Justice K.HEMA\n\n Dated :27\/01\/2009\n\n O R D E R\n                            K.HEMA, J.\n\n                -----------------------------------------\n                        B.A.No. 387 of 2009\n                -----------------------------------------\n\n              Dated this the 27th January, 2009\n\n                             O R D E R\n<\/pre>\n<p>      This petition is for bail.\n<\/p>\n<p>      2. The alleged offences are under Sections 406, 409 and<\/p>\n<p>420 read with 34 of the Indian Penal Code. According to<\/p>\n<p>prosecution, petitioner is second accused, who along with<\/p>\n<p>first accused and in furtherance of common intention with<\/p>\n<p>other accused, induced several persons to deposit huge<\/p>\n<p>amount in the establishment run by first accused with<\/p>\n<p>fraudulent intentions and the amounts were not returned and<\/p>\n<p>the interest was also not given and thereby they cheated de<\/p>\n<p>facto complainant and others.\n<\/p>\n<p>      3. Petitioner&#8217;s arrest was recorded on 4.11.2008. Learned<\/p>\n<p>Public Prosecutor submitted that charge sheet has not been<\/p>\n<p>filed and hence, petitioner is entitled for bail by default, but<\/p>\n<p>suitable conditions may be imposed.<\/p>\n<p>      4. On hearing both sides, I am satisfied that bail can be<\/p>\n<p>granted to petitioner.\n<\/p>\n<p><span class=\"hidden_text\">   BA.387\/09                      2<\/span><\/p>\n<p>    Hence, bail is granted to petitioner on the following<\/p>\n<p>terms and conditions:\n<\/p>\n<blockquote><p>     i)   Petitioner shall execute a bond for Rs.1,00,000\/-<\/p>\n<\/blockquote>\n<blockquote><p>            with two solvent sureties each for the like sum<\/p>\n<p>            to the satisfaction of the    Magistrate Court<\/p>\n<p>            concerned.\n<\/p><\/blockquote>\n<blockquote><p>     ii)    Petitioner shall report before the investigating<\/p>\n<p>            officer as and when required.\n<\/p><\/blockquote>\n<blockquote><p>     iii).
