Justice ANTONY DOMINIC\n\n Dated :10\/01\/2011\n\n O R D E R\n                       ANTONY DOMINIC, J.\n                    ================\n                    W.P.(C) NO. 612 OF 2011\n                =====================\n\n           Dated this the 10th day of January, 2011\n\n                         J U D G M E N T\n<\/pre>\n<p>      In the Parappanangadi Sub District Level Kalolsavam,<\/p>\n<p>petitioner&#8217;s team participated in Drama Competition. They were<\/p>\n<p>awarded 3rd prize. Petitioner filed an appeal complaining that the<\/p>\n<p>venue was changed at the last minute and that the sound system<\/p>\n<p>was not proper. It was also complained that there was power<\/p>\n<p>failure affecting their performance. Despite the contentions, his<\/p>\n<p>appeal was rejected without considering any of the grounds as<\/p>\n<p>per Ext.P2 order. It is challenging Ext.P2 and seeking a direction<\/p>\n<p>to permit the petitioner&#8217;s team to participate in the Revenue<\/p>\n<p>District Competition, the writ petition is filed.<\/p>\n<p>      2.   Learned Government Pleader has obtained instructions<\/p>\n<p>in the matter. According to the learned Government Pleader, the<\/p>\n<p>first and second prize winners had secured 251 and 225 marks<\/p>\n<p>respectively, whereas the petitioner&#8217;s team had secured only 198<\/p>\n<p>marks.     As far as the allegation regarding power failure is<\/p>\n<p>concerned, learned Government Pleader submits that a report<\/p>\n<p>was obtained from the Stage Manager, who has denied the said<\/p>\n<p>WPC No. 612\/11<br \/>\n<span class=\"hidden_text\">                                   :2 :<\/span><\/p>\n<p>allegation. In so far as the change of venue is concerned, learned<\/p>\n<p>Government Pleader submits that due to the circumstances<\/p>\n<p>prevailing, such a stage was necessitated and that among the five<\/p>\n<p>contestants, nobody other than the petitioner had raised any<\/p>\n<p>complaint in that behalf.\n<\/p>\n<p>      3.   First of all, there is vide disparity in the marks obtained<\/p>\n<p>by the petitioner&#8217;s team as compared to first and second prize<\/p>\n<p>winners. Secondly, first and second prize winners who will be<\/p>\n<p>prejudiced by any order obtained by the petitioner have not been<\/p>\n<p>impleaded in this writ petition. Thirdly, the allegation of power<\/p>\n<p>failure put forward by the petitioner has been denied by the<\/p>\n<p>respondents and there is nothing to reject the said version.
