Justice V.GIRI\n\n Dated :03\/12\/2008\n\n O R D E R\n                        V.GIRI, J\n                      -------------------\n                   W.P.(C).35693\/2008\n                      --------------------\n      Dated this the 3rd day of December, 2008\n\n                      JUDGMENT\n<\/pre>\n<p>      Petitioner is the Convener of Head load Workers<\/p>\n<p>Union (BMS) of Panniyottukonam Unit and submits<\/p>\n<p>that members of the Union were earlier members of<\/p>\n<p>respondents 4 and 5 and this resulted in an agreement<\/p>\n<p>between the Unions.          One Subhash Chandrabose<\/p>\n<p>started to cut and remove rubber trees standing in his<\/p>\n<p>estate and when he was obstructed,                   he had<\/p>\n<p>approached this Court for police protection and this led<\/p>\n<p>to Ext.P1 judgment.        Petitioner contends that the<\/p>\n<p>owner of the property is willing to engage members of<\/p>\n<p>the petitioner Union as well. But this is being objected<\/p>\n<p>to by respondents 4 and 5.             Petitioner also alleges<\/p>\n<p>that respondents 4 and 5 are trying to employ<\/p>\n<p>unregistered workers to defeat the workers of the<\/p>\n<p>petitioner. This has been prevented by the petitioner.<\/p>\n<p>In these circumstances,        petitioner     approached the<\/p>\n<p>first  respondent     with          Ext.P2    representation,<\/p>\n<p>challenging the action taken by respondents 4 and 5.<\/p>\n<p>W.P.(C).35693\/2008<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>2.   Having heard learned Government Pleader also,<\/p>\n<p>writ petition is disposed of directing the first respondent<\/p>\n<p>to look into Ext.P2 and see that only registered workers<\/p>\n<p>are employed irrespective of the Union to which they<\/p>\n<p>belong.
