1.\t\tThis
\napplication has been preferred for regular bail under Section 439 of
\nthe Code of Criminal Procedure,1973, in connection with the offence
\nregistered with Ellisbridge Police Station, Ahmedabad bearing
\nC.R.No.I- 454 of 2006 for the offence punishable under Sections 302,
\n143, 147, 148, 149, 120(B) and 34 of the Indian Penal Code read with
\nSection 135(1) of Bombay Police Act.\n<\/p>\n
2.\t\tHaving
\nheard the learned counsel for both the sides and looking to the facts
\nand circumstances of the case and evidence on record, it appears that
\n:\n<\/p>\n
(i)\t\tThe
\npresent bail application is successive bail application. After
\nreceiving the papers of charge-sheet, previous bail application being
\nCriminal Misc.Application No.2479 of 2008 was preferred by the
\napplicant, which was disposed of as withdrawn. Order dated 23rd
\nApril,2008 passed by this Court in earlier bail application, reads as
\nunder:\n<\/p>\n
?SORAL ORDER<\/p>\n
1.\tLearned
\ncounsel for the applicant seeks permission to withdraw this
\napplication, after hearing the arguments canvassed by the learned
\nAdditional Public Prosecutor, with the help of investigating papers.\n<\/p>\n
2.\tPermission as prayed
\nfor, is granted. This application is disposed of as withdrawn. Notice
\nis discharged.??\n<\/p>\n
(ii)\t\tThere is no change in
\ncircumstance, after the aforesaid order is passed except passage of
\ntime\/ afflux of time.\n<\/p>\n
(iii)\tLearned counsel for
\nthe applicant has argued in detail and read over the statements of
\nthe witnesses. Learned Additional Public Prosecutor has also relied
\nupon several statements recorded during the course of investigation.
\nLooking to the statement of prosecution witness namely  Hansaba
\nChandrasinh Jadeja, who is a wife of the present applicant, has
\nstated that on 15th June,2006, the applicant was away from
\nhis house. 15th June,2006 is the day on which murder has
\ntaken place in the vicinity of Ellisbridge Gymkhana club.\n<\/p>\n
(iv)\t\tLooking to the
\nstatement of prosecution witness  Shaktidan Badridan, there is
\ninvolvement of the present applicant in the offence as alleged by the
\nprosecution. Looking to the evidence on record, it appears that the
\napplicant was in the city of Ahmedabad on 15th June,2006,
\nand, his presence nearby scene of offence, i.e. Ellisbridge Gymkhana
\nis coming on record on the basis of mobile phone tracing. Thus, the
\napplicant was present nearby Ellisbridge Gymkhana on 15th
\nJune,2006.\n<\/p>\n
(v)\t\tLooking to the
\nstatement of Prosecution witness  Aniruddhsinh Jadeja, who is
\ndriver of Tata Sumo Jeep Car, stated that the applicant was sitting
\non Jeep Car on 15th June,2006 and the applicant was came
\nfrom Rajkot to Ahmedabad.\n<\/p>\n
\t\tThese three witnesses are
\nconnecting the applicant with the offence, more particularly, on 15th
\nJune,2006, at Ahmedabad and on nearby Ellisbridge Gymkhana, where
\nmurder took place.\n<\/p>\n
(vi)\t\tAs per papers of
\ninvestigation, there is charge of conspiracy against the applicant.
\nEvery act of co-conspirator is enhancement and furtherance of
\nconspiracy. Looking of the statement of Devendra, who is Manager and
\nis serving in Roshni Guest House in the city of Ahmedabad, there is a
\nprima facie case against the applicant. The present applicant has
\nstayed in Roshni Guest House in the false name of Raju Dave. Thus,
\nthe applicant was present in the city of Ahmedabad and he has signed
\nthe register of Roshni Guest House in the name of  Raju Dave.
\nInitially, conspiracy was hatched to commit murder of deceased
\nPankajbhai Trivedi at Roshni Guest House, as per the prosecution.\n<\/p>\n
(vii)\t Looking to the
\nhandwriting expert opinion
\ndated 18th August,2006, Register of Roshni Guest
\nHouse, in which, signature in the name of Raju Dave, is handwriting
\nof the applicant. Thus, there is a prima facie case against the
\npresent applicant. As this is bail application stage, this Court is
\nnot much analyzing statements of several other witnesses, which are
\ncollected during the course of investigation.\n<\/p>\n
(viii)\tLearned counsel for
\nthe applicant submitted that similarly situated another co-accused
\nnamely Chandrakant Meghjibhai Daki and Daxesh Hasmukhlal Shah have
\nbeen enlarged on bail and the role played by the present applicant is
\nsimilar than the role alleged against these two co-accused and,
\ntherefore, on the ground of parity, the applicant deserves to be
\nenlarged on bail. This contention is not accepted by this Court for
\nthe reason that :\n<\/p>\n
\t(a)\tThe applicant was
\npresent nearby scene of offence i.e. Ellisbridge Gymkhana, as per
\nevidence collected during the course of investigation.\n<\/p>\n
\t(b)\tLooking to the
\nstatement of Hansaba Jadeja and Shaktidan Badridan on the date of
\nwhich, the murder of deceased was taken place, the applicant was
\npresent in the city of Ahmedabad.\n<\/p>\n
\t(c)\tLooking to the
\nstatement of Aniruddhsinh Jadeja read with Register of Roshni Guest
\nHouse, the applicant has travelled from Rajkot to Ahmedabad from 10th
\nJune,2006 to 13th June,2006 and stayed in the name of Raju
\nDave at Roshni Guest House. There is also allegation of conspiracy
\nagainst the present applicant and on 15th June,2006, the
\napplicant has came from Rajkot to Ahmedabad, as per statement of
\nAniruddhsinh Jadeja in Tata Sumo Jeep Car. Handwriting expert report
\nis also against the present applicant.\n<\/p>\n
\t(d)\t\tThere is also
\nstatements of witnesses namely Devendra Jibodhchandra and Jairajsinh
\nJadeja, etc. For these reasons, the case of the present applicant is
\ndifferent from the other co-accused namely Chandrakant Daki and
\nDaxesh Shah, who are enlarged on bail.\n<\/p>\n
3.\t\tAs
\na cumulative effect of the aforesaid facts and reasons and looking to
\nthe facts and circumstances of the case, statements of the witnesses,
\ngravity of the offence, quantum of punishment, the manner in which
\nthe applicant is involved in the offence and as this is successive
\nbail application and there is no change of circumstance, after
\nwithdrawal of the previous bail application, I am not inclined to
\nenlarge the applicant on bail. Learned counsel for the applicant has
\nargued out at length on the basis of several evidences on record but
\nas this is a bail application stage, this Court is not much
\nevaluating and analyzing the statement of the witnesses in detail.
\nSuffice it to say that the present applicant is prima facie, involved
\nin commissioning of the offences as alleged by the prosecution and if
\nhe is enlarged on bail, there are all chances that he may tamper with
\nthe evidence and may not be available to the court, at the time of
\ntrial.\n<\/p>\n
4.\t\tIn
\nview of the aforesaid facts and circumstances of the case, there is
\nno substance in this application and, therefore, the same is hereby
\ndismissed. Notice is discharged.\n<\/p>\n
