Justice K.M.JOSEPH\n\n Dated :14\/08\/2007\n\n O R D E R\n                         K.M.JOSEPH, J.\n                - - - - - - - - - - - - - - - - - - - - -\n             W.P.(C).No. 17074 OF 2007\n            - - - - - - - - - - - - - - - - - - - - - - - - - -\n                Dated this the 14th day of August, 2007\n\n\n                             JUDGMENT\n<\/pre>\n<p>      Petitioner availed a loan which is not repaid. An award was<\/p>\n<p>passed. Petitioner challenges the consequential demand notice<\/p>\n<p>issued by the second respondent. Petitioner seeks a direction to<\/p>\n<p>the second respondent to give reasonable time to pay off the<\/p>\n<p>debt and to extend the benefits provided to the debtor as per<\/p>\n<p>Ext.P3 circular.\n<\/p>\n<p>      2.    I heard learned counsel for the petitioner and the<\/p>\n<p>learned counsel for the Bank.\n<\/p>\n<p>      3.    Learned counsel for Bank points out that the petitioner<\/p>\n<p>is not entitled to the benefit of Ext.P3 circular as prohibition in<\/p>\n<p>Ext.P3 is against the charge of rate higher than 100 % of the<\/p>\n<p>principal amount and in this case interest demanded is not in<\/p>\n<p>excess of double the amount and therefore the petitioner is not<\/p>\n<p>entitled to the benefit of the the circular.<\/p>\n<p>      4.    Learned counsel for the petitioner submits that<\/p>\n<p><span class=\"hidden_text\">WPC No.17074\/07                   2<\/span><\/p>\n<p>petitioner may be permitted to pay off the entire amount in easy<\/p>\n<p>instalments.\n<\/p>\n<p>      Having regard to all facts, the writ petition is disposed of<\/p>\n<p>permitting the petitioner to pay off the entire amount remaining<\/p>\n<p>to be paid with due interest in 7 equal monthly instalments, the<\/p>\n<p>first of which shall be payable on or before 15\/09\/2007.<\/p>\n<p>Petitioner has to pay the remaining instalments on or before the<\/p>\n<p>15th of every succeeding months. The first respondent will serve<\/p>\n<p>a statement on the petitioner showing the amount payable by the<\/p>\n<p>petitioner with interest and also the amount of instalment<\/p>\n<p>payable on the basis that the amount is to be paid in 7 equal<\/p>\n<p>monthly instalments, within two weeks from today.
