Balachandran, J.\n            ---------------------------\n             C.M.Appl.No.68 of 2007 &amp;\n               R.S.A.No.111 of 2007\n            ---------------------------\n\n                     JUDGMENT\n<\/pre>\n<p>    Advocate Sri.Parthasarathy, on behalf of the<\/p>\n<p>counsel for the appellant, prays for adjournment of<\/p>\n<p>the case. I see no reason why adjournment is to be<\/p>\n<p>granted for the purpose of consideration of C.M.<\/p>\n<p>Appl.No.68\/07,   wherein,  the    prayer   is   for<\/p>\n<p>condonation of delay of 212 days in filing the<\/p>\n<p>appeal. Counsel for the respondents also is absent.<\/p>\n<p>Perused the records.\n<\/p>\n<p>    2.   The judgment under appeal was passed on<\/p>\n<p>13.3.2006.  Copy application was made on 20.6.2006,<\/p>\n<p>only  after  more  than  three  months.  Copy   was<\/p>\n<p>delivered on 10.10.2006, but the appeal is filed<\/p>\n<p>only on 19.1.2007.\n<\/p>\n<p>    3.   In the affidavit filed by the wife and<\/p>\n<p>Power of Attorney holder of the appellant, the<\/p>\n<p>averments are that when the appeal was heard by the<\/p>\n<p>lower appellate counsel, her counsel had told her<\/p>\n<p><span class=\"hidden_text\">RSA 111\/07               2<\/span><\/p>\n<p>that on pronouncement of the judgment, he would<\/p>\n<p>intimate   the   same  to   her   and  also   would<\/p>\n<p>simultaneously make arrangements to apply for a<\/p>\n<p>certified copy of the judgment; that since she did<\/p>\n<p>not get any communication from the office of her<\/p>\n<p>counsel in the court below till third week of June<\/p>\n<p>2006, she went over to the office of her counsel in<\/p>\n<p>the court below and made enquiries and only then,<\/p>\n<p>it was noted that the judgment was pronounced in<\/p>\n<p>March 2006 itself and application for certified<\/p>\n<p>copy of the judgment was not made; that immediately<\/p>\n<p>she made arrangements to apply for certified copy<\/p>\n<p>of the judgment; that copy of the judgment was<\/p>\n<p>ready and 1.7.2006 was fixed as the date to take<\/p>\n<p>delivery   of  the  judgment,  but,  it was   taken<\/p>\n<p>delivery of only on 10.10.2006, after more than<\/p>\n<p>three months, as the Clerk did not take note of the<\/p>\n<p>date fixed by the Registry to appear and receive<\/p>\n<p>the certified copy of the judgment; that when she<\/p>\n<p>approached   her  counsel  before  this Court,   on<\/p>\n<p>perusing the records, pointed out that certified<\/p>\n<p>copy of the judgment in A.S.No.105\/05 alone was<\/p>\n<p><span class=\"hidden_text\">RSA 111\/07                3<\/span><\/p>\n<p>there among the records handed over to him and<\/p>\n<p>certified copy of the judgment in A.S.No.104\/05 is<\/p>\n<p>also necessary to enable him to proceed with the<\/p>\n<p>matter and she was, therefore, constrained to make<\/p>\n<p>another copy application for certified copy of the<\/p>\n<p>judgment, but during the second week of January<\/p>\n<p>2007, her counsel intimated her that certified copy<\/p>\n<p>of the judgment in A.S.No.104\/05 was already in the<\/p>\n<p>records    handed  over  to  him   by  her  and   he<\/p>\n<p>inadvertently thought that the certified copy of<\/p>\n<p>the judgment in A.S.No.104\/05 was not there in the<\/p>\n<p>records handed over to him and that the present<\/p>\n<p>appeal is immediately thereafter filed before this<\/p>\n<p>Court on 19.1.2007.\n<\/p>\n<p>     4.   Though the judgment under appeal is one in<\/p>\n<p>A.S.No.105\/05, the judgment is a common judgment in<\/p>\n<p>A.S.Nos.104\/05 and 105\/05. No sensible Lawyer would<\/p>\n<p>advise    the party  to  get  another  copy  of  the<\/p>\n<p>judgment in A.S.No.104\/05 to file appeal against<\/p>\n<p>the judgment and decree in A.S.No.105\/05.         No<\/p>\n<p>Lawyer    appearing  before  this  Court  owes   the<\/p>\n<p>responsibility for having given such an advice and<\/p>\n<p><span class=\"hidden_text\">RSA 111\/07                4<\/span><\/p>\n<p>no affidavit is filed.   As regards the fault on the<\/p>\n<p>part    of  the  Lawyer  in  the court  below,   the<\/p>\n<p>allegations are made against him behind his back<\/p>\n<p>and no affidavit is filed by him supporting the<\/p>\n<p>case of the appellant. Allegations are also made<\/p>\n<p>against the Clerk of the Lawyer in the court below,<\/p>\n<p>and that also is made behind his back.   The party,<\/p>\n<p>who is negligent in the matter of prosecuting his<\/p>\n<p>case cannot, by making such allegations, seek to<\/p>\n<p>have condoned the delay of as much as 212 days in<\/p>\n<p>filing the appeal, so as to disturb and upset the<\/p>\n<p>rights    that  have   accrued  to  the   successful<\/p>\n<p>parties\/respondents, by filing appeal much out of<\/p>\n<p>time.
