Civil Application No.10\/2008.\n<\/p>\n<p>Before<br \/>\n\tfiling the present petition, the petitioner filed Special Civil<br \/>\n\tApplication No.6417\/2010 before this Court challenging the award of<br \/>\n\tthe Labour Court dated 12th December 2007. However, it<br \/>\n\twas brought to the notice of the Court in that petition that the<br \/>\n\tMisc. Civil Application filed by the petitioner was also rejected on<br \/>\n\t4th February 2010 and hence, the said petition was<br \/>\n\tdisposed of on 16th June 2010 reserving liberty to the<br \/>\n\tpetitioner to file fresh petition challenging both the orders passed<br \/>\n\tby the Labour Court. Accordingly, the present petition is filed.\n<\/p>\n<p>Heard<br \/>\n\tMr.Maharshi Patel, the learned advocate appearing for M\/s.H.L.Patel<br \/>\n\tAdvocates for the petitioner and Mr.Manish Patel, the learned<br \/>\n\tadvocate appearing for the respondent.\n<\/p>\n<p>There<br \/>\n\tis no dispute about the fact that the original award passed by the<br \/>\n\tLabour Court on 12th December 2007 was an ex-parte award.<br \/>\n\tIt is submitted that the notice was duly served on the petitioner.<br \/>\n\tHowever, looking to the illness of the advocate appearing for the<br \/>\n\tpetitioner before the Labour Court, the proper representation could<br \/>\n\tnot be made and hence, the Labour Court was constrained to pass an<br \/>\n\tex-parte award. Even the Misc. Civil Application filed by the<br \/>\n\tpetitioner for setting aside the ex-parte award and to decide the<br \/>\n\tsame on merits, was also rejected on 4th February 2010.<br \/>\n\tWhile rejecting the Misc. Civil Application, the Labour Court has<br \/>\n\tobserved that, &#8216;no proper explanation was given for not pursuing the<br \/>\n\treference and hence, the said application is rejected&#8217;.\n<\/p>\n<p>Considering<br \/>\n\tthe facts and circumstances of the case and the submissions made by<br \/>\n\tthe learned counsels, the Court is of the view that interest of<br \/>\n\tjustice requires fair opportunities to be granted to the parties.<br \/>\n\tHowever, looking to the lapses on the part of the petitioner, the<br \/>\n\tpetitioner is required to be saddled with cost while setting aside<br \/>\n\tthe impugned order passed by the Labour Court. Accordingly, the<br \/>\n\tpresent petition is allowed and the impugned award dated 12th<br \/>\n\tDecember 2007 as well as the order dated 4th February<br \/>\n\t2010 are hereby quashed and set-aside with cost of Rs.10,000=00,<br \/>\n\twhich shall be paid by the petitioner to the respondent within a<br \/>\n\tperiod of 30 days from today and the matter is remanded to the<br \/>\n\tLabour Court to decide it afresh  and on merits and after giving<br \/>\n\tadequate opportunity to both the parties.\n<\/p>\n<p>The<br \/>\n\tLabour Court shall decide the matter as expeditiously as possible<br \/>\n\tpreferably within a period of six months from the date of receipt of<br \/>\n\tthe writ or from the date of receipt of the certified copy,<br \/>\n\twhichever is earlier.\n<\/p>\n<p>It<br \/>\n\tis made clear that if the petitioner fails to pay the cost of<br \/>\n\tRs.10,000=00 to the respondent, this order would not come into<br \/>\n\toperation and the orders passed by the Labour Court would be upheld.\n<\/p>\n<p>Subject<br \/>\n\tto the above directions and observations, this petition is<br \/>\n\taccordingly disposed of.\n<\/p>\n<p>(K.A.Puj,<br \/>\nJ.)<\/p>\n<p>\/moin<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court District vs Sudhirkumar on 23 December, 2010 Author: K.A.Puj,&amp;Nbsp;
