M. SAHAI)<\/p>\n<p>We<\/a><br \/>\n\thave heard Mr. Anand B. Gogia, learned counsel for the petitioner.\n<\/p>\n<p>This<br \/>\n\twrit petition has been filed challenging the order dated 20.04.2011<br \/>\n\tpassed by the Central Administrative Tribunal, Ahmedabad Bench,<br \/>\n\tAhmedabad in O.A. No.138 of 2010.\n<\/p>\n<p>The<br \/>\n\tfather of the petitioner who was working as Record Keeper in the<br \/>\n\toffice of Principal Director of Audit, Western Railway, Rajkot died<br \/>\n\tin harness on 05.01.1999.  The widow sought an appointment on<br \/>\n\tcompassionate ground. She was informed that there was no post<br \/>\n\tavailable in Group &#8216;D&#8217; cadre and, therefore, her application for<br \/>\n\tcompassionate appointment was rejected.  After rejection of her<br \/>\n\tapplication, she moved another application that her minor son be<br \/>\n\tappointed on compassionate ground.  Subsequently, the petitioner who<br \/>\n\tbecame major, applied for appointment on compassionate ground.  His<br \/>\n\tname was noted.  But, the claim for compassionate appointment was<br \/>\n\trejected.\n<\/p>\n<p>We<br \/>\n\tare of the opinion that once the compassionate appointment has been<br \/>\n\trefused to the widow of the deceased, no right is conferred<br \/>\n\tthereafter on the son to move application for compassionate<br \/>\n\tappointment.  It is well settled that compassionate appointments are<br \/>\n\tprovided to meet immediate exigencies in the family to tide over the<br \/>\n\tfinancial crisis.  It is not a source of recruitment.  The father of<br \/>\n\tthe petitioner died on 05.01.1999.  The family has survived for a<br \/>\n\tperiod of 12 years.  Further, the application moved by widow for<br \/>\n\tgrant of compassionate appointment which was rejected, was not<br \/>\n\tchallenged by the widow.\n<\/p>\n<p>For<br \/>\n\tthe aforesaid reason, we do not find any merits in the claim of<br \/>\n\tcompassionate appointment made by the petitioner nor any illegality<br \/>\n\tin the impugned order passed by the respondents or by the Tribunal.<br \/>\n\tThis petition is devoid of any merits and is accordingly dismissed.\n<\/p>\n<p>\t\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>\t\t\t\t\t\t\t\t[V.
