PATTANAIK (J)\n\nCITATION:\n JT 1996 (5)   378\t  1996 SCALE  (4)163\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     We have heard the learned counsel on both sides.<br \/>\n     The appellant  was appointed as a direct recruit to the<br \/>\nM.P. State  Civil Service  [Deputy Collector]  on January  7<br \/>\n1967 and  jointed the  service on  February 15, 1967. He was<br \/>\nput on\tprobation w.e.f.  the said  date. He  had passed the<br \/>\nprescribed  test  on  June  27.\t 1972.\tThe  Government\t had<br \/>\nconfirmed his  appointment on  regular basis  on  march\t 13,<br \/>\n1973. The  appellant has  sought his confirmation w.e.f. his<br \/>\ndate of\t joining the  duty,  viz.,  February  15,  1967\t and<br \/>\nclaimed seniority  from that  date.  The  Tribunal  has\t not<br \/>\ngranted the  relief in\tO.A. No.521  of 1988  by order dated<br \/>\nDecember 17, 1992. Thus this appeal by special leave.\n<\/p>\n<p>     The learned  counsel for  the appellant  has  contended<br \/>\nthat since  he has been appointed w.e.f. the date of joining<br \/>\nof duty,  his seniority\t should be reckoned from the date of<br \/>\nhis starting  discharging duty\tof the\tpost, viz., February<br \/>\n15, 1967.  As he has not been discharged from service due to<br \/>\nhis failure to pass the test, though he passed his test at a<br \/>\nlater, he  must be  deemed to have been confirmed w.e.f. the<br \/>\ndate of\t his joining  the duty.\t Therefore, the seniority is<br \/>\nrequired to be confirmed from that date. We find no force in<br \/>\nthe contention.\t Indisputably, the  appellant is governed by<br \/>\nthe Madhya  Pradesh Civil  services [General  Conditions  of<br \/>\nService] Rules,\t 1961 [for short, the &#8216;Rules&#8217;]. Clause 2 [9]<br \/>\ndefines &#8216;service&#8217; to mean a service of group of posts in<br \/>\nconnection with\t the affairs  of the  State other  than\t the<br \/>\nIndian Administrative Service and the Indian Police Service<br \/>\norganized as  such by  the Government. Rule 4 classifies the<br \/>\npost with  which we  are not  concerned. Rule  8  prescribes<br \/>\nprobation. Rule 8 [1] envisages that a person appointed to a<br \/>\nservice or  post by  direct recruitment\t shall ordinarily be<br \/>\nplaced on  probation for  such period  as may be prescribed.<br \/>\nThe appointing authority may, for sufficient reasons, extend<br \/>\nthe period  of probation  by a\tfurther period not exceeding<br \/>\none year.  The probationer  has to undergo such training and<br \/>\npass such  departmental examination during the period of his<br \/>\nprobation as  may be  prescribed. Sub-rules  (4) and (5) are<br \/>\nnot relevant  and are  omitted. Sub-rule  (6) of  Rule 8  is<br \/>\nrelevant for the purpose of the case which envisages that on<br \/>\nsuccessful  completion\t of  probation\t and   passing\t the<br \/>\nprescribed departmental examination, if any, the probationer<br \/>\nshall, if  there is a permanent post available, be confirmed<br \/>\nin the\tservice or  post to  which he  has  been  appointed.<br \/>\nOtherwise a certificate shall be issued in his favour by the<br \/>\nappointing authority  to the  effect  that  the\t probationer<br \/>\nwould have  been confirmed  but for  the non-availability of<br \/>\nthe permanent  post. As\t soon as  a permanent  post  becomes<br \/>\navailable, he  will be\tconfirmed.  Under  sub-rule  (7),  a<br \/>\nprobationer,  who   has\t neither   been\t confirmed   nor   a<br \/>\ncertificate issued  in his favour under sub-rule [6], nor is<br \/>\nhe discharged  from service  under sub-rule [4], he shall be<br \/>\ndeemed to  have been  appointed as  a  temporary  Government<br \/>\nservice w.e  f. the  date of  expiry of\t probation  and\t his<br \/>\nconditions of  service\tshall  be  governed  by\t the  Madhya<br \/>\nPradesh Government  Servants [Temporary\t and Quasi-Permanent<br \/>\nService] Rules, 1960.\n<\/p>\n<p>     Under Rule\t 12, the  seniority of\tthe members  of\t the<br \/>\nservice of  a district\tbranch or  group of  posts  of\tthat<br \/>\nservice,  shall\t  be  determined   in  accordance  with\t the<br \/>\nprinciples laid\t down therein.\tSub-clause [i] of Clause [a]<br \/>\nenvisages  that\t  the  seniority  of  a\t directly  recruited<br \/>\nGovernment servant appointed on probation shall count during<br \/>\nhis probation  from the date of his appointment; the proviso<br \/>\nis not\trelevant. Sub-clause  [A] envisages  that  the\tsame<br \/>\nunder of inter se seniority of direct recruits maintained by<br \/>\nconfirmation of the normal period of probation. If, however,<br \/>\nthe period  of probation  of any direct recruit is extended,<br \/>\nthe appointing\tauthority should  determine  the  date\tfrom<br \/>\nwhich the  candidate should be assigned seniority. Until the<br \/>\nprobation is  declared and  he was confirmed in the post, he<br \/>\ndoes  not   became  a\tmember\tof  the\t service  successful<br \/>\ncompletion of the probation and pass of the prescribed tests<br \/>\nor conditions  precedent to  declare the probation. So, mere<br \/>\npassage of  time of  one year does not entitle a probationer<br \/>\nto be  a  member  of  the  service.  He\t remains  to  be  on<br \/>\ntemporarily  service.\tOn  declaration\t of  probation,\t the<br \/>\nappointing  authority  should  confirm\tin  a  pending\tpost<br \/>\navailable or to grant quasi-permanent status. As soon as the<br \/>\npost is\t available. he\tshould be  confirmed. In view of the<br \/>\nadmitted position  that\t he  did  not  pass  the  test,\t the<br \/>\nappointing authority  considered that his seniority would be<br \/>\ncounted w.e.f. the date of his passing the test. Rule 12 [a]\n<\/p>\n<p>(ii) clearly empowers the appointing authority to assign, in<br \/>\nthese circumstances,  the seniority  in lower level than the<br \/>\none assigned  by the  Public Service  Commission. We  do not<br \/>\nfind any  illegality committed\tby the authorities in giving<br \/>\nseniority from the date of his passing the test.\n<\/p>\n<p>     The appeal is accordingly dismissed.
