No.19927 of 2010\n                     GAURI SHANKAR YADAV .\n                             Versus\n                        STATE OF BIHAR .\n                          -----------\n<\/pre>\n<p>2   15.06.2010             Heard  learned  counsel  appearing                 on<\/p>\n<p>                behalf   of    the     petitioner    and    learned      counsel<\/p>\n<p>                appearing on behalf of the State.\n<\/p>\n<pre>                             The     petitioner      is    in       custody    in\n\n                connection     with     Siswan    (Chainpur      O.P.)    Police\n\n<\/pre>\n<p>                Station Case No. 74\/2009 for offences punishable<\/p>\n<p>                under Section 395 of the Indian Penal Code and<\/p>\n<p>                3\/4 of Explosive Substance Act.\n<\/p>\n<p>                             The petitioner along with 15 others have<\/p>\n<p>                been charged with committing the dacoity in the<\/p>\n<p>                house of the informant and having fled away with<\/p>\n<p>                valuables.\n<\/p>\n<p>                             Learned     counsel     for      the     petitioner<\/p>\n<p>                submits that he has not been named in the F.I.R.<\/p>\n<p>                nor there has been any recovery from his personal<\/p>\n<p>                possession     or    from   his   house    as    regarding    the<\/p>\n<p>                items of dacoity.           Learned counsel submits that<\/p>\n<p>                he has also not been put on T.I. Parade.                  It is<\/p>\n<p>                further submitted that the name of the petitioner<\/p>\n<p>                has   transpired       by   reason   of    the      confessional<\/p>\n<p>                statement made by one Jabbar Nat who has been<\/p>\n<p>                granted bail by this Court in Cr.Misc. No. 3404<\/p>\n<p>                of    2010     passed       on    17.2.2010      (Annexure-2).<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>Relying upon another order passed in the case of<\/p>\n<p>Dharmu Yadav in Cr.Misc. No. 11208 of 2010 dated<\/p>\n<p>13.4.2010, learned counsel submits that the case<\/p>\n<p>of   the    petitioner            is     on        same     and       similar<\/p>\n<p>footing.\n<\/p>\n<p>            Having           regard           to    the        submissions<\/p>\n<p>aforesaid,        let       the     petitioner         namely,           Gauri<\/p>\n<p>Shankar Yadav be released on bail on furnishing<\/p>\n<p>bail bonds of Rs. 10,000\/- with two sureties of<\/p>\n<p>the like amount to the satisfaction of learned<\/p>\n<p>Chief   Judicial           Magistrate,         Siwan      in    connection<\/p>\n<p>with Siswan (Chainpur O.P) P.S. Case No. 74\/09)<\/p>\n<p>subject to the following condition:-<\/p>\n<p>            (i) that one of the bailors will be a<\/p>\n<p>close relative of the petitioner, who will give<\/p>\n<p>an affidavit giving genealogy as to how he is<\/p>\n<p>related    with       the    petitioner.             The       bailor     will<\/p>\n<p>undertake        to    furnish         information        to    the      court<\/p>\n<p>about      any        change       in     the       address         of     the<\/p>\n<p>petitioner, (ii) that the bailor shall also state<\/p>\n<p>on   affidavit            that    he     will      inform       the      Court<\/p>\n<p>concerned if the petitioner is implicated in any<\/p>\n<p>other case of similar nature after his release in<\/p>\n<p>the present case and thereafter the Court below<\/p>\n<p>will be at liberty to initiate the proceeding for<\/p>\n<p>cancellation          of    bail   on     the      ground      of     misuse,<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>          (iii)    that          the       petitioner         will      give       an<\/p>\n<p>          undertaking        that         he   will    receive        the    police<\/p>\n<p>          papers on the given date and be present on date<\/p>\n<p>          fixed for charge and if he fails to do so on two<\/p>\n<p>          given dates and delays the trial in any manner,<\/p>\n<p>          his   bail     will        be    liable     to     be    cancelled       for<\/p>\n<p>          reasons of misuse, (iv) that the petitioner will<\/p>\n<p>          be well represented on each date and if he fails<\/p>\n<p>          to do so on two consecutive dates, his bail will<\/p>\n<p>          be liable to be cancelled.\n<\/p>\n<p>                       In    view         of   the     antecedents          of     the<\/p>\n<p>          petitioner, the petitioner is directed to appear<\/p>\n<p>          before    the      Superintendent             of        Police,    Siwan,<\/p>\n<p>          within fifteen days of his release with a copy of<\/p>\n<p>          this order and every two weeks thereafter for the<\/p>\n<p>          next nine months.               The conduct of the petitioner<\/p>\n<p>          will be kept under watch in this period by the<\/p>\n<p>          Superintendent of Police concerned and if it is<\/p>\n<p>          found wanting in any respect, a report shall be<\/p>\n<p>          made to the court concerned by him to initiate a<\/p>\n<p>          proceeding for cancellation of bail for reasons<\/p>\n<p>          of    misuse      of       bail.
