DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 30\/11\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tHeard learned counsel for the parties.\n<\/p>\n<p>2.\t\tThis<br \/>\npetition is directed against the order of detention dated 21.8.2010<br \/>\npassed by the respondent No.2 in<br \/>\nexercise of powers conferred under Section 3 (2) of the Gujarat<br \/>\nPrevention of Anti Social Activities Act, 1985 (for short &#8220;the<br \/>\nAct&#8221;) by detaining the detenu as a &#8220;bootlegger&#8221; as<br \/>\ndefined under Section 2(b) of the Act.\n<\/p>\n<p>3.\t\tLearned<br \/>\ncounsel for the detenu submits that order of detention impugned in<br \/>\nthis petition deserves to be quashed and set aside on the ground that<br \/>\none solitary incident alleged against<br \/>\nthe detenu  is not of such magnitude and intensity as to have the<br \/>\neffect of disturbing the public order so as to pass an order under<br \/>\nSection 3(1) of the PASA Act. He has further submitted that the<br \/>\ndetaining authority has not applied his mind to the vital facts and<br \/>\nthere was non-application of mind before recording the order of<br \/>\ndetention. In support of the above contention, the learned counsel<br \/>\nhas relied upon the following case-laws:\n<\/p>\n<p>4.\t\tJudgment<br \/>\nand order dated 22.8.2000 of the Division Bench of this Court (Coram:<br \/>\nM.R. Calla &amp; R.R. Tripathi, JJ.), in Letters Patent Appeal No.223<br \/>\nof 2000 in Special Civil Application No.554 of 2000 <a href=\"\/doc\/1069201\/\">(Ashok Balabhai<br \/>\nMakwana vs. State of Gujarat)<\/a>;\n<\/p>\n<p><a href=\"\/doc\/193102690\/\">Piyush<br \/>\n\tKantilal Mehta vs. Commissioner of<\/a> police, AIR 1989 Supreme Court<br \/>\n<span class=\"hidden_text\">\t491<\/span><\/p>\n<p><a href=\"\/doc\/195612027\/\">Om<br \/>\n\tPrakash vs. Commissioner of Police and others<\/a>, JT 1989 (4) SC 177<\/p>\n<p>Kanuji<br \/>\n\tS. Zala vs. state of Gujarat and others, 1999 (2) GLH 415.\n<\/p>\n<p>5.\t\tLearned<br \/>\nAGP for the respondent-State supported the detention order passed by<br \/>\nthe authority and submitted that sufficient material and evidence was<br \/>\nfound during the course of investigation, which was also supplied to<br \/>\nthe detenu, indicating that the detenu is in the habit of indulging<br \/>\ninto activities as defined under Section 2(b) of the Act and,<br \/>\nconsidering the facts of the case, the detaining authority has<br \/>\nrightly passed the order of detention and the detention order<br \/>\ndeserves to be upheld by this Court.\n<\/p>\n<p>6.\t\tHaving<br \/>\nheard learned counsel for the parties and considering the facts and<br \/>\ncircumstances of the case, it appears that the subjective<br \/>\nsatisfaction arrived at by the detaining authority cannot be said to<br \/>\nbe legal, valid and in accordance with law inasmuch as the offences<br \/>\nalleged in the one  FIR cannot have any bearing on the public order<br \/>\nsince the law of the land i.e. Indian Penal Code and other relevant<br \/>\npenal laws are sufficient enough to take care of the situation and<br \/>\nthat the allegations as have been levelled against the detenu cannot<br \/>\nbe said to be germane for the purpose of bringing the detenu  within<br \/>\nthe meaning of Section 2(b) of the Act unless and until the material<br \/>\nis there to make out a case that the person concerned has become a<br \/>\nthreat and a menace to the society so as to disturb the whole tempo<br \/>\nof the society and that the whole social apparatus is in peril<br \/>\ndisturbing the public order at the instance of such person.  In view<br \/>\nof the ratio laid down by the Hon&#8217;ble Supreme Court in the decisions<br \/>\ncited by the learned counsel for the petitioner,<br \/>\nthe Court is of the opinion that the activities of the detenu<br \/>\ncannot be said to be dangerous to the maintenance of the public order<br \/>\nand at the most fall under the maintenance of &#8220;law and order&#8221;.\n<\/p>\n<p>7.\t\tIn<br \/>\nthe result, this Special Civil Application is allowed. The impugned<br \/>\norder of detention dated 21.8.2010 passed by the respondent<br \/>\nNo. 2 is hereby quashed and set aside.  The detenu is ordered<br \/>\nto be set at liberty forthwith if not required in any other case.<br \/>\nRule is made absolute accordingly.  Direct service is permitted.\n<\/p>\n<p>(ANANT S.
