     2.         This   Misc.   Civil   Application   is   filed <\/p>\n
     praying   therein,   the   transfer   of   the   proceedings <\/p>\n
     of  Hindu  Marriage  Petition  No.  232 of 2010  filed <\/p>\n
     by the respondent herein, before the Court of the <\/p>\n
     Civil Judge, Senior Division, Akola under Section <\/p>\n
     13 of the Hindu Marriage Act, to the Court of the <\/p>\n
     Civil Judge, Senior Division, Aurangabad.\n<\/p>\n
     3.<\/p>\n
                It is the case of the applicant that, the <\/p>\n
     marriage between the applicant and the respondent <\/p>\n
     solemnized   on   20-06-1994   at   Buldana   as   per   Hindu <\/p>\n
     Rites and Customs.   Thereafter, they have started <\/p>\n
     residing   at   Aurangabad   as   the   respondent   is   in <\/p>\n
     service in the Company at M.I.D.C. Aurangabad.\n<\/p>\n
     .          It is the case of the applicant that, in <\/p>\n
     spite of more than 16 years are passed after the <\/p>\n
     marriage, they have not blessed by God, they have <\/p>\n
     taken medical treatment and advice of the Doctor, <\/p>\n
     but in vain. On this ground, the respondent herein <\/p>\n
     filed  Hindu  Marriage  Petition  No. 232  of 2010  in <\/p>\n

     the   Court   of   the   Civil   Judge,   Senior   Division, <\/p>\n
     Akola  under  Section  13 of the  Hindu  Marriage   Act <\/p>\n
     for divorce. Hence, this application for transfer <\/p>\n
     of   the   said   proceedings   from   the   Court   of   the <\/p>\n
     Civil   Judge,   Senior   Division,   Akola   to   the   Court <\/p>\n
     of the Civil Judge, Senior Division, Aurangabad.\n<\/p>\n
     4.         Learned   Counsel   appearing   for   the <\/p>\n
     applicant submits that, the applicant is residing <\/p>\n
     at Aurangabad and the respondent is also residing <\/p>\n
     at   Aurangabad   and   therefore,   it   would   be <\/p>\n
     appropriate   and   in   the   interest   of   justice,   to <\/p>\n
     transfer the proceedings of H.M.P. No.232 of 2010 <\/p>\n
     from   the   Court   of   the   Civil   Judge,   Senior <\/p>\n
     Division,  Akola  to  the Court  of the  Civil  Judge, <\/p>\n
     Senior   Division,   Aurangabad.   It   is   further <\/p>\n
     submitted   that,   the   applicant   has   filed <\/p>\n
     Application   No.   814   of   2011   in   the   Court   of   the <\/p>\n
     Judicial Magistrate, First Class, Aurangabad under <\/p>\n
     Sections   18,   19,   20   and   22   of   the   Domestic <\/p>\n
     Violence   Act   and   notices   are   issued   in   the   said <\/p>\n
     proceedings.   Learned   Counsel   further   submitted <\/p>\n

     that,   the   applicant   is   not   having   any   separate <\/p>\n
     income   or   the   respondent   is   not   providing   any <\/p>\n
     amount   to fulfill  day  today  needs  of the  present <\/p>\n
     applicant   and   the   applicant   and   respondent   are <\/p>\n
     residing  in one  and the  same  house  at Aurangabad <\/p>\n
     only,  and  therefore,  it would  be  just and  proper <\/p>\n
     in   the   interest   of   justice,   to   transfer   the <\/p>\n
     proceedings   from   the   Court   of   the   Civil   Judge, <\/p>\n
     Senior   Division,   Akola  to the Court  of  the Civil <\/p>\n
     Judge, Senior Division, Aurangabad.\n<\/p>\n
     .         Learned   Counsel   appearing   for   the <\/p>\n
     applicant   further   submits   that,   Akola   is   near <\/p>\n
     about   300   kms.   away   from   Aurangabad.     Learned <\/p>\n
     Counsel   further   invited   my   attention   to   the <\/p>\n
     grounds   taken   in   the   application   and   submitted <\/p>\n
     that,   in   a   proceeding   filed   by   the   husband, <\/p>\n
     convenience   of   the   wife   should   be   looked   into.\n<\/p>\n
     Learned   Counsel   in   support   of   his   aforesaid <\/p>\n
     contention placed reliance on the judgment of this <\/p>\n
     Court in the case of Savita w\/o Vijay Mahajan vs. <\/p>\n
     Vijay s\/o Bajirao Mahajan  reported in 2008 B.C.I.\n<\/p>\n

     210  and  unreported  judgment   of this  Court  in the <\/p>\n
     case   of  Yogita   @   Swati   Anil   Somwanshi   vs   Anil <\/p>\n
     Rameshswar   Somwanshi   in   Miscellaneous   Civil <\/p>\n
     Application   No.35   of   2010   dated   20-06-2011 <\/p>\n
     (Coram:   S.S.Shinde,   J.).   Therefore,   it   is   prayed <\/p>\n
     that, this application may be allowed.\n<\/p>\n
     5.        On   the   other   hand,   learned   Counsel <\/p>\n
     appearing   for   the   respondent   vehemently   opposed <\/p>\n
     the application and submitted that, this Court may <\/p>\n
     not   interfere   in   the   impugned   order.   Learned <\/p>\n
     Counsel also invited my attention to the averments <\/p>\n
     in   the   affidavit   in   reply   and   submitted   that, <\/p>\n
     divorce   petition   before   the   Civil   Judge,   Senior <\/p>\n
     Division,   Akola   is   in   civil   nature   ands   the <\/p>\n
     application filed by the application filed by the <\/p>\n
     applicant is in criminal nature and therefore, the <\/p>\n
     application filed by the application for transfer <\/p>\n
     may not be entertained.\n<\/p>\n
     6.        I   have   given   due   consideration   to   the <\/p>\n
     rival submissions.  It is not in dispute that, the <\/p>\n

     applicant and also the respondent are residing at <\/p>\n
     Aurangabad.   It is true that, the applicant being <\/p>\n
     a lady and having no source of income, will not be <\/p>\n
     able  to travel   300 kms.  from  Aurangabad  to Akola <\/p>\n
     on   every   date   of   hearing.     The   Hon’ble   Supreme <\/p>\n
     Court held held that, in a proceeding filed by the <\/p>\n
     husband,   convenience   of   the   wife   in   such <\/p>\n
     proceeding should be looked into.\n<\/p>\n
     7.<\/p>\n
                Therefore,   in   the   light   of   discussion <\/p>\n
     hereinabove,   the   application   is   allowed   in   terms <\/p>\n
     of prayer clause (A).   The Record and Proceedings <\/p>\n
     of  Hindu  Marriage  Petition  No.  232 of 2010  filed <\/p>\n
     by  the respondent  herein   before  the Court  of  the <\/p>\n
     Civil Judge, Senior Division, Akola under Section <\/p>\n
     13  of the Hindu  Marriage  Act  against  the  present <\/p>\n
     applicant   stands   transferred   to   the   Court   of   the <\/p>\n
     Civil   Judge,   Senior   Division,   Aurangabad.     The <\/p>\n
     concerned   Court   to   take   appropriate   steps   to <\/p>\n
     transfer the said proceedings within one week from <\/p>\n
     the   receipt   of   the   copy   of   the   order   of   this <\/p>\n
     Court.\n<\/p>\n
