KODEKAR, APP, for Respondent(s) : 1, \nNone\nfor Respondent(s) :\n2, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 09\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>1.\t\tRule.\n<\/p>\n<p>Mr. Kodekar, learned APP, waives service of Rule on behalf of the<br \/>\nrespondent State of Gujarat.\n<\/p>\n<p>2.\t\tHaving<br \/>\nregard to the facts of the case, this application is taken up for<br \/>\nhearing today.\n<\/p>\n<p>3.\t\tThe<br \/>\napplicant convict-prisoner, who, vide judgement and order dated<br \/>\n30.6.2005 rendered in Sessions Case No. 19 of 2005 by learned<br \/>\nAdditional Sessions Judge, Fast Track Court No. 6, Panchmanal at<br \/>\nGodhra, has been convicted for the offence under Sections 302, 452 of<br \/>\nthe Indian Penal Code and sentenced to imprisonment for life, has<br \/>\nfiled this application through jail praying for suspension of<br \/>\nsentence and to release him on bail during the pendency and final<br \/>\nhearing of the above numbered Criminal Appeal. Alternative, it is<br \/>\nalso prayed for expediting the hearing of the appeal.\n<\/p>\n<p>4.\t\tWe<br \/>\nhave considered the submissions advanced by Mr. Kodekar, learned APP<br \/>\nfor the respondent State of Gujarat. We have also perused the<br \/>\naverments made in the application and the jail remarks sheet so also<br \/>\nthe impugned judgement and order.\n<\/p>\n<p>5.\t\tUpon<br \/>\nperusal of the judgement and order of  conviction and sentence<br \/>\nrecorded against the accused as well as the evidence adduced in<br \/>\ntrial, we have noticed that the case against the accused is based on<br \/>\nthe oral testimony of the eye witness and the eye witness in terms<br \/>\ndeposed before the Court about the role played by the applicant in<br \/>\ncommitting the crime. Therefore,  prima facie, the decision of the<br \/>\ntrial Court convicting the applicant under Section 302 of the Indian<br \/>\nPenal Code cannot be regarded as erroneous at this stage.\n<\/p>\n<p>6.\t\tThe<br \/>\nSupreme Court in several recent decisions has cautioned the High<br \/>\nCourts that after conviction of an accused under section 302 of the<br \/>\nIndian Penal Code, the relief of regular bail should not  be granted<br \/>\nby the High Courts.  Reference can be made to the decisions rendered<br \/>\nin case of (1) JADEJA AJITSINH NATUBHA AND ORS. Vs. STATE OF GUJARAT,<br \/>\n21 GLR 571, (2) STATE OF HARYANA VS.HASMAT, (2004)6 SCC  175,(3)<br \/>\nS.JEEVANANTHAM VS. STATE THROUGH INSPECTOR OF POLICE, T.N. (2004) 5<br \/>\nSCC 230, (4) <a href=\"\/doc\/1092777\/\">STATE Represented By Inspector Of Police, Vigilance &amp;<br \/>\nAnti-Corruption, Tiruchirapalli, T.N. Vs. V. JAYAPAUL<\/a> (2004) 5 SCC<br \/>\n223 and (5) KISHORI LAL<br \/>\nVs. RUPA AND OTHERS (2004) 7 SCC 638.\n<\/p>\n<p>7.\t\tOn<br \/>\nthe facts and in the circumstances of the case this<br \/>\nCourt is of the opinion that no ground is made out by the applicant<br \/>\nto release him on regular bail during the pendency and<br \/>\nfinal disposal of the appeal filed by him.\n<\/p>\n<p>8.\t\tSo<br \/>\nfar as the prayer for early hearing of the appeal is concerned, it<br \/>\nmay be noted that upon perusal of the jail mark sheets we have<br \/>\nnoticed that the applicant has undergone  5 years 8 months 11 days<br \/>\nsentence as against the imprisonment for life and when he was<br \/>\nreleased on furlough leave he has absconded for 194 days. Therefore,<br \/>\npolice has arrested and sent him to jail. In view of this also, the<br \/>\nprayer for early hearing of the appeal cannot be granted.\n<\/p>\n<p>9.\t\tFor<br \/>\nforegoing reasons, the application fails and it is accordingly<br \/>\nrejected.\n<\/p>\n<p>10.\t\tRule<br \/>\nis discharged.\n<\/p>\n<p>   (A.M.
