Mr.Shelat appears for respondent<br \/>\n\tno.8 and waives notice of Rule.  The presence of other parties to<br \/>\n\tthe proceedings may not be required at this stage.\n<\/p>\n<p>The<br \/>\n\tpresent application is for interim injunction against execution and<br \/>\n\timplementation of the judgement and award of the Tribunal which is<br \/>\n\timpugned in the First Appeal.\n<\/p>\n<p>Considering<br \/>\n\tthe facts and circumstances, there shall be interim injunction<br \/>\n\tagainst execution and implementation of the judgment and the award<br \/>\n\tpassed by the Tribunal on the condition that the applicant deposits<br \/>\n\tthe entire awarded amount together with costs and interest to the<br \/>\n\textent of the liability of the applicant found by the Tribunal<br \/>\n\twithin a period of four weeks from today.\n<\/p>\n<p>We<br \/>\n\thave heard the learned counsel appearing for both the sides on the<br \/>\n\taspects of withdrawal.\n<\/p>\n<p>Considering<br \/>\n\tthe facts and circumstances, out of the amount which may be<br \/>\n\tdeposited, the original claimants shall be permitted to withdraw 20%<br \/>\n\tof the amount with the clarification that all claimants shall<br \/>\n\tproportionately share the withdrawal and if any of the claimant is<br \/>\n\tminor on the date of the withdrawal, the share of minor shall be<br \/>\n\tinvested initially for a period of three years and upon attaining<br \/>\n\tmajority, the said minor shall be at the liberty to encash the FDR<br \/>\n\twithout their being any specific order of this Court.  The remaining<br \/>\n\t80% of the amount shall be invested by the Tribunal with the<br \/>\n\tNationalised Bank initially for a period of three years and such<br \/>\n\tinvestment shall be renewed from time to time until the appeal is<br \/>\n\tfinally disposed. The original Fixed Deposit Receipt shall be<br \/>\n\tretained with the Nazir Department of the Tribunal.\n<\/p>\n<p>Application<br \/>\n\tallowed to the aforesaid extent.
