1.\tThis
\nis an application preferred under Section 439 of the Code of Criminal
\nProcedure, 1973 by the applicants for regular bail, who came to be
\narrested, in connection with F.I.R. registered as  C.R. No. I-491 of
\n2009 with Sector-7 Police Station, Gandhinagar for the offence
\npunishable under Sections 143, 147, 148, 149, 332, 333, 307, 337,
\n338, 120 (B), 186 and 188 of the Indian Penal Code, Section 135 of
\nBombay Police Act and Section 3 & 7 of Public Property Damage
\nAct.\n<\/p>\n
2.\tLearned
\nadvocate for the applicants submitted that the applicants are not
\nprima-facie involved in the alleged commission of offence and false
\ncase is foisted on them.    Learned advocate placing reliance on the
\nF.I.R. submitted that considering the role attributed to the
\napplicants no overt act can be said to have been committed by them
\nand, therefore, the applicants deserve to be enlarged on bail.
\nLearned advocate has placed reliance on the two orders dated
\n24.12.2009  passed by this Court in Criminal Misc. Application No.
\n14006 of 2009 and the order dated 24.12.2009 in Criminal Misc.
\nApplication No. 14004 of 2009 and  submitted that considering the
\nrole attributed to the applicants since at the most they are facing
\nthe charge under Section 307 of the Indian Penal Code, they deserve
\nto be enlarged on bail.\n<\/p>\n
3.\tLearned
\nA.P.P. Ms. Manisha L. Shah, representing the State, while opposing
\nthe bail application, submitted that the applicants are involved in a
\nserious offence punishable under Sections 143, 147, 148, 149, 332,
\n333, 307, 337, 338, 120 (B), 186 and 188 of the Indian Penal Code,
\nSection 135 of Bombay Police Act and Section 3 & 7 of Public
\nProperty Damage Act. The applicants were present in the mob and each
\nof them committed assault on the police officer and the same is
\nreflected in the F.I.R. at Annexure-A to the application and in the
\npolice papers. Considering the fact that the police officer sustain
\ninjuries in the assault wherein the applicants are involved, the
\napplicants cannot claim  parity with the other co-accused, who were
\nalready released by this Court by order dated 24.12.2009. Thus the
\nlearned A.P.P. submitted that no discretionary relief be granted to
\nthe applicants and the application is deserve to be dismissed.\n<\/p>\n
4.\tI
\nhave heard learned advocate Mr. S.K. Patel appearing for the
\napplicant and learned A.P.P. Ms. Manisha L. Shah  appearing for the
\nState at length and in great detail. I have considered the averments
\nmade in the application,  role attributed to the applicants which is
\nreflected in F.I.R. at Annexure-A to the application. The applicants
\nwere armed with the weapons and they committed assault on the police
\nofficer who sustain the injuries. After sustaining injuries, the
\nofficer was admitted in the hospital and subsequently he has been
\ndischarged. Considering the aforesaid aspect and the role attributed
\nto each of the applicants, I am of the view that the applicants
\ndeserve to be enlarged on bail. However, stringent terms and
\nconditions are required to be imposed  while releasing them on bail.\n<\/p>\n
5.\tIn
\nthe facts and circumstances of the case, the application is allowed
\nand the applicants are ordered to be enlarged on bail in connection
\nwith C.R. No. I-491  of 2009 registered at Sector-7 Police Station,
\nGandhinagar on executing a bond of Rs. 30,000\/- (Rupees thirty
\nthousand only) each with two sureties each of the like amount to the
\nsatisfaction of the Trial Court and subject to the conditions that
\nthey shall:\n<\/p>\n
(a)\tnot
\ntake undue advantage of their liberty or abuse \ttheir\tliberty;\n<\/p>\n
(b)\tnot
\nact in a manner injurious to the interest of the \tprosecution;\n<\/p>\n
(c)\tsurrender
\ntheir passport, if any, to the lower court \twithin a week.\n<\/p>\n
(d)\tnot
\nleave the State of Gujarat without the prior \tpermission of the
\nSessions Court concerned;\n<\/p>\n
(e)\tmark
\ntheir presence at the concerned Police Station on \tany day of every
\nfirst week of English calendar month \tbetween 9.00 AM and 2.00 PM.
\ntill the trial is over;\n<\/p>\n
(f)\tfurnish
\nthe present address of their residence to the \tI.O. \tand also to the
\nCourt at the time of execution of \tthe \tbond and shall not change
\ntheir residence without \tprior permission of this Court;\n<\/p>\n
(g)\tmaintain
\nlaw and order.\n<\/p>\n
6.\tIf
\nbreach of any of the above conditions is committed, the Sessions
\nJudge concerned will be free to issue warrant or to take appropriate
\naction in the matter.\n<\/p>\n
7.\tBail
\nbond to be executed before the lower Court having jurisdiction to try
\nthe case.\n<\/p>\n
8.\tAt
\nthe trial, the Trial Court shall not be influenced by the
\nobservations of preliminary nature, qua the evidence at this stage,
\nmade by this Court while enlarging the applicants on bail.\n<\/p>\n
9.\tRule
\nis made absolute to the aforesaid extent.\n<\/p>\n
\tDirect
\nService is permitted.\n<\/p>\n
