial Court<\/p>\n
that he will give vacant possession of the premises in
\n                               6<\/span><\/p>\n
question by 31st March, 2010 and, so also, he shall<\/p>\n
deposit the amount decreed by the trial Court within<\/p>\n
one month and shall continue to pay mesne profits<\/p>\n
month by month till handing over vacant possession to<\/p>\n
the respondent-plaintiff.     It is made clear that if the<\/p>\n
appellant will not furnish the above undertaking and\/or<\/p>\n
fails to deposit the amount as ordered above within one<\/p>\n
month      from   today,    then,    appropriate   contempt<\/p>\n
proceedings shall be initiated against him.<\/p>\n
