GOVERNMENT PLEADER for Respondent(s) : 1, \nNone for\nRespondent(s) : 2 - 3. \n==========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMS.JUSTICE H.N.DEVANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/06\/2009 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>By<br \/>\n\tthis petition, which has been filed at the pre-execution stage, the<br \/>\n\tpetitioner has challenged the validity of the order of preventive<br \/>\n\tdetention passed by the respondent No.2   District Magistrate,<br \/>\n\tRajkot in exercise of powers under sub-section (2) of Section 3 of<br \/>\n\tthe Gujarat Preventive of Anti Social Activities Act, 1985 (the Act)<br \/>\n\tagainst the petitioner.\n<\/p>\n<p>According<br \/>\n\tto the petitioner, the said order has been passed by the respondent<br \/>\n\tNo.2 upon recording subjective satisfaction based on a single<br \/>\n\toffence stated to have been registered against the petitioner as<br \/>\n\tprohibition C.R. No.5384\/2008 with Dhoraji Police Station for the<br \/>\n\toffences punishable under Sections 66(1)b, 65-A, E, 116-B and 81 of<br \/>\n\tthe Bombay Prohibition Act, 1949.  The petitioner has challenged the<br \/>\n\tsaid order of detention passed by the detaining authority mainly on<br \/>\n\tthe ground that in respect of three other co-accused, namely,<br \/>\n\tHasinaben, wife of the petitioner, Mustaq Umarbhai Saiyed Fakir and<br \/>\n\tIsmailbhai Kasambhai Sandhi, against whom similar orders of<br \/>\n\tdetention had been passed, have not been confirmed by the Advisory<br \/>\n\tBoard constituted under the Act, by giving an opinion that there are<br \/>\n\tno sufficient reasons to detain the detenue by way of preventive<br \/>\n\tdetention and therefore, all the three detenues were enlarged by the<br \/>\n\tState Government.  It is the case of the petitioner that in view of<br \/>\n\tthe fact that, on identical facts, the Advisory Board has expressed<br \/>\n\tthe opinion that the order of detention was not justified, the<br \/>\n\trespondents should be restrained from executing the order of<br \/>\n\tdetention qua the present petitioner.\n<\/p>\n<p>Strong<br \/>\n\treliance is placed upon the decision of the Apex Court in case of<br \/>\n\t<a href=\"\/doc\/1880398\/\">Alpesh Navinchandra Shah v. State of Maharashtra,<\/a><br \/>\n\treported in (2007) 2 SCC 777 as well as the order dated 7th<br \/>\n\tJanuary 2008 passed by a Division Bench of this Court rendered in<br \/>\n\tLetters Patent Appeal No.2149 of 2007 in case of <a href=\"\/doc\/1950720\/\">State<br \/>\n\tof Gujarat v. Anup Vithalbhai Shah and others<\/a>.\n<\/p>\n<p>\tThe<br \/>\n\tApex Court, in the case of Pawan Bhartiya v. Union of India<br \/>\n\tand another, reported in (2003)11 SCC 479, in a case where<br \/>\n\tidentical order of detention had been passed against the petitioner<br \/>\n\tas well as his brother and the petitioner&#8217;s brother had already been<br \/>\n\treleased on the ground that there was no sufficient cause for<br \/>\n\tdetention of the detenue under Section 3(1) of the COFEPOSA Act, and<br \/>\n\tthe Government had accordingly revoked the detention order issued<br \/>\n\tagainst him after considering the report of the Advisory Board, the<br \/>\n\tCourt held that the petitioner therein who was similarly situated,<br \/>\n\twas entitled to the same treatment.\n<\/p>\n<p>\tThe<br \/>\n\tDivision Bench of this Court in the above cited decision has held<br \/>\n\tthat when the facts were similar in the case of all four persons<br \/>\n\tagainst whom detention orders were passed and since the Advisory<br \/>\n\tBoard had quashed the detention orders passed against two of the<br \/>\n\taccused persons, the same treatment should be given to the<br \/>\n\tpetitioners   appellants.  The Court, therefore, set aside the<br \/>\n\tdetention orders passed against the petitioners   appellants<br \/>\n\ttherein.\n<\/p>\n<p>\tOn<br \/>\n\ta perusal of the First Information Report in question on the basis<br \/>\n\tof which similar detention orders had been passed in case of the<br \/>\n\tthree co-accused, it is apparent that the allegations against all<br \/>\n\tthe co-accused are similar in nature.  Hence, the petitioner herein<br \/>\n\tis similarly situated to all the other co-accused.\n<\/p>\n<p>\tIn<br \/>\n\tthe aforesaid premises, examining the facts of the present case in<br \/>\n\tthe light of the decisions cited hereinabove, this Court is of the<br \/>\n\tview that considering the fact that the petitioner is similarly<br \/>\n\tsituated to the other co-accused, coupled with the fact that the<br \/>\n\tAdvisory Board has held that there were no sufficient reasons for<br \/>\n\tdetaining the other co-accused, the order of detention against the<br \/>\n\tpetitioner herein would also not be sustainable on the same grounds.<br \/>\n\t Ordinarily, this Court would not intervene against the an order of<br \/>\n\tpreventive detention at the pre-execution stage.  But, in the facts<br \/>\n\tand circumstances of the present case, it would not be just and<br \/>\n\tproper to permit the respondents to execute the order of detention<br \/>\n\tagainst the petitioner when similar orders of detention have already<br \/>\n\tbeen revoked by the Advisory Board.\n<\/p>\n<p>\tIn<br \/>\n\tview of the above discussion, the petition succeeds and is,<br \/>\n\taccordingly, allowed.
