    Revision petitioner is the accused and first<\/p>\n
respondent the complainant in S.T.No.59\/2003 on the<\/p>\n
file of Chief Judicial Magistrate, Pathanamthitta.<\/p>\n
Revision petitioner was convicted and sentenced to<\/p>\n
a fine of Rs.2,15,000\/- and in default simple<\/p>\n
imprisonment for six months with a direction to pay<\/p>\n
Rs.2,00,000\/-  out   of   the  fine   realised   as<\/p>\n
compensation  to   first   respondent.     Revision<\/p>\n
petitioner   challenged   the   conviction   before<\/p>\n
Sessions Court, Pathanamthitta in Crl.A.295\/2004.<\/p>\n
Learned  Sessions   Judge   on  reappreciation   of<\/p>\n
evidence confirmed the conviction and sentence and<\/p>\n
dismissed the appeal.    It is challenged in the<\/p>\n
revision.\n<\/p>\n
    2.  Learned counsel appearing for the revision<\/p>\n
petitioner and first respondent were heard.<\/p>\n
    3.   Learned counsel appearing for revision<\/p>\n
CRRP 1661\/2006              2<\/span><\/p>\n
petitioner submitted that in view of the evidence<\/p>\n
on record he is not challenging the conviction but<\/p>\n
the sentence may be modified.\n<\/p>\n
     4.      On going through the judgments of the<\/p>\n
courts below, I find no reason to interfere with<\/p>\n
the conviction.\n<\/p>\n
     5.    Evidence establish that  towards discharge<\/p>\n
of liability of Rs.2,00,000\/- revision petitioner<\/p>\n
issued Ext.P2 cheque which was dishonoured for want<\/p>\n
of sufficient funds when presented for encashment.<\/p>\n
Evidence also establish that first respondent had<\/p>\n
complied      with  all  the   statutory   formalities<\/p>\n
provided under section 138 and 142 of Negotiable<\/p>\n
Instruments Act.     In such circumstance, conviction<\/p>\n
of the revision petitioner for the offence under<\/p>\n
section     138  of  Negotiable  Instruments  Act   is<\/p>\n
perfectly legal.\n<\/p>\n
     6.    Learned Chief Judicial Magistrate sentenced<\/p>\n
the   revision    petitioner  only  to  fine  with   a<\/p>\n
direction     to  pay  the   amount  covered  by   the<\/p>\n
dishonoured cheque on realisation as compensation.<\/p>\n
In   addition     to  the   amount  covered   by   the<\/p>\n
dishonoured cheque revision petitioner was directed<\/p>\n
CRRP 1661\/2006              3<\/span><\/p>\n
to pay an additional amount of Rs.15,000\/- as fine.<\/p>\n
Considering all the relevant aspects, interest of<\/p>\n
justice will be met, if the sentence is reduced to<\/p>\n
Rs.2,05,000\/- and in default simple imprisonment<\/p>\n
for three months.\n<\/p>\n
     Revision is allowed in part.    Conviction of the<\/p>\n
revision petitioner     for the offence under section<\/p>\n
138 of Negotiable Instruments Act is confirmed.<\/p>\n
Sentence     is  modified.    Revision  petitioner  is<\/p>\n
sentenced to a fine of Rs.2,05,000\/- and in default<\/p>\n
simple      imprisonment   for   three   months.    On<\/p>\n
realisation of fine, Rs.2,00,000\/- to be paid to<\/p>\n
first respondent as compensation under section 357<\/p>\n
(1) (b) of Code of Criminal Procedure.<\/p>\n
     Though    learned  counsel   appearing  for   the<\/p>\n
revision     petitioner  sought    time  for  payment,<\/p>\n
revision was filed in 2006 and he had already<\/p>\n
availed of three years.        In such circumstance,<\/p>\n
revision petitioner is granted two months time to<\/p>\n
pay   the    fine.    Revision  petitioner  need  only<\/p>\n
deposit the balance amount deducting the amount if<\/p>\n
any deposited in the case earlier,     as directed by<\/p>\n
the    appellate   court   or  this   court.     First<\/p>\n
CRRP 1661\/2006          4<\/span><\/p>\n
respondent is entitled to withdraw the amount, if<\/p>\n
any in deposit.\n<\/p>\n<\/p>\n
