Justice R.BASANT\n\n Dated :12\/02\/2008\n\n O R D E R\n                               R.BASANT, J.\n\n                            ----------------------\n\n                         W.P.C.No.35429 of 2007\n\n                        ----------------------------------------\n\n               Dated this the 12th day of February 2008\n\n\n                             J U D G M E N T\n<\/pre>\n<p>      The petitioner is the first accused and he faces allegations<\/p>\n<p>in a crime registered under the Immoral Traffic Prevention Act.<\/p>\n<p>He   is   arrayed   as   the   first   accused.     Altogether   there   are   four<\/p>\n<p>accused   persons.     The   other   accused   are   the   employees   of   the<\/p>\n<p>petitioner   herein.     While   investigation   in   that   case   was   being<\/p>\n<p>conducted   by   the   fourth   respondent   &#8211;   the   Circle   Inspector   of<\/p>\n<p>Police of Vizhinjam, who had registered the crime, the petitioner<\/p>\n<p>lodged   a   complaint   before   the   Director   General   of   Police.     He<\/p>\n<p>complained   that   the   fourth   respondent   is   interested   in   falsely<\/p>\n<p>implicating  him and at the  instance  of some others  who are  ill-<\/p>\n<p>disposed   to   the   petitioner   because   of   business   interest,   such   a<\/p>\n<p>crime   has   been   registered   and   the   petitioner   has   been   falsely<\/p>\n<p>implicated.  The first respondent, the Director General of Police,<\/p>\n<p>on   that  application  directed  the   third   respondent,  the   Assistant<\/p>\n<p>Commissioner   of   Police   to   enquire   into   the   matter.     He<\/p>\n<p>conducted an enquiry and came to the  conclusion  and reported<\/p>\n<p><span class=\"hidden_text\">W.P.C.No.35429\/07                       2<\/span><\/p>\n<p>to   the   first   respondent   his   conclusions.     On   the   basis   of   such<\/p>\n<p>report,   the   first   respondent   has   now   decided   that   further<\/p>\n<p>investigation should not be conducted by the fourth respondent;<\/p>\n<p>but   instead,   the   same   must   be   conducted   by   another   Circle<\/p>\n<p>Inspector of Police namely the Circle Inspector of Police, Pettah.<\/p>\n<p>Such officer is now conducting the investigation.  Investigation is<\/p>\n<p>not complete.  Final report has not been filed.\n<\/p>\n<\/p>\n<p>      2.     The   petitioner   has   come   to   this   court,   while   the<\/p>\n<p>enquiry by the third respondent was pending, with the grievance<\/p>\n<p>that attempt has  now  been  made  not  to  give due  regard  to  the<\/p>\n<p>enquiry  conducted by the third respondent and an attempt was<\/p>\n<p>being   made   to   still   continue   the   prosecution   against   the<\/p>\n<p>petitioner.     Respondents   were   directed   to   file   a   statement.<\/p>\n<p>Statement   has   been   filed.     It   is   now   reported   that   the   Circle<\/p>\n<p>Inspector   of   Police,   Pettah   is   continuing   the   investigation   as<\/p>\n<p>directed by the first respondent.  The petitioner&#8217;s grievance that<\/p>\n<p>the   fourth   respondent   is   not   conducting   a   proper   investigation<\/p>\n<p>was considered by the first respondent and directions have been<\/p>\n<p>issued   to   the   Circle   Inspector   of   Police,   Pettah   to   conduct   the<\/p>\n<p>investigation   now.     That   decision   was   taken   by   the   first<\/p>\n<p><span class=\"hidden_text\">W.P.C.No.35429\/07                         3<\/span><\/p>\n<p>respondent obviously  on  the  report  which  he  had  secured  after<\/p>\n<p>enquiry by the third respondent.\n<\/p>\n<\/p>\n<p>       3.     Investigation   by   the   C.I,   Pettah,   the   present<\/p>\n<p>investigating   officer,     is   going   on,   I   am   of   the   opinion   that   no<\/p>\n<p>further   directions   can   or   need   be   issued   by   this   court   at   this<\/p>\n<p>stage.     The   present   investigating   officer,   I   need   only   observe,<\/p>\n<p>must complete the investigation as expeditiously as possible and<\/p>\n<p>file an appropriate final report after such investigation.<\/p>\n<p>       4.
