Justice K.T.SANKARAN\n\n Dated :25\/02\/2010\n\n O R D E R\n                        K.T.SANKARAN, J.\n                  ---------------------------------------------\n                        B.A.No.962 of 2010\n                  ---------------------------------------------\n            Dated this the 25th day of February, 2010\n\n\n\n                               O R D E R\n<\/pre>\n<p>        This is an application for bail under Section 439 of the<\/p>\n<p>Code of Criminal Procedure. The petitioner is the sole accused<\/p>\n<p>in Crime No.2713 of 2009 of Perumbavoor Police Station.<\/p>\n<p>      2.   The offences alleged against the petitioner are under<\/p>\n<p>Sections 489B and 489C of the Indian Penal Code.<\/p>\n<p>      3.   The date of occurrence was on 31.12.2009.               The<\/p>\n<p>petitioner went to State Bank of India, Perumbavoor branch to<\/p>\n<p>deposit Rs.8,000\/-. The Bank officials found that four currency<\/p>\n<p>notes of the denomination of Rs.500\/- given by the petitioner<\/p>\n<p>were fake currency notes. On information given to the police,<\/p>\n<p>the petitioner was arrested. The petitioner is in judicial custody<\/p>\n<p>since 31.12.2009.\n<\/p>\n<p>      4.   The learned Public Prosecutor opposed the Bail<\/p>\n<p>application. It is submitted that the petitioner belongs to Bihar<\/p>\n<p>and he has no permanent known about in Kerala. The<\/p>\n<p>investigation is now being conducted by CBCID. If the petitioner<\/p>\n<p><span class=\"hidden_text\">BA No.962\/2010                   2<\/span><\/p>\n<p>is released on bail at this stage, he would abscond, submits the<\/p>\n<p>learned Public Prosecutor.\n<\/p>\n<p>      5.    Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioner, the nature of the offence, the present stage of<\/p>\n<p>investigation and the fact that the petitioner is in judicial custody<\/p>\n<p>since 31.12.2009, I am of the view that, to ensure the presence<\/p>\n<p>of the petitioner before court during trial, some stringent<\/p>\n<p>conditions are necessary while granting bail.<\/p>\n<p>      The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.50,000\/- with two solvent sureties, of whom one shall<\/p>\n<p>be a person belonging to State of Kerala and who own<\/p>\n<p>immovable properties in the State of Kerala, for the like amount<\/p>\n<p>to the satisfaction of the Judicial Magistrate of the First Class,<\/p>\n<p>Perumbavoor, subject to the following conditions:<\/p>\n<p>a)    The petitioner shall report before the investigating officer<br \/>\n      between 9 A.M. and        11 A.M.     on all Mondays and<br \/>\n      Thursdays, till the final report is filed or until further<br \/>\n      orders;\n<\/p>\n<p>b)    The petitioner shall appear before the investigating officer<br \/>\n      for interrogation as and when required;\n<\/p>\n<p>c)    The petitioner shall not try to influence the prosecution<\/p>\n<p><span class=\"hidden_text\">BA No.962\/2010                    3<\/span><\/p>\n<p>     witnesses or tamper with the evidence;\n<\/p>\n<p>d)   The petitioner shall not commit any offence or indulge in<br \/>\n     any prejudicial activity while on bail;\n<\/p>\n<p>e)   In case of breach of any of the conditions mentioned above,<br \/>\n     the bail shall be liable to be cancelled.\n<\/p>\n<p>     The sureties shall produce the title deeds in respect of their<\/p>\n<p>properties for perusal by the court to ensure the court that they<\/p>\n<p>hold immovable properties in the State of Kerala.<\/p>\n<p>     The Bail Application is allowed as above.<\/p>\n<p>                                              K.T.SANKARAN,<br \/>\n                                                    JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Durgesh Kumar vs State Of Kerala on 25 February, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 962 of 2010() 1.
