Justice V.GIRI\n\n Dated :22\/07\/2009\n\n O R D E R\n                         V.GIRI, J\n                      .......................\n                   W.P.(C).17835\/2009\n                      .......................\n           Dated this the 22nd day of July, 2009\n\n                       JUDGMENT\n<\/pre>\n<p>     A mini lorry belonging to the petitioner bearing<\/p>\n<p>registration No.KL-10-Z\/9739, was seized when it was<\/p>\n<p>allegedly transporting river sand without valid pass. This<\/p>\n<p>is evidenced by Ext.P2 seizure mahazar.              Ultimately<\/p>\n<p>Ext.P3 order of confiscation has been passed by the<\/p>\n<p>District Collector, after      finding that the vehicle was<\/p>\n<p>involved in an illicit transportation of river sand but<\/p>\n<p>permitting   the   petitioner       to     pay an   amount    of<\/p>\n<p>Rs.1,25,000\/- for redeeming the vehicle. This is under<\/p>\n<p>challenge in this writ petition.           As per the directions<\/p>\n<p>issued by this Court, files have been produced by the<\/p>\n<p>learned Government Pleader.\n<\/p>\n<\/p>\n<p>2.   I have perused the files as well. That the vehicle<\/p>\n<p>was found involved in an illicit transportation of river<\/p>\n<p>sand without valid pass is not a matter which is seriously<\/p>\n<p>disputed.   In fact I do not find any written objection<\/p>\n<p>submitted by the petitioner before the District Collector.<\/p>\n<p>In the circumstances, the finding that the vehicle was<\/p>\n<p>W.P.(C).17835\/09<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>involved in illicit transportation of river sand is only to<\/p>\n<p>be confirmed and I do so.\n<\/p>\n<\/p>\n<p>3.   Learned counsel for the petitioner submits that<\/p>\n<p>the driver of the vehicle had misused the same without<\/p>\n<p>the consent of the petitioner. Even the said objection<\/p>\n<p>was not raised before the District Collector.     Learned<\/p>\n<p>counsel for the petitioner further submits that at any<\/p>\n<p>rate value of the vehicle has been fixed on the higher<\/p>\n<p>side. Vehicle in question is a 2006 model mini lorry and<\/p>\n<p>going by the market value it cannot be considered as<\/p>\n<p>having been fixed on the higher side. I do not find any<\/p>\n<p>grounds to interfere with Ext.P3.
