Justice K.HEMA\n\n Dated :23\/07\/2008\n\n O R D E R\n                           K.HEMA, J.\n                --------------------------------------\n                 Bail Application No.4626 of 2008\n                ---------------------------------------\n               Dated this the 23rd day of July, 2008\n\n\n                              O R D E R\n<\/pre>\n<p>     This petition is for bail.\n<\/p>\n<p>     2.    The alleged offence is under Section 55(a) of Abkari<\/p>\n<p>Act.  According to the prosecution, the accused was found in<\/p>\n<p>possession of 12 litres of Indian made foreign liquor on<\/p>\n<p>29.6.2008 and he was arrested on the same day.             He is in<\/p>\n<p>custody since then.\n<\/p>\n<p>     3.    Learned public prosecutor submitted that he has no<\/p>\n<p>objection in granting bail to the petitioner on conditions.<\/p>\n<p>     Hence, bail is granted to the petitioner on the following<\/p>\n<p>terms and conditions:\n<\/p>\n<blockquote><p>     (i)   Petitioner shall execute bond for Rs.25,000\/- with two<\/p>\n<p>           solvent sureties each for the like sum to the<\/p>\n<p>           satisfaction of the Magistrate Court concerned.<\/p>\n<\/blockquote>\n<blockquote><p>    (ii)   Petitioner shall report before the Investigating Officer<\/p>\n<p>           on every Monday and Thursday between 10 a.m. and<\/p>\n<p>           1 p.m. until further orders.\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\">BA No.4626\/08                    2<\/span><\/p>\n<\/blockquote>\n<blockquote><p>    (iii)   Petitioner shall not commit any offence while on bail<\/p>\n<p>            and in case of breach of this condition, bail is liable to<\/p>\n<p>            be cancelled.\n<\/p><\/blockquote>\n<blockquote><p>\n       The petition is allowed.<\/p><\/blockquote>\n<p>                                                  K.HEMA, JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Bharathan vs State Of Kerala Represented By The on 23 July, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 4626 of 2008() 1.
