While on duty on 8th February 1996 on a<br \/>\nsurprise checking it was found that the respondent has committed<br \/>\ncertain irregularities. Though he had collected fare, he had not<br \/>\nissued tickets. Therefore a charge-sheet was issued and a<br \/>\ndepartmental inquiry was initiated. Ultimately  a punishment  of<br \/>\nputting the respondent from his present salary  to original salary<br \/>\nwas imposed. The respondent therefore filed an appeal where, after<br \/>\nissuing notice to the respondent,  the penalty was increased to<br \/>\nputting the respondent from his present salary  to original salary<br \/>\nfor five years. The second appeal filed by the respondent came to be<br \/>\ndismissed.\n<\/p>\n<p>3.\tAs<br \/>\na result of hearing and perusal of the record I am of the view that<br \/>\nthe Tribunal has erroneously held that the reviewing authority has no<br \/>\npower to enhance the  punishment as the reviewing authority has such<br \/>\npower to do so. However, in so far as the final order of the Tribunal<br \/>\nis concerned, the same is just and proper inasmuch as looking to the<br \/>\ngravity of  the misconduct I am of the view that imposition of<br \/>\npunishment by the original authority is just and proper and there was<br \/>\nno case for enhancement of punishment.\n<\/p>\n<p>4.\tIn<br \/>\nthe premises aforesaid, the finding of the Labour Court that the<br \/>\nreviewing authority has no power to enhance the  punishment and also<br \/>\nthe punishment imposed by the reviewing authority is set aside.<br \/>\nSubject to this observation the award is confirmed and the petition<br \/>\nis dismissed. Rule is discharged with  no order as to costs.
