Justice ANTONY DOMINIC\n\n Dated :06\/01\/2009\n\n O R D E R\n                            ANTONY DOMINIC, J.\n                             ---------------------------\n                            W.P.(C) No. 521 of 2009\n                         ------------------------------------\n                    Dated this the 6th day of January, 2009\n\n                                  JUDGMENT\n<\/pre>\n<p>      Complaint of the petitioner is regarding the alleged deduction\/<\/p>\n<p>recovery towards Contractor&#8217;s Profit and Overhead Charges on cost of<\/p>\n<p>Bitumen supplied by the department for the amounts due to him in relation<\/p>\n<p>to the nine agreements i.e he had entertained into with the first respondent<\/p>\n<p>for executing works on contract basis. Complaining of the recovery<\/p>\n<p>effected, he has filed Exhibit P3 representation before the first respondent<\/p>\n<p>and in this writ petition, it is alleged that not only that the request has not<\/p>\n<p>been considered but even representation has not been answered.<\/p>\n<p>       Taking into account the aforesaid grievance of the writ petitioner, it<\/p>\n<p>is directed that the first respondent shall consider Exhibit P3, if the same is<\/p>\n<p>pending as expeditiously as possible at any rate within six weeks from the<\/p>\n<p>date of production of copy of this judgment along with a copy of his writ<\/p>\n<p>petition.\n<\/p>\n<p>      The Petitioner shall produce a copy of this judgment before the first<\/p>\n<p>respondent for compliance.\n<\/p>\n<\/p>\n<p>                                      ANTONY DOMINIC, JUDGE<br \/>\nscm<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court R.Sugathan vs The Executive Engineer on 6 January, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 521 of 2009(K) 1.
