Justice HARUN-UL-RASHID\n\n Dated :09\/06\/2010\n\n O R D E R\n                      HARUN-UL-RASHID, J.\n                       ------------------------\n                        S.A.No.267 Of 1998\n                        ----------------------\n               Dated this the 9th day of June, 2010.\n\n                           J U D G M E N T\n<\/pre>\n<p>      The defendant in O.S.No.205 of 1989 on the file of the<\/p>\n<p>Principal Munsiff Court, Nedumangad is the appellant. The suit<\/p>\n<p>was filed for declaration and partition. The trial court passed a<\/p>\n<p>preliminary decree declaring plaintiff&#8217;s right to partition 1\/5 share<\/p>\n<p>by metes and bounds over suit property on paying proportionate<\/p>\n<p>redemption price and declaring that the plaintiff is entitled to<\/p>\n<p>mesne profits from the date of possession. The appeal preferred<\/p>\n<p>by the appellant\/defendant is dismissed confirming the judgment<\/p>\n<p>and decree passed by the trial court.        Parties are hereinafter<\/p>\n<p>referred to as the plaintiff and defendant as arrayed in the suit.<\/p>\n<p>      2.   Admittedly, the plaintiff&#8217;s father executed a sale deed<\/p>\n<p>for and on behalf of the plaintiff to the first defendant as per<\/p>\n<p>document No.576\/36\/67 in the year 1967 marked as Ext.B2. At<\/p>\n<p>the time of execution of Ext.B2 sale deed the plaintiff was a<\/p>\n<p>minor. It is contended by the plaintiff that the sale deed is not<\/p>\n<p>binding on the plaintiff and it is not supported by consideration to<\/p>\n<p>S.A.No.267 Of 1998<\/p>\n<p>                                 ::2::\n<\/p>\n<p>the extent of the share of the plaintiff. It is contended that the<\/p>\n<p>sale deed executed in favour of the plaintiff is void and that he is<\/p>\n<p>entitled to partition and separate possession of his 1\/5 share<\/p>\n<p>ignoring the sale deed. The suit was filed to declare Exts.A1 &amp; B2<\/p>\n<p>sale deeds as void ab-initio and for partition and separate<\/p>\n<p>possession of 1\/5 share.      The defendant resisted the suit and<\/p>\n<p>prayed for dismissal of the suit. The appellant\/defendant inter<\/p>\n<p>alia contended that the suit is barred by limitation; the sale deed<\/p>\n<p>was executed by the guardian of the plaintiff for valid<\/p>\n<p>consideration and therefore the plaintiff is not entitled to any<\/p>\n<p>share and therefore the plaintiff is not entitled to relief for setting<\/p>\n<p>aside the sale deed and claim 1\/5 share.\n<\/p>\n<p>      3.    The trial court held that Ext.B2 sale deed executed on<\/p>\n<p>behalf of the plaintiff is void and the court further held that since<\/p>\n<p>the sale deed is a void document, Article 60 of the Limitation Act<\/p>\n<p>will not apply. In that premise a decree was passed by the trial<\/p>\n<p>court.   The appellate court confirmed the findings of the trial<\/p>\n<p>court and dismissed the appeal. There is no discussion by the<\/p>\n<p>trial court nor any finding recorded that Exts.A1 &amp; B2 sale deeds<\/p>\n<p>S.A.No.267 Of 1998<\/p>\n<p>                                  ::3::\n<\/p>\n<p>are void. Learned counsel for the appellant brought to the notice<\/p>\n<p>of this Court Section 8(3) of the Hindu Minority and Guardianship<\/p>\n<p>Act, 1956. Section 8(3) reads follows:\n<\/p>\n<blockquote><p>              &#8220;8. Powers of natural guardian.-\n<\/p><\/blockquote>\n<blockquote><p>        (1)   The natural guardian of Hindu minor has power,<\/p>\n<p>        subject to the provisions of this section, to do all acts<\/p>\n<p>        which are necessary or reasonable and proper for the<\/p>\n<p>        benefit of the minor or for the realisation, protection or<\/p>\n<p>        benefit of the minor&#8217;s estate; but the guardian can in no<\/p>\n<p>        case bind the minor by a personal covenant.<\/p>\n<p>        (2)   The natural guardian shall not, without the<\/p>\n<p>        previous permission of the court, &#8211;\n<\/p><\/blockquote>\n<blockquote><p>              (a)   mortgage or charge, or transfer by sale,<\/p>\n<p>        gift, exchange or otherwise, any part of the immovable<\/p>\n<p>        property of the minor; or<\/p>\n<\/blockquote>\n<blockquote><p>              (b)   lease any part of such property for a term<\/p>\n<p>        exceeding five years or for a term extending more than<\/p>\n<p>        one year beyond the date on which the minor will attain<\/p>\n<p>        majority.\n<\/p><\/blockquote>\n<blockquote><p>        (3)   Any disposal of immovable property by a natural<\/p>\n<p>        guardian, in contravention of sub-section (1) or sub-<\/p>\n<p>        section (2), is voidable at the instance of the minor or<\/p>\n<p>        by any person claiming under him.&#8221;\n<\/p><\/blockquote>\n<p>S.A.No.267 Of 1998<\/p>\n<p>                                ::4::\n<\/p>\n<p>Article 60 of the Limitation Act mandates that a suit to set aside<\/p>\n<p>a transfer of property made by the guardian of a ward shall be<\/p>\n<p>filed by the ward who has attained majority within three years of<\/p>\n<p>his attaining majority.    Admittedly, the suit was filed beyond<\/p>\n<p>three years and at the time of filing the suit the plaintiff was aged<\/p>\n<p>27 years. Since the plaintiff did not approach the court of law<\/p>\n<p>within the time limit prescribed under the Limitation Act the suit<\/p>\n<p>is barred by limitation. Learned counsel for the appellant also<\/p>\n<p>brought to the notice of this Court the decisions reported in<\/p>\n<p><a href=\"\/doc\/1053453\/\">Ramadas       Menon     v.   Sreedevi<\/a>      (2004(1)     KLT     323),<\/p>\n<p><a href=\"\/doc\/454130\/\">Vishwambhar and Others v. Laxminarayan and Another<\/a><\/p>\n<p>(2001(6) SCC 163) and <a href=\"\/doc\/1208005\/\">M.C.Mehta v. Union of India and<\/p>\n<p>Others<\/a> (2004(8) SCC 784).\n<\/p>\n<p>      4.   The suit was filed when the plaintiff attained the age of<\/p>\n<p>27, more than 9 years after attaining majority. Therefore, the<\/p>\n<p>suit is barred by limitation. Since the suit is barred by limitation<\/p>\n<p>the other contentions of the plaintiff ought not have been<\/p>\n<p>considered by the trial court and the suit ought to have dismissed<\/p>\n<p>as barred by limitation.    In the light of the provisions quoted<\/p>\n<p>S.A.No.267 Of 1998<\/p>\n<p>                                 ::5::\n<\/p>\n<p>above and the decisions reported above, the suit itself is barred<\/p>\n<p>by limitation. In the circumstances, the plaintiff is not entitled to<\/p>\n<p>any reliefs claimed in the plaint.\n<\/p>\n<p>     In the result, the appeal is allowed.     The judgment and<\/p>\n<p>decree passed by the court below is set aside and the suit stands<\/p>\n<p>dismissed.
